MINUTES OF A REGULAR MEETING OF THE COUNCIL OF THE CITY OF FORT
COLLINS, Held Thursday, January 15,.1970, at 1:30 o'clock P.M.
Preset: Councilmen Carson, Troxell, Lopez, Kissock and Kruchten.
City Manager Coffey, Assistant City Attorney March, Jr., and Director of Public;..

Motion was made by Councilman Kissock, seconded by Councilman Kruchten ,
that the reading of the minutes of the last regular meeting held January 8, 1970,
be dispensed with. Roll was called resulting as follows: Ayes: Councilmen
Carson, Troxell, Lopez, Kissock and Kruchten. Nayes: None. The Mayor
declared the motion adopted.
The following proclamation was presented and read at length:
PROCLAMATION
WHEREAS, the civic bodies and service organizations of our community
and the departments of the local government recognize the great service rendered
to this community by the Fort Collins Jaycees; and
WHEREAS, the Fort Collins Jaycees have set aside the week of January
18-24, 1970, to observe the founding and 50th anniversary of the Jaycees and to
commemorate such funding by the selection of three (3) outstanding young men
in this community as the recipient of the Distinguished Service Award, Outstanding
Yound Educator Award and the Outstanding Young Farmer -Rancher Award; and
WHEREAS, the Fort Collins Jayceeslave set aside this week to commemorate
such founding by honoring their "Bosses"; and
WHEREAS, this organization of young men has contributed materially to
the* betterment of this community throughout the year.
THEREFORE, I, KARL E. CARSON, Mayor of the City of Fort Collins, do
hereby proclaim the week of January 18-24, 1970, as JAYCEE WEEK and urge all
citizens of our community to give full consideration to the.future services of
the Jaycees.

OF THE COUNCIL OF THE CITY OF FORT COLLINS GIVING .NOTICE CONCERNING A PROPOSED
ORDINANCE AMENDING CHAPTER 19 OF THE CODE OF ORDINANCES OF THE CITY OF FORT COLLIY
COLORADO, 1958, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE, IN ORDER TO
CLASSIFY FOR ZONING PURPOSES CERTAIN PROPERTY BEING ANNEXED D:THE CITY OF FORT
COLLINS
WHEREAS, heretofore the City Council of the City of Fort Collins
initiated annexation procedures for certain property known as the Spencer Second
Annexation to the City of Fort Collins; and
WHEREAS, THE owners of said property have petitioned that a portion of
said property be included in the R-L, Low Density Residential District; and
WHEREAS, the Planning and Zoning Board has made a study of said zoning
request and has held a hearing and has made a report and recommendation thereon,
all in accordance with Section 19-46 of the Code of Ordinances of the City of
Fort Collins, Colorado, 1958, as amended; and
WHEREAS, the City Council desires to hold a hearing on said zoning .
request as required by said Section 19-46.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that February 5, 1970, at 1:30 P.M., or as soon thereafter as the matter
may come on for hearing, in the Council Chambers in the City Hall of the City
of Fort Collins, is hereby set as the time and placeibr a public hearing on
said zoning request; and
BE IT FURTHER RESOLV ED that the CityClerk is hereby instructed to
publish a notice of said hearing as provided in Section 19-46 of the Code of
Ordinances of the City of Fort Collins, Colorado; 1958, as amended, in the form
attached hereto.

