MINUTES OF A REGULAR MEETING OF THE COUNCIL OF THE CITY OF FORT COLLINS, Held
Thursday, October 17, 1963, at 1:30 o'clock P.M.
Present: Councilmen Johnson, Colwell, McMillan, Honstein and Councilman Quinn.
,City Manager Boos, City Attorney March and City Engineer Weiss.
Motion was made by Councilman Colwell, seconded by Councilwoman Quinn, that the
reading of the minutes of the last regular meeting held October 10, 1963, be dispensed with.1
Roll was called resulting as follows: Ayes: Councilmen Johnson, Colwell, McMillan, Honsteii
and Councilwoman Quinn. Nayes: None. The President declared the motion adopted.
The following ordinance was presented on second reading:
ORDINANCE NO. 37, 1963
BEING AN ORDINANCE FOR THE REGULATION OF TRAFFIC UPON THE PUBLIC STREETS OF THE CITY OF
FORT COLLINS, COLORADO, ADOPTING BY REFERENCE "THE MODEL TRAFFIC ORDINANCE FOR COLA RADO
MUNICIPALITIES" (1962) AS AMENDED HEREIN AND PROVIDING PENALTIES FOR THE VIOLATION OF THE
SAME AND REPEALING CHAPTER 23 OF THE CODE OF ORDINANCES OF THE CITY OF FORT COLLINS, COLO-
RADO, 1958, AS AMENDED
Motion was made by Councilman McMillan, seconded by Councilman Colwell, that
Ordinance No. 37, 1963, be adopted and become a law upon passage. Roll was called resulti
as follows: Ayes: Councilmen Johnson, Colwell, McMillan, Honstein and Councilwoman Quinn.
Nayes: None. The President declared the motion adopted.
The following petition was presented and read at length:

Gentlemen:
Delta Eta House Association respectfully to titions and requests the City Council
of the City of Fort Collins, Colorado, to vacate that portion of West Coy Drive wdch appears
in the C. W. Johnson Subdivision in the City of Fort Collins, Colorado.
In support of said petition and as grounds therefor, petitioner respectfully re-
presents the following:
1. Petitioner is the owner of the properties abutting the public street requested
to be vacated.
2. The street, which petitioner requests be vacated, has never been used as a
public street, thorofare, or for any other public purpose.
3. None of the properties abutting said street will b e without access to a public
street.
4. Petitioner does not intend to use the subdivided lots abutting said street forl
single family residential uses.
5. Petitioner believes that if said street is vacated,t he property owned by pe-
titioner could be developed in the most harmonious manner and will best promote the interest:
of the City of Fort Collins, Colorado, and its inhabitants.

Mr. John Kochenburger was present and advised the Council as to the r4 on for the
equested vacation. It appears that the majority of the property owned by the Delta Eta
ouse Association is an island in the City which 6s not been annexed. The House Association
owning several of the lots immediately across West Coy Drive which are in the C. W. Johnson
ubdivision. After considerable discussion in reference thereto, motion was made by Coun-
ilman Johnson, seconded by Councilwoman Quinn, that the petition be referred to the Planni
Zoning Board for their recommendation. Roll was called resulting as follows: Ayes:

The following communication was presented and read at length:

Dear Council Members:
We wish to make application to have the north side of Canyon, between Howes and
eldrum Streets, zoned for two-hour parking.
With the unlimited parking as now permitted along this street, a parking problem
has been created with the establishment of our banking operation. By having this side of
the street limited to two -parking, our customers will then be able to find a parking place
next to our place of business.
Your consideration in this matter will be greatly apT eciated.

