EXECUTIVE SUMMARY: This Ordinance, which was unanimously adopted on First Reading on September 16, 2003, appropriates funds to install a median on College Avenue at the Lake Street intersection. BACKGROUND: The intersection of College Avenue and Lake Street is currently a full movement, stop controlled intersection. This intersection also has the highest number of accidents for any stop controlled intersection within Fort Collins. Over the past four years, there have been 55 accidents at this location,many of which have involved injury. In the Fall of 2002,the City staff applied for,and was awarded a Hazard Elimination Grant in the amount of$186,000 to construct a median on College Avenue that would prevent the north and southbound left turns as well as the east and westbound left and through movements. In effect, Lake Street will become a right-in/right-out access onto College Avenue. ORDINANCE NO. 127, 2003 OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROPRIATING UNANTICIPATED GRANT REVENUE IN THE TRANSPORTATION SERVICES FUND - COLLEGE AVENUE/LAKE STREET MEDIAN PROJECT TO BE USED TO INSTALL A MEDIAN TO IMPROVE SAFETY AT THE INTERSECTION OF COLLEGE AVENUE AND LAKE STREET WHEREAS, the intersection at College Avenue and Lake Street, a full movement, stop controlled intersection, has the highest number of accidents for any stop controlled intersection within Fort Collins; and WHEREAS, in the fall of 2002, the City applied for and received a total of $186,000 in Federal Hazard Elimination grant funds to pay for 100% of the cost of constructing a median on College Avenue at Lake Street for the purpose of improving safety at the intersection of College Avenue and Lake Street (the "Project'); and WHEREAS, the estimated cost of the Project is $186,000, with no local matching funds required; and WHEREAS, construction of the Project will take place during the summer of 2004; and WHEREAS, the City Council adopted Resolution 2003-101, on September 16, 2003, authorizing the Mayor to enter into an intergovernmental agreement with the Colorado Department of Transportation for receipt of Federal Hazard Elimination Grant funds to be used to construct a median on College Avenue at Lake Street for the purpose of improving safety at the intersection of College Avenue and Lake Street; and WHEREAS,Article V, Section 9,of the Charter of the City of Fort Collins permits the City Council to make supplemental appropriations by ordinance at any time during the fiscal year, provided that the total amount of such supplemental appropriations,in combination with all previous appropriations for that fiscal year,does not exceed the then current estimate of actual and anticipated revenues to be received during the fiscal year; and WHEREAS, City staff has determined that the appropriation of the Federal Hazard Elimination Grant funds as described herein will not cause the total amount appropriated in the Transportation Services Fund budget to exceed the current estimate of actual and anticipated revenues to be received during any fiscal year; and WHEREAS, it is the desire of the Council to appropriate the sum of $186,000 in federal Hazard Elimination grant funds in the Transportation Services Fund-College Avenue/Lake Street Median project to be used to construct a median on College Avenue at Lake Street for the purpose of improving safety at the intersection of College Avenue and Lake Street. NOW,THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that there is hereby appropriated for expenditure from unanticipated revenue in the Transportation Services Fund - College Avenue/Lake Street Median project, the sum of ONE HUNDRED EIGHTY-SIX THOUSAND DOLLARS ($186,000),upon receipt,from the Colorado Department of Transportation, be used to construct a median on College Avenue at Lake Street for the purpose of improving safety at the intersection of College Avenue and Lake Street. Introduced and considered favorably on first reading and ordered published this 16th day of September, A.D. 2003, and to be presented for final passage on the 7th day of October, A.D. 2003.