RESOLUTION 70-4
OF THE COUNCIL OF THE CITY OF FORT COLLINS GIVIU NOTICE CONCERNING A PROPOSED
ORDINANCE AMENDING CHAPTER 19 OF THE CODE OF ORDINANCES OF THE CITY OF FORT COLLIT
COLORADO, 1958, AS AMENDED, BEING THE ZONING ORDINANCE, AND RELATING TO THE
CREATION OF A ZONING DISTRICT TO BE KNOWN AS THE R-L-M, LOW DENSITY MULTIPLE
FAMILY DISTRICT, AND RELATING TO CHANGING THE ZONING MAP OF THE CITY OF FORT
COLLIN, SO AS TO PLACE CERTAIN PROPERTY IN SAID PROPOSED ZONE.
WHEREAS, the Planning and Zoning Board has made a study and has re-
commended that the zoning ordinance be amended by creating a zoning district.
to be known as the R-L-M, Low Density Multiple Family District; and
WHEREAS, said proposed district would permit uses now permitted in
the R-L, Low Density Residential District, and would also permit two-family dwel-
lings and multiple family dwellings up to and including four -family units; and
WHEREAS, petitions have been presented to the City Council requesting
that the property described in the attached Notice of Public Hearing be reclassi-
fied for zoning purposes into the R-M, Medium Density Residential District; and
WHEREAS, the Planning and Zoning Board has held a hearing on said
petitions andhas recommended that said properties be placed in the R-L-M, Low
Density Multiple Family District, to be created; and
WHEREAS, the City Council desires to hold a public hearing upon an
ordinance creating such additional zone and reclassifying said properties
into said zone.
NOW, THEREFORE, BE IT RESOLCED BY THE COUNCIL OF THE CITY OF FORT .
COLLINS that February 5, 1970, at 1:30 P.M., or as soon thereafter as the matter
may come on for hearing, in the Council Chambers in the City Hall of the City
of Fort Collins, is hereby set as the time and place for a public hearing on
said proposed ordinance; and
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to pub-
lish a notice of said hearing as provided in Section 19-46 of the Code of Ordi
trances of the City of Fort Collins, Colorado, 1958, as amended, in the form attach•
ed hereto.

This resolution includes the rezoning from R-E to R-M-P by Leslie Everitt
and Willard Baker. Motion was made by Councilman Lopez, seconded by Councilman
Krucnten, that this resolution be adopted. Roll was called resulting as follows;

RESOLUTION
OF THE COUNCIL OF THE CITY OF FORT COLLINS CHANGING THE NAME OF THE STREET KNOWN
AS`KANE CONCOURSE TO SOUTH COLLEGE AVENUE

WHEREAS, the Planning and Zoning Board has made a study and has
recommended to the City Council that the name of the street known as Kane
Concourse bae changed to South College Avenue; and
WHEREAS, it appears reasonable and proper to accept such recommendation
and to change the designation of said street.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the name of the street known as Kane Concourse be changed to South
College Avenue.

The preliminary hearing on the application for a Fermented Malt Bever-
age by the La Sierra Cafe, 220 E. Mountain, which was tabled January 8, 1970, to
this date, was again presented. Motion was made by Councilmar. Troxell, Seconded
by Councilma❑ Kissock, that this be removed from the table. Roll was called
resulting as follows: Ayes: Councilmen Carson, Troxell, Lopez, Kissock and
Kruchten. Nayes: None. The Mayor declared the motion adopted.
After discussion, motion was made by Councilman Kissock, seconded by
Councilman Kruchten, .that the boundaries as spelled out in the regulations, be fol-
lowed and that February 5, 1970, be set as date for final hearing. Roll was
called resulting as follows: Ayes: Councilmen.Carson, Troxell, Lopez,
Kissock and Kruchten. Nayes: None. The Mayor declared the motion 'adopted.
The City Manager advised the Council that he had been negotiating with
Red Moffit, Editor of the.Coloradoan Newspaper and they had come to an agreement
on the cost for.publishing the legal publications for the City of Fort Collins,
which was 18% per line for first readings and 14/ per line for second readings.
The City Manager recommended that this be approved. Motion was made by Council-
man Troxell, seconded by Councilman Kissock, that the Fort Collins Coloradcan'
newspaper be awaxded the legal publications for the City Roll was called
resulting as follows: Ayes: Councilmen Carson, Troxell, Lopez, Kissock and
Kruchten. Nayes: None. The Mayor declared the motion adopted.
Ms.Laura Makepeace presented Florence Morgan, both of the League
of Women Voters, and stated that Mrs. Morgan would take her place occasionally as
an observer of the City Council when it was necessary for 's.Makepeace to be
absent.

