SUBJECT
Second Reading of Ordinance No. 139, 2003 Amending Ordinance No. 097, 2003 Zoning
Property Known as the Swift Addition to the Fossil Lakes P.U.D. Annexation to Correct an Error
in the Legal Description Contained in Said Zoning Ordinance.
RECOMMENDATION
Staff recommends adoption of the Ordinance on Second Reading.
EXECUTIVE SUMMARY
On July 22, 2003, City Council adopted Ordinance No. 097, 2003, amending the Zoning Map of
the City of Fort Collins and classifying for zoning purposes the property included in the Swift
Addition to the Fossil Lakes PUD Annexation.
A typographical error in the legal description contained in the zoning ordinance, resulting in a
faulty legal description. This Ordinance, which was unanimously adopted on First Reading on
October 7, 2003, amends the original zoning ordinance by replacing the incorrect legal
description with an amended legal description.
ORDINANCE NO. 139, 2003
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING ORDINANCE NO.097, 2003 ZONING PROPERTY
KNOWN AS THE SWIFT ADDITION TO THE FOSSIL LAKES P.U.D.
ANNEXATION TO CORRECT AN ERROR IN THE LEGAL
DESCRIPTION CONTAINED IN SAID ZONING ORDINANCE
WHEREAS,on July 22, 2003,the Council adopted Ordinance No. 097,2003, (the "Zoning
Ordinance") amending the Zoning Map of the City of Fort Collins and classifying for zoning
purposes the property included in the Swift Addition to the Fossil Lakes P.U.D. Annexation; and
WHEREAS,the legal description of the parcels as shown in the Zoning Ordinance contained
typographical errors; and
WHEREAS, the purpose of this Ordinance is to correct those errors in the legal description
contained in the Zoning Ordinance.
NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That Ordinance No. 097, 2003,is hereby amended so as to replace the legal
description of Parcel A contained therein with the legal description shown below:
A parcel of land being a part of the East Half of Section Nine (9), Township Six
North (T.6N.), Range Sixty-eight West (R.68W.), of the Sixth Principal Meridian
(6th P.M.), County of Latimer, State of Colorado and being more particularly
described as follows:
COMMENCING at the Center — North Sixteenth Corner of said Section 9 and
assuming the West line of the Northeast Quarter (NE1/4) of said Section 9 to bear
North 00°00'42" East, with all other bearing herein relative thereto:
THENCE South 00°00'42"West along said West line a distance of 815.71 feet to the
POINT OF BEGINNING;
THENCE South 90°00'00 East a distance of 365.37 feet to a Point of Curvature
(PC);
THENCE along the arc of a curve concave to the Southwest a distance of 196.35 feet,
whose radius is 250.00 feet, whose delta is 45°00'00", and whose long chord bears
South 67°30'00"East a distance of 191.34 feet to a Point of Curvature (PT);
THENCE South 45°00'00 East a distance of 228.51 feet;
THENCE North 45°00'00 East a distance of 129.68 feet to a PC;
THENCE along the arc of a curve concave to the Southeast a distance of 115.04 feet,
whose radius is 250.00 feet, whose delta is 26°21'52" and whose long chord bears
North 58°10'56"East a distance of 114.03 feet to a PT;
THENCE North 71°21'52"East a distance of 459.62 feet to a point on a curve, said
curve being non-tangent to the aforesaid line;
THENCE along the arc of a curve concave to the Southwest a distance of 56.78 feet,
whose radius is 850.00 feet, whose delta is 03°49'37" and whose long chord bears
South 16°43'19" East a distance of 56.77 feet;
THENCENorth 75011'29"East along a line being non-tangent to the aforesaid curve
a distance of 150.00 feet to a point on a curve, said curve being non-tangent to the
aforesaid line;
THENCE along the arc of a curve concave to the Southwest a distance of 292.62 feet,
whose radius is 1000.00 feet,whose Delta is 16°45'58", and whose long chord bears
North 23°11'30" West a distance of 291.58 feet;
THENCE North 58025'31"East along a line being non-tangent to the aforesaid curve
a distance of 222.47 feet;
THENCE South 41°07'09"East a distance of 51.38 feet;
THENCE South 39°26'21" East a distance of 87.37 feet;
THENCE South 30°04'10" East a distance of 23.94 feet;
THENCE South 26°19'46" East a distance of 30.78 feet;

Said parcel contains 28.045 Acres more or less (±), and is subject to any rights-of-
way or other easements of record or as now existing on said described parcel of land.
Section 2. That the City Engineeris hereby authorized and directed to amend said Zoning
Map in accordance with Section 1 of this Ordinance.
Section 3. That all other provisions contained in Ordinance No. 097, 2003, shall remain
in full force and effect.
