SUBJECT:
First Reading of Ordinance No. 139, 2003 Amending Ordinance No. 097, 2003 Zoning Property
Known as the Swift Addition to the Fossil Lakes P.U.D. Annexation to Correct an Error in the
Legal Description Contained in Said Zoning Ordinance.
RECOMMENDATION:
Staff recommends adoption of the Ordinance on First Reading.
EXECUTIVE SUMMARY:
On July 22, 2003, City Council adopted Ordinance No. 097, 2003 amending the Zoning Map of
the City of Fort Collins and classifying for zoning purposes the property included in the Swift
Addition to the Fossil Lakes PUD Annexation.
A typographical error in the legal description contained in the zoning ordinance, resulting in a
faulty legal description. This Ordinance amends the original zoning ordinance by replacing the
incorrect legal description with an amended legal description.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING ORDINANCE NO.097, 2003 ZONING PROPERTY
KNOWN AS THE SWIFT ADDITION TO THE FOSSIL LAKES P.U.D.
ANNEXATION TO CORRECT AN ERROR IN THE LEGAL
DESCRIPTION CONTAINED IN SAID ZONING ORDINANCE
WHEREAS, on July 22,2003,the Council adopted Ordinance No. 097,2003, (the"Zoning
Ordinance") amending the Zoning Map of the City of Fort Collins and classifying for zoning
purposes the property included in the Swift Addition to the Fossil Lakes P.U.D. Annexation; and
WHEREAS,the legal description of the parcels as shown in the Zoning Ordinance contained
typographical errors; and
WHEREAS,the purpose of this Ordinance is to correct those errors in the legal description
contained in the Zoning Ordinance.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That Ordinance No. 097, 2003, is hereby amended so as to replace the legal
description contained therein with the legal description shown below:
A parcel of land being a part of the East Half of Section Nine (9), Township Six North (T.6N.),
Range Sixty-eight West (R.68W.), of the Sixth Principal Meridian (6th P.M.), County of Larimer,
State of Colorado and being more particularly described as follows:
COMMENCING at the Center — North Sixteenth Corner of said Section 9 and
assuming the West line of the Northeast Quarter (NE1/4) of said Section 9 to bear
North 00°00'42"East, with all other bearing herein relative thereto:
THENCE South 00°00'42"West along said West line a distance of 815.71 feet to the
POINT OF BEGINNING;
THENCE South 90°00'00 East a distance of 365.37 feet to a Point of Curvature
(PC);
THENCE along the arc of a curve concave to the Southwest a distance of 196.35 feet,

Section 3. That all other provisions contained in Ordinance No. 097, 2003, shall remain
in full force and effect.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
AMENDING THE ZONING MAP OF THE CITY OF FORT COLLINS
AND CLASSIFYING FOR ZONING PURPOSES THE PROPERTY INCLUDED
IN THE SWIFT ADDITION TO FOSSIL LAKE P.U.D. ANNEXATION TO THE
CITY OF FORT COLLINS, COLORADO
WHEREAS, Division 1.3 of the Land Use Code of the City of Fort Collins establishes the
Zoning Map and Zone Districts of the City; and
WHEREAS, Division 2.9 of the Land Use Code of the City of Fort Collins establishes
procedures and criteria for reviewing the zoning of land; and
WHEREAS,in accordance with the foregoing,the Council has considered the zoning of the
property which is the subject of this ordinance,and has determined that the said property should be
zoned as hereafter provided.
NOW THEREFORE BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS as follows:
Section 1. That the Zoning Map of the City of Fort Collins adopted pursuant to Section
1.3.2 of the Land Use Code of the City of Fort Collins is hereby amended by including the two
parcels of property referenced below as Parcels "A" and "B", known collectively as the Swift
Addition to Fossil Lake P.U.D. Annexation to the City of Fort Collins, Colorado, and by placing
such parcels into the Urban Estate (UE) Zone District and the in the Low Density Mixed Use
Neighborhood (LMN) Zone District as follows:
PARCEL "A" - TO BE PLACED INTO THE URBAN ESTATE (UF) DISTRICT•
A parcel of land being a part of the East Half of Section Nine (9), Township Six

described property is included in the Residential Neighborhood Sign District.

Map in accordance with this Ordinance.