Fort'Collins Landmark Preservation Commission
..SUBJECT: Resignation of Betty Woodworth
Attached is a letter of resignation from Betty Woodworth, and in as much
as all appointments are made by the Council, no action was taken by the Commis-
sion. At the meeting of the Commission on January 12, the members expressed
their regret as I'm sure the Council will in accepting Miss Woodworth's resignatioi
because she made an outstanding contribution to the Commission during her member-
ship.
A1'so attached is a check for fifty dollars from Miss Woodworth for the
use of the Commission as referred to in the last paragraph of her letter. We
ask that the Manager deposit this amount in the special account established for
the Commission.
Within a mon th, the Commission will have a slate of recommendations
for the replacement of Miss Woodworth to present to the Council.

Dear Jim:
I meant to send this to you shortly after the last meeting of the
Commission and am sorry to be doing it just before the meeting.
I'm going to have to resign from the Commission. The Coloradoan is
now having a Monday society page, which means that if I go to the Commission
meeting and spend the time I should be writing a report of it, I'm getting my
work in late and delaying other people.
Working with the Commission has been pleasant and interesting and
you have gotten it off to a good start. With Dave Watrous as a member, you
certainly don't need me either for publicity or for information about the past,
however, I'm enclosing a small check for the Commission - a poor substitute
for the old bank section of the Avery Block.

for her -services on the Board be sent to her. Roll was called resulting as

The City/Attorney advised the Council that ari apartment house had been

build in the 200 block of North Sherwood, that no certificate of occupancy had _
been issued and several of the apartments are occupied. He stated the contractor
had been been informed that it would have to be vacated. Since.they did not
comply, the water was turned off and the contractor has taken this matter to
court. This case will be heard the 21st'day of January, 1970, and involves the
Mayor, _City Manager, Manager of Electricity, Sewer, Water and tle Public Service
of Colorado. The Assistant City Attorney asked authority to represent the City

in this matter. Motion was made by Councilman Kissock, seconded by Councilman
Kruchten, that this authorization be approved. Roll was called resulting as
follows:: Ayes: Councilmen Carson, Troxell, Lopez, Kissock and Kruchten.
Nayes: None. . The Mayor declared the motion adopted.
The City Manager advised the Council that there is a vancancy on the
Personnel Board and recommended Mr. A. 0. Farrar from C.S.U., as a replacement
on this Board.' Motion was made by Councilman Kruchten, seconded by Councilman
Troxell, that this matter be referred to the City Attorney to prepare the
necessary resolution on same. , Roll was called resulting as follows: Ayes:
Councilmen Carson, Troxell, Lopez, Kissock and Kruchten. Nayes: None. The
Mayor declared the motion adopted.
Mr. Don Reynolds, City Planner, presented a sample of a new sign to
be used in posting, informing the public of zoning requests

The Director d' Public Works, Chuck Liquin, advised the Council that
the dragline was in and would be in service soon.
There was discussion on progress of the trash haulers and the new
alley inspector. The Director of Public Works stated that the aDey inspector
was being instructed in his duties and so far was satisfied in the trash pick-
up. Councilman Troxell stated that there was still trash being left on the
curbs -in numerous places throughout the City. Tke City Attorney stated that
not placing trash, etc.; at the curb could not be enforced under the present
ordinance. Motion was made by Councilman Troxell, that the matter be referred
to the City Attorney for an amendment to the ordinance and that the alley
inspector be authorized to enforce regulations. This motion was seconded by
Councilman Kruchten. Roll. was called resultirgas follows: Ayes: Council-
ment Carson, Troxell, Lopez, Kissock and Kruchten. Nayes: None. The Mayor
declared the motion adopted.
-Councilman Lopez.stated that trash should be 'placed in the proper
containers and places.