After discussion, motion was made by Councilman Colwell, seconded by Councilman
McMillan, that this matter be referred to the City Manager for investigation and report.
Roll was called resulting as follows: Ayes: Councilmen Johnson, Colwell, McMillan, Honstein
and Councilwoman Quinn. Nayes: None. The President declared the motions dopted.
The City Attorney advised the Council that he had received a letter from the bond
Attorneyls and a proposed amendment to the City Charter in reference to amending the charter
to allow the issuance of water bonds without submitting the proposal to the electorate. The
City Attorney requested the Council to look over the proposed amendment and advise him of any
changes that they might wish to include before okaying any draft of same.
The City Engineer presented the following letter and petition:

II I called you a few days ago in regard to the results of a petition concerning
Ilparking in the 300 Block of South Howes. Because I am a cardiac patient I need my car read-
ily available and the two-hour parking would be a greater hardship on me than the previous
Iiplan.
I am enclosing a request signed by several residents of the block to excludethe
00 Block on South Howes from the two-hour parking limit recently proposed by the City
ounci.l.

We, the undersigned residents of the 300 block of South Howes, respectfully request that this
block be exempted from the two -parking regulation proposed by the City Council at the meeting
on Thursday, October 10, 1963. It is our opinion that the two-hour limit will impose more
hardship on us than the present plan of unlimited time for parking.

Motion was made by Councilman Johnson, seconded by Councilwoman Quinn, that the
90 day trial for two-hour parking be removed from the action taken at a previous meeting.

and Councilwoman Quinn. Nayes: None. The President declared the motion adopted.

We three merchants and property owners are requesting that the City of Fort Collins install
parking meters so that our customers will find it much more convenient to stop and do busi-
ness at our establishments.
Ted Carpenter & Son, 132 LaPorte Avenue requests four two hour parking meters on LaPorte
Avenue. Ghent Motor Company corner of College Avenue and LaPorte Avenue requests three two-
hour parking meters and two fifteen minute meters on LaPorte Avenue and one two hour meter
on College Avenue next tothe Commercial Printing Company at 221 North college Avenue.
The Commercial Printing Company, 221 North College Avenue requests two two-hour meters and
one fifteen minute meter.

Harold Warren was present in the audience and spoke in reference to parallel
parking which the City Engineer recommended, when and if parking meters were installed as
requested. Mr. Warren stated that .the Chamber of Commerce Committee was considering para-
llel parking which would decrease parking facilities in the down town section. He mentioned
that there was strong opinion among the down town merchants against the parallel parking
and that this opinion should be investigated before making too many changes in the down
town parking facilities on the streets. After discussion, motion was made by Councilman
Johnson, seconded by Councilman Colwell, that the matter be referred to the City Manager for
investigation and report. Roll was called resulting as follows: Ayes. Councilmen Johnson,!
Colwell, McMillan, Honstein and Councilwoman Quinn. Naves: None. The President declared
the motion adopted.

Gentlemen:
rle, the undersigned, Robert E. Schmick and William F. Vigor of Schmick-Vigor Construction
Company and owners of Park Lane Manor Apartment House, 337 East Olive, Fort Collins, Color
would like to petition to the City Council that we be granted diagonal parking on the west
side of Peterson Street in the 300 block from the corner of Olive to Magnolia.
The reason for petition is that we have a 31 unit apartment house and feel that diagonal
parking w ill help to enable us to eliminate parking congestion w hich is prevalent under the
parallel parking rule now in effect.

After discussion in which the consensus of opinion of the Council members was that
the developers of this apartment house should have forseen the necessity of providing
adequate parking for their tenants which it is very evident from their request that they
failed to take into consideration. After discussion, motion was made by Councilman McMillan;
seconded by Councilwoman Quinn, that this request for diagonal parking be rejected. Roll
was called resulting as follows: Ayes: Councilmen Johnson, Colwell, McMillan, Honstein
and Councilwoman Quinn. Nayes: None. The President declared the motion adopted.

(Gentlemen:
We have just been advised by McMillan Claim Service that they do not consider the
City of Fort Collins liable for damage done as the result of a faulty sewer in the vicinity
�of 645 South Whitcomb Street, Fort uollins, Colorado.
In light of the statements made by John L. McGowan of the above named claim ser-
vice, we must, therefore, institute legal proceedings to recover what we believe to be a
,just and proper claim.
