SUBJECT:
Resolution 2003-108 Authorizing the Lease of City-Owned Property at 110 North Howes Street.
RECOMMENDATION:
Staff recommends adoption of the Resolution.
FINANCIAL IMPACT:
Rent collected from this lease will result in approximately $6,930 in unanticipated revenue to
Operation Services. Tenant will pay all expenses for utilities,janitorial and taxes.
EXECUTIVE SUMMARY:
The City and the County purchased the property located at 110 North Howes Street as part of the
Block 31 purchases. Consistent with the Intergovernmental Agreement dividing Block 31, the
County's interest in this property was quit claimed to the City. The County's Risk Management
Department was the last occupant of this building and vacated the building two years ago. This
space, which is 693 square feet in size, has been considered for other City users,but a current need
has not been identified. Staff has shown the space to a private business and negotiations are
continuing. Staff recommends leasing this site until this area of Block 31 is needed for future
improvements.
RESOLUTION 2003-108
OF THE COUNCIL OF THE CITY OF FORT COLLINS
AUTHORIZING THE LEASE OF CITY-OWNED PROPERTY AT
110 NORTH HOWES STREET
WHEREAS, the City of Fort Collins is the owner of property at 110 North Howes Street,
Fort Collins, Larimer County, Colorado (the "Property"); and
WHEREAS, the Property was purchased as part of the acquisition of Block 31 and there is
not a specific current use identified for this Property; and
WHEREAS, the City desires to lease this Property for a term of one year, with the City
having the option to renew for an additional year, at an annual rate of at (east $6,930; and
WHEREAS, the lease of the Property is beneficial in that it will generate revenue and will
provide for the occupation of the Property; and
WHEREAS, under Section 23-114 of the Code of the City of Fort Collins, the Council is
authorized to lease any and all interests in real property owned in the name of the City,provided that
Council first finds that the lease is in the best interests of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the Council hereby finds that the lease of the Property at 110 North
Howes Street as provided herein is in the best interests of the City.
Section 2. That the City Manager is hereby authorized to execute a lease agreement for
the Property, consistent with the terms of this Resolution, together with such additional terms and
conditions as the City Manager, in consultation with the City Attorney,determines to be necessary
and appropriate to protect the interests of the City.
