Second Reading of Ordinance No. 138,2003,Amending the Zoning Map of the City of Fort Collins
by Amending the Zoning Classification for that Certain Property Known as the City of Fort Collins
Vehicle Storage and Operations Service Maintenance Facility Rezoning.
RECOMMENDATION
Staff and the Planning and Zoning Board recommend adoption of the Ordinance on Second Reading.
EXECUTIVE SUMMARY
Ordinance No. 138, 2003, which was unanimously adopted on First Reading on October 7, 2003,
rezones three parcels of land at the northwest comer of Vine Drive and Wood Street,just west of
the existing City of Fort Collins Service Center.
The site contains the City's Fleet Service Building and is also used for material storage. The rezone
facilitates the expansion of the Fort Collins Service Center.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING THE ZONING MAP OF THE
CITY OF FORT COLLINS BY CHANGING THE ZONING
CLASSIFICATION FOR THAT CERTAIN PROPERTY KNOWN
AS THE CITY OF FORT COLLINS VEHICLE STORAGE AND OPERATIONS
SERVICE MAINTENANCE FACILITY REZONING
WHEREAS, Division 1.3 of the Fort Collins Land Use Code (the "Land Use Code")
establishes the Zoning Map and Zone Districts of the City; and
WHEREAS, Division 2.9 of the Land Use Code establishes procedures and criteria for
reviewing the rezoning of land; and
WHEREAS, in accordance with the foregoing, the Council has considered the rezoning of
the property which is the subject of this ordinance, and has determined that the said property should
be rezoned as hereafter provided; and
WHEREAS,the Council has further determined that the proposed rezoning is consistent with
the City's Comprehensive Plan and/or is warranted by changed conditions within the neighborhood
surrounding and including the subject property; and
WHEREAS, to the extent applicable, the Council has also analyzed the proposed rezoning
against the considerations as established in Section 2.9.4(H)(3) of the Land Use Code.
NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the Zoning Map adopted by Division 1.3 of the Land Use Code is hereby
amended by changing the zoning classification from"POL",Public Open Lands,to"E",Employment
Zone District, for the following described property in the City known the City of Fort Collins
Vehicle Storage and Operations Service Maintenance Facility Rezoning:
A TRACT OF LAND BEING A PORTION OF THE SOUTHWEST ONE-
QUARTER OF SECTION 2,TOWNSHIP 7 NORTH,RANGE 69 WEST OF THE
SIXTH PRINCIPAL MERIDIAN, CITY OF FORT COLLINS, COUNTY OF
LARIMER, STATE OF COLORADO, BEING DESCRIBED AS FOLLOWS:
BASIS OF BEARINGS: CONSIDERING THE SOUTH LINE OF THE
SOUTHWEST ONE-QUARTER OF SECTION 2 AS BEARING S 89°14'45"E AND
WITH ALL BEARINGS CONTAINED HEREIN RELATIVE THERETO:

Use Code be, and the same hereby is, changed and amended by showing that the above-described
property is included in the Residential Neighborhood Sign District.
Section 3. The City Manager is hereby authorized and directed to amend said Zoning
Map in accordance with this Ordinance.

This rezoning was adopted unanimouslya ing a Board on September 4, 2003,
by adoption of its Consent Agenda.
EXECUTIVE SUMMARY:
This is a request to rezone three parcels of land at the northwest comer of Vine Drive and Wood

The rezoning request is consistent with the City of Fort Collins Structure Plan. This plan represents
the land north of Vine Drive, 1/4 mile east of Shields Street for Employment uses. This designation
includes the existing Service Center site.

The property was annexed in 1987 and 1991as part of the Service Center Fourth and Fifth
Additions.

2. Ouasi-Judicial Rezoning
The properties included within the rezoning petition are less than 640 acre. Therefore, the
rezoning is considered a quasi-judicial rezoning.In order for the Planning and Zoning Board
to recommend approval of a rezoning to the City Council,the following criteria must be met:
A. Consistent with the City's Comprehensive Plan:
The requested Employment zoning is consistent with the City's Structure Plan,
which is an element of the Comprehensive Plan. The Structure Plan represents this
parcel as Employment0 Y
and/or P
B. Warranted by change in the neighborhood surrounding and including the subject
property:
The area to the east and west of the site has been developing as part of the City of
Fort Collins Service Center.City Utilities,including electric, stormwater,water and
wastewater and their associated equipment is located east of the site. Operation
Services has a Fleet Maintenance building at the northern portion of the site, and a
vehicle repair buil ' 'ust t of ite. Vep osed rezone will facilitate the

C. Additional Consideration for Ouasi-Judicial Rezonings:
In determining whether to recommend approval of any such proposed zoning
amendment, the Planning and Zoning Board and City Council may consider the
following additional factors:
(1) Whether and the extent to which the proposed amendment is compatible with

The area adjadent to the site has-develop with similar uses permitted in the
Employment District. east of I-25 has a rural character and density.Much of
the land is used for farming. The Urban Estate provides one of the lowest
maximum densities of the City zone districts, a maximum of two units/acre.
The land to the east of the site is zoned FA 1 in Latimer County,which would
permit a residential density less than that of Urban Estate.
The proposed UE zoning will provide greater compatibility with the area
than the existing Industrial zoning.

(2) Whether and the extent to which the proposed amendment would result in
significantly adverse impacts on the natural environment, including,but not
limited to water, noise, air, stormwater manaeement, wildlife, vegetation,
wetlands and the natural functioning of the environment.
The parcels are currently zoned POL—Public Open Lands. The purpose of
this zone district is to include larger, public owned parcels of land which
have a community-wide interest to be included within its own zoning.These
typically include public parks, natural areas, recreation facilities and golf
courses. While the City owns the parcel, it does not meet the criteria for the

The parcel is within 400 feet of the Poudre River. The site itself does not
contain any wetlands or other natural habitats which may warrant special
preservation, however, future study may be necessary when a project
development plan is proposed.
(3) Whether and the extent to which the proposed amendment would result in a
logical and orderly development pattern.

3. Request for E—Employment District Zoning
The applicant initially filed a rezoning petition with the City on July 11, 2003. The current
request is to rezone 15.25 acres from POL to E. The property is partially developed with
buildings, parking and drive aisles that are a part of the City's Service Center.
The purpose of the Employment Zone District is to provide a "locations for a variety of
workplaces, including('—gh,11d na es r a dev opment activities, office and

construction of buildinMoor spa S,t ortatio acilities and streetscapes;to direct
the development of workplaces consistent with the vitality and quality of life in adjacent
residential neighborhoods.
4. Neighborhood Response:
The Current Planning Department has scheduled a neighborhood information meeting for
this rezoning on August 26,2003.This meeting will be held after the publication of the staff
report. Staff will foreword notes from this meeting to the Planning and Zoning Board prior
to the September 4, 2003 hearing.

FINDINGS OF FACT/CONCLUSIONS
After reviewing the City of Fort Collins Vehicle Storage and Service Maintenance Facility rezoning,
File#23-03, staff makes the following findings of fact and conclusions as explained above:
A. The subject property for the City of Fort Collins Vehicle Storage and Service Maintenance
Facility Rezoning is designated as Employment on the City of Fort Collins Structure Plan,
an element of the City's Comprehensive Plan.
B. The proposed plan amendment will promote the public welfare and will be consistent with

RECOMMENDATION
Staff recommends that City Council approve the City of Fort Collins Vehicle Storage and Service
Maintenance Facility Rezoning#23-03, Amendment to the Zoning Map from POL—Public Open
Lands to E—Employment.
