Present: Councilmen Johnson, Carson, McMillan, Bennett and Kruchten. City
Manager Coffey, City Attorney March and City Engineer Fischer.
Motion was made by Councilman Carson, seconded by Councilman Bennett, that the
reading of the minutes of the last regular meeting held December 9, 1965, be dispensed
with. Roll was called resulting as follows: Ayes: Councilmen Johnson, Carson, McMillan,
Bennett and Kruchten. Nayes: None. The President declared the motion adopted.
The following resolution was presented and read at length:
RESOLUTION
OF THE COUNCIL OF THE CITY OF FORT COLLINS GIVING PUBLIC NOTICE CONCERNING A PROPOSED
ORDINANCE CHANGING THE ZONING MAP OF THE CITY OF FORT COLLINS AND AMENDING ORDINANCE NO.
46, 1965, COMMONLY KNOWN AS THE ZONING ORDINANCE
WHEREAS, a written petition has been presented to the City Council requesting
that the zoning classification for the property more particularly described in the "Notice
of Public Hearing" attached hereto be changed from "RL" Low Density Residential District
to "RM" Medium Density Residential District, and
WHEREAS, the Planning and Zoning Board has made a study of said zoning request
and has held a hearing and made a report and recommendation thereof, all in accordance with
the provisions of Section XXI of Ordinance No. 46, 1965, and
WHEREAS, the City Council desires to hold a public hearing on said rezoning
request as required by Section 21.1 (2) of Ordinance No. 46, 1965,
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that
January 6, 1966, at 1:30 P.M. or as soon thereafter as the matter may come on for hearing

Gentlemen:
We, the undersigned, being the owners of more than fifty per cent (50%) of the
hereinafter described property si:ltuate in the City of Fort Collins, County of Larimer, State
of Colorado, respectfully petition and request that the City Council change t he zoning
ordinance heretofore passed by amending the may thereof by changing the zoning classifica-
tion of the hereinafter described land from RL zone to RM zone, and as grounds therefore
and in support thereof respectfully states:
1. The property is described as follows: All of the land contained in the re-
corded Plats of the Martin Subdivisions, First and Second Filing.
2. Said property was originally included in the B-Residential zone of the former
zoning ordinance.
3. The then owner of the lands above described petitioned for and the Council
of the City of Fort Collins granted the re -zoning, under the old zoning ordinance, to B-
Residential. The re -zoning of the first filing was by Fort Collins Ordinance.14-62, passed
April 26, 1962, and the re -zoning of the Second Filing was by Fort Collins Ordinance 21-64,
passed June 25, 1964.
4. In reliance upon the Fort Collins zoning ordinance as requested and adopted
by John and Eloise Martin, one of your petitioners herein, the area was developed in accor-
dance with the then existing B-R sidential zoning requirement. Several of your petitioners
herein have constructed duplexes upon said property and developed their property in reliance
of said B-Residential zoning requirement. Others have purchased properties and intended to
develop them in accordance with the former residential zoning resolution.
5. In reliance upon the zoning ordinance, your petitioners have all expended
considerable sums of money in the development of said lots, and they propose and plan to
expend further sums of money in development of the remaining portions of said lots in accor-
dance with the requirements of the former B-Residential zoning resolution.

6. To deny the petitioners request to change the above described property to
RM, would cause a financial hardship upon them and would be unfai• to them because of their
change of position in reliance upon the former zoning resolution by the City of Fort Colli
Colorado.
7. The change of. zone classification by the City of Fort Collins from B-Residen-
tial to RL zone was erroneous in that circumstances in the area had not materially changed
to warrant said zoning change subsequent to the time of the original re -zoning and that
there is no other legal ground for said zoning change as executed by the City of Fort
Collins, Colorado.
8. By the filing of this petition, your petitioners do not intend, nor do they
confirm accept nor ooncur in the present zoning ordinance nor do they in any manner
accept, nor concur in the present zoning ordinance nor do they in any manner accept the

