SUBJECT:
Items Relating to Gateway Mountain Park.
RECOMMENDATION:
Staff recommends the adoption of Resolution and Ordinance on First Reading.
FINANCIAL IMPACT:
Adoption of the Resolution and Ordinance will appropriate unanticipated revenue from the State
of Colorado, Department of Transportation into the Gateway Mountain Park account.
The $260,000 project will be funded by a $182,000 (70%) grant from the Colorado Scenic and
Historical Byways Program. The City's matching funds in the amount of$78,000 (30%) for this
grant have been appropriated into the Gateway Mountain Park account by Ordinance No. 5,
2000. The City has funds budgeted in 2001 for the maintenance and operation of Gateway
Mountain Park.
EXECUTIVE SUMMARY:
A. Resolution 2001-7 Authorizing the Mayor to Enter into an Intergovernmental Agreement
with the State Department of Transportation for a Colorado Scenic and Historic Byways
Program Grant for Gateway Mountain Park.
B. First Reading of Ordinance No. 9, 2001, Appropriating Unanticipated Revenue in the
Capital Projects Fund for Gateway Mountain Park.
Gateway Mountain Park is a 400-acre site located five miles up the Poudre Canyon. The site is
owned by the City of Fort Collins and was previously the City's Water Treatment Plant. The
City Council has provided direction to make the property accessible to the public as a park.
The Friends of the Poudre, on behalf of the City, applied for the Scenic Byway Grant. The City
will be receiving the $182,000 grant from the Colorado Scenic and Historical Byways program.
The Colorado Department of Transportation, administers the program. The grant funds will be
used to help with development of Park facilities. Grant funds will be used to fund such items as
road improvements, picnic shelter(s), restroom(s), an environmental kiosk, interpretative paths
and signs and other site amenities. The funds will be used in years 2001 and 2002 as the Park is
developed for public use.
RESOLUTION 2001-7
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE MAYOR TO ENTER INTO AN
INTERGOVERNMENTAL AGREEMENT
WITH THE STATE DEPARTMENT OF TRANSPORTATION FOR
A COLORADO SCENIC AND HISTORIC BYWAYS PROGRAM GRANT
FOR GATEWAY MOUNTAIN PARK
WHEREAS,the City of Fort Collins owns a 400-acre site located approximately five miles
up the Poudre Canyon, which property was formerly known as the City's Water Treatment Plant
No.1, a portion of which will be developed as Gateway Mountain Park; and
WHEREAS, in order to make the Park accessible to the public, it will be necessary to
complete a realignment of and substantial improvements to the entry road to the Park from Highway
14(the"Park Road Project"),plans for which originally called for an estimated construction cost of
$1,120,000; and
WHEREAS, on August 18, 1998, City Council adopted Resolution 98-113 authorizing the
City to contract with the Colorado Department of Transportation ("CDOT")for the realignment of
the entry road to Gateway Mountain Park; and
WHEREAS, on September 1, 1998, City Council adopted Ordinance No. 135, 1998,
appropriating$664,000 to be used for improvements associated with the Park Road Project,with the
understanding that the remaining funds ($456,000) would be appropriated in 1999 and 2000; and
WHEREAS, CDOT has previously made available an additional $59,000 in 1999 and
$170,000 in 2000 to be used for the Park Road Project and Council appropriated these funds
pursuant to Ordinance No. 71, 1999, and Ordinance No. 5, 2000; and
WHEREAS, the revised estimate for design and construction of the Park Road Project
reflects a reduction from $1,120,000 to$893,000 due to changes in the original design, lower than
anticipated construction costs, and requests from Great Outdoors Colorado and the Colorado
Division of Wildlife that their funds be used for park development,rather than road improvements;
and
WHEREAS, CDOT administers a Colorado Scenic and Historical Byways grant program,
and has, through that program, awarded a grant in the amount of $182,000 to the City for its
Gateway Mountain Park project, including the Park Road Project; and
WHEREAS, the grant funds will be used to fund such items as road improvements, picnic
shelters,restrooms,environmental educational displays,paths and signs,and other site amenities for
Gateway Mountain Park; and
WHEREAS,sufficient City funds($78,000)were appropriated in Ordinance No. 135, 1998,
to match 30% of the new grant total; and
WHEREAS,the City has the power to enter into intergovernmental agreements with the State
of Colorado under Article II, Section 16 of the Charter of the City.
NOW, THEREFORE, BE IT RESOLVED BY COUNCIL OF THE CITY OF FORT
COLLINS, that the Mayor is hereby authorized to enter into an Intergovernmental Agreement
between the City and the State of Colorado, State Department of Transportation, providing for the
grant of $182,000 to the City for the City's Gateway Mountain Park project, together with such
subsequent amendments and addenda, including any amendments increasing the amount of Scenic
and Historical Byways grant funds to be provided to the City for Gateway Mountain Park so long
as all City matching funds have been appropriated,provided that the City Manager,in consultation
with the City Attorney, determines that any such amendments or addenda are in the best interests
of the City and recommends that the same be executed.
Passed and adopted at a regular meeting of the City Council of the City of Fort Collins held
this 16th day of January, A.D. 2001.

APPROPRIATING UNANTICIPATED REVENUE
IN THE CAPITAL PROJECTS FUND FOR
GATEWAY MOUNTAIN PARK
WHEREAS,the City of Fort Collins owns a 400-acre site located approximately five miles

with remaining dollars to be used for development of Gateway Park; and
WHEREAS,sufficient City funds($78,000)were appropriated in Ordinance No. 135, 1998,
to match 30% of the new grant total; and
WHEREAS,City Council adopted Resolution 2001-7, on January 16, 2001, authorizing an
intergovernmental agreement between the City of Fort Collins and the Colorado Department of
Transportation for the provision of $182,000 in Scenic and Historical Byways grant funding for
Gateway Mountain Park, including the Park Road Project; and
WHEREAS,Article V,Section 9,of the Charter of the City of Fort Collins permits the City
Council to make supplemental appropriations, by ordinance at any time during the fiscal year,
provided that the total amount of such supplemental appropriations,in combination with all previous
appropriations for that fiscal year, do not exceed the then current estimate of actual and anticipated
revenues to be received during the fiscal year; and
WHEREAS,it is the desire of the Council to appropriate the Colorado Scenic and Historical
Byways grant funds received from CDOT,totaling$182,000,in the Capital Projects Fund,Gateway
Mountain Park capital project, to be used for the design and development of the access road and
development of Gateway Mountain Park.
NOW,THEREFORE,BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the
Capital Projects Fund, Gateway Mountain Park capital project, the sum of ONE HUNDRED
EIGHTY-TWO THOUSAND DOLLARS($182;000),from Colorado Department of Transportation
Colorado Scenic and Historical Byways grant funds, to be used for the design and development of
the access road and development of Gateway Mountain Park.
Introduced, considered favorably on first reading and ordered published this 16th day of
January, A.D. 2001, and to be presented for final passage on the 6th day of February, A.D. 2001.
