MINUTES OF A REGULAR MEETING OF THE COUNCIL OF THE CITY OF FORT COLLINS-, Held
vember 12, 1964, at 1:30 o'clock P.M.
Present: Councilmen Colwell, McMillan, Guyer and Councilwoman Quinn. City Attor-
ney March, Acting City Manager Lynch and Acting City Engineer Case. Councilman Johnson,
used for a portion of the meeting and Assistant Mayor McMillan presiding.
Motion was made by Councilwoman Quinn, seconded by Councilman Colwell, that the-

State of Colorado, for renewal of 3.2% beer license, was presented. Motion was made by
Councilman Colwell, seconded by Councilman Guyer, that the Mayor and City Clerk be author-
ized to execute the approval of the licensing authority. Roll was called resulting as
follows: Ayes: Councilman Colwell, McMillan, Guyer and Councilwoman Quinn. Absent: Coun-
cilman Johnson, excused. Nayes: None. The President declared the motion adopted.

Mrs. Maud Burns of the Western Health Foods was the only petitioner that was pre-
sent and she stated that the group solicitating signatures on the petitionvare rushed to get
it filed in time for to-dayls agenda. Cobihollman Guyer suggested that they might be able
to get some signatures from the property owners to the south, such as. apartment houses,
Batson's and the Townhouse Motel. It was the consensus of opinion of the Council to include
all hooded meters in that section if the merchants and property owners requested it to
eliminate more petitions on the matter. Motion was made by Councilman Guyer, seconded by
Councilwoman Quinn, that this matter be tabled for one week in order to allow the petitioners
additional time to get other signatures. Roll was called resulting as follows:. Ayes:

The City Council
The North 5 feet of the Utility Easement on the South side of Lot 3 in the Second
Spring Creek Subdivision, has been checked by the Engineer's Office, and the Light and Power
)epartment, and has been found clear of any present and future use as an easement, and the
additional deeded 5 feet on the South side of Lot 3 will replace the needed room for our pre
gent utilities now established. Our Policy of not building over utility easements would re-
strict this property from building closer to t he line with a garage, and extending our ease-
nent by deed 5 feet further to the South woul d replace the vacated portion.

Council in reference to the petition for granting over night parking previously tabled.

Mr. Fischer discussed the complaint of the lack of parking spaces during tile night by those
persons having hotel and rooming houses in the downtown area of Walnut and North College
Avenue. After .this discussion, motion was made by Councilwoman Quinn, seconded by council-
man Colwell, that the motion to table the petition for one week be amended to table the
petition to November 25, 1964. Roll wq,s called resulting as follows*. Ayes: Councilmen

Mr. Fred Vogt was present and he stated that he was very much in favor of the
ordinance as presented in which would more or less control the trash dumping of all trash
within the City limits of Fort Collins as it was becomilig a problem to the County Commis-
sioners as the promiscous dumping of trash in various locations outside of the City was a
continued source of concern. Mr. Marion Jones who has a paper collection for the City
appeared and asked if this would necessitate him closing the paper col
lection place that he,
has in the north part of town. He was advised that this was a part of this ordinance and
that he should make his collection in one place at the City Dump grounds

Taft Hill .Third Annexation, has offered the City 2/9th of a share of Pleasant Valley and
Lake Canal water with his annexation. However, in the approval of the Planning and Zoning
Board, it was recommended that a 10 foot right-of-way be dedicated. for the widening of
South Taft Hill Road. Mr. Thompson was present and discussed the matter with the Council,
stating that if widening did occur, it would be necessary in some instances to move houses
back from their present locations along the east side of South Taft Hill Road.. It was
suggested however, that an agreement be made that the. right-of-way be deeded and the use
of such right-of-way be held in abeyance until such a time as South Taft Hill Road is
widened for arterial traffic. Motion was made by Councilman Guyer, seconded by Councilwoma
Quinn, that the matter be referred to the City Attorney to prepare a right-of-way deed and
an agreement thereon and also that a water and sewer tap be allowed subject to t he final

OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING A PETITION FOR THE ANNEXATION OF THE
SOUTH TAFT HILL THIRD ANNEXATION TO THE CITY OF FORT COLLINS; SETTING THE DATE FOR HEARING
ON AN ORDINANCE APPROVING THE ANNEXATION THEREOF; AND GIVING NOTICE THEREOF
WHEREAS, heretofore on the 5th day of November, A. D. 1964, a written petition
was presented to t he Council' of the City of' Fort Collins in substantial compliance with the
provisions of Colorado Revised Statutes, 1953, 139-11-3, by the owners of more than fifty
per cent (50%) of the area and who comprise the majority of landowners residing in the area
of the following described land, situate in the County of Larimer, State of Colorado, to -
wit:
A, tract of land situate in the NW4 of Section 15, Township 7 North, Range 69 West
of the Sixth P.M., County of Larimer, State of Colorado, which considering the

perty for which annexation was requewted, but that Mr. Underdown did have water rights for
another property which would be for annexation at a later date. He explained that the

Mr. Truman Means was present and requested to be heard in r_eferenee3 to his water
tap application which was denied at the last regular meeting. It was explained to Mr.
Means that he was in the West Fort Collins District and under the agreement that the City
has with this district, the City cannot grant a water tap unless the applicant has been
released . It appears that Mr. Means property is directly north of the south boundary
of this district but it would be necessary for him to get a release for his property from
the West Fort Collins District or to be excluded by a court order. The West Fort Collins
District claim that they have a line now directly adjacent to his property which he could
tap, but as Mr. Means explained, they do not have water on said line and will not have for
some time to come and the house being erected upon that portion of Mr. Mean's property
which he sold to Mr. Langholf, is practically finished and no water is available at this
time. Mr. Means was requested to discuss this matter with the City Attorney for further
clarification of his situation.

OF THE CITY COUNCIL OF THE CITY OF FORT COLLINS APPROVING AN AGREEMENT WITH NORTHSIDE
BAPTIST CHAPEL OF FORT COLLINS, COLORADO, PERMITTING USE OF WATER OUTSIDE THE CITY LIMITS
WHEREAS, an application was heretofore made to the City Council for permission to
tap the water mains of the water system of the City of Fort Collins by the Northside Bap-
tist Chapel of Fort Collins, Colorado, and

WHEREAS, under the provisions of Section 21-27 of the Code of Ordinances of the
City of Fort Collins, Colorado, 1958, as amended, no additional taps for new consumers out-
side the citylimits of the City of Fort Collins shall be permitted, except as t he City
Council expressly provides for by resolution, and
WHEREAS, the City Council has approved said application subject to the entering
into by said applicant of an agreement in connection with the granting of the applicatipn,
and
WHEREAS, the City Attorney has prepared an agreement in accordance with the polio
heretofore adopted by the City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that tb
application of the above -mentioned party be and it is hereby approved.
BE IT FURTHER RESOLVED that the terms of the agreement pertaining thereto be and
they are hereby approved.
BE IT FURTHER RESOLVED that the City Manager be and he is hereby authorized and
directed to execute said agreement for and on behalf of the City of Fort Collins.

The City Attorney advised the Council that he had checked into the water rights o
the Northside Baptist Chapel who have applied to the City for an outside water tap and that
the property does not at this time have any water rights. However, he stated that this
property would be available for annexation upon the completion of the Mountain View Heights
Annexation and that, in that way, the property of the Northside Baptist Chapel could be
annexed and a water and sewer tap made available. Motion was made by Councilman McMillan,
seconded by Councilwoman Quinn, that this resolution be tabled at t his time. Roll was
call-=d resulting as follows: Ayes: Councilmen Johnson, Colwell, McMillan, Guyer and
Councilwoman Quinn. Nayes: None. The President declared the motion adopted.
Bids were opened on electric wire and cable on November 5, 1964. Requests for
these bids were sent to eight companies and.otily two companies submitted bids. The Mine
and Smelter Suply Company of Denver made a bid of $28,488.50 on the specifications as calle
for and the Anaconda Wire & Cable Company of Denver $30,300.20. The unit price bid by the
Mine and Smelter Supply Company is based on receiving the entire order and the Acting City
Manager recommended that their bid be accepted. Motion was made by Councilwoman Quinn,
seconded by Councilman Guyer, that the bid of the Mine and Smelter Supply Company on elec-
tric wire and cable be accepted. Roll was called resulting as follows: Ayes: Councilmen

WHEREAS, the State Highway Commission is about to formulate its highway progaam
for the next budget year, and
WHEREAS, the City of Fort Colins desires to make certain recommendations to t he
State Highway Commission through the County Commissioners of Larimer County, and
WHEREAS, the City Council has given coreful consideration to this matter and that certain projects should be called to the attention of the State Highway Commission. feel