RESOLUTION
CP THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING THE TERMS IN AGREEMENT TO BE ENTERED
INTO WITH JAMES P. HOFFMAN
WHEREAS, James P. Hoffman has offered to contract with the City for the removal
Of sludge from the City Sewage Plant and whereas the said James P. Hoffman has further
Offered to purchase from the City the sludge hauling tank and truck owned by the City and
Presently used for hauling such sludge, and
WHEREAS, it is the opinion of the City Council that it is in the best interests
Of the City to contract with James P. Hoffman to remove sludge from the City sewage plant
and the sludge hauling tank and truck presently owned by the City will not be needed by
the City to sell said truck to James P. Hoffman at its fair market value which is $1,600.00
and
WHEREAS, an agreement has been prepared by the City Attorney providing for James
P. Hoffman hauling sludge from the city sewage plant at the rate of $2.80 per load and
Providing further for the sale of the sludge hauling tank and truck to the said James P.
Hoffman for $1,600.00, and
WHEREAS, said agreement has been approved by the City Manager.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS, that
the terms of the agreement between the City of Fort Collins and James P. Hoffman be and the
same hereby are accepted and approved and be it further resolved that the Mayor and City
Clerk be and they hereby are authorized and directed to execute said agreement for and on
behalf of the City of Fort Collins.

Regional Airport Board, and
WHEREAS, the City Council desires to appoint members from Fort Collins to said
Board.
NOW, THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS, that
Harvey Johnson, Robert Norton and William Evans are hereby appointed to such Board.
AND BE IT FURTHER RESOLVED, that Harvey Johnson and Robert Norton are hereby
appointed for a two year term to said Board and William Evans is hereby appointed to a four
,year term to said Board.

Mayor Johnson suggested that a resolution be drawn up commending Frank Schleicher
and Roland Colwell for their services on the Interim Committee of the Fobt Collins -Loveland

The City Manager advised the Council that he would like Mr. Gordon L. Bennett,
Deputy State Librarian, prepare a study of library needs of the City of Fort Collins and
the surrounding area and that he had prepared a letter requesting this study and would
like to have the Council approve the request. He stated that the State Library would carry
on this study without any cost to the City and would make suggested recommendations that
would be necessary to bring the City library up to standards. Motion was made by Council-
cilman Carson, seconded by Councilman Bennett, that the City Manager be authorized to
request a study of library needs from Mr. Gordon Bennett, Deputy State Librarian. Roll
was called resulting as follows: Ayes: Councilmen Johnson, Carson, McMillan, Bennett and
Kruchten. Nayes: None. The President declared the motion adopted.
The City Council requested the Council to approve a $10.00 processing fee on
appeals for modification of the Building Ordinance which are filed for presentation to the
Zoning Board of Appeals. This fee is provided for in Ordinance No. 46, 1965, but the
amount of same was not designated. The Zoning Board of Appeals, at their regular meeting
of December 14, 1965, requested the approval of a $10.00 processing fee. Motion was made
by Councilman McMillan, seconded by Councilman Carson, that the recommendation of the Zon-
ing Board of Appeals be approved and that a fee for processing appeals to the Zoning Board
of Appeals be set at $10.00. Roll was called resulting as follows: Ayes: Councilmen

Subject: Leave of Absence for Kathryn BI-ack
Mrs. Kathryn Black, Clerk Typist II in the Utility Office of he City of Fort
Collins, has submitted a resignation caused by a promotional transfer of her husband who is
employed at Woodward Governor.
In discussing this with Mrs. Black, it has been determined that her husband is
being transferred from Fort Collins to the home plant in Rockford, Illinois for a one-year'
training program, and upon completion, will return to the new plant in Fort Collins.
Mrs. Black started her employment with the City May 15, 1958, is an excellent
career employee, and one that should be encouraged to return to City employment following
the one year's leave. Attention is called to the attached photocopy of employee evaluation
report of May 27, 1965.
Rule X, Section 12, of the Personnel Rules for the Municipal Service, states,
"Regular employees may be allowed leave without pay for a period not to exceed three months
upon recommendation of the Department head and approval of the City Manager. Leave may
be extended beyond the three months only upon approval of the City Council."
In view of the above, it is recommended that Mrs. Kathryn Black be granted a
one -year's leave of absence without pay effective January 8, 1966.
