MINUTES OF A REGULAR MEETING OF THE COUNCIL OF THE CITY OF FORT COLLINS, Held

Present: Councilmen Carson, 'Troxell, Kissock, Kruchten and Bennett. City
Manager Coffey, City Attorney March and Director of Public Works Liquin.
Motion was made by Councilman Kissock, seconded by Councilman Kruchten, that
the reading of the minutes of the last regular meeting held December 26, 1968, be dispensed
with. Roll was called resulting as follows: Ayes: Councilmen Carson, Troxell,
Kissock, Kruchten and Bennett. Nayes: None. The President declared the motion
adopted.
The following ordinance was presented on second reading:

BEING AN ORDINANCE APPROPRIATING THE SUM OF $98,000 FOR THE FISCAL YEAR 1968 FOR WATER
CAPITAL IMPRO V.EMENTS
Motion was made by Councilman Troxell, seconded by Councilman Kruchten, that
Ordinance No. 57, 1968, be adopted and become a law upon passage. Roll was called
resulting as follows: Ayes: Councilmen Carson, Troxell, Kissock, Kruchten and
Bennett. Nayes: None. The President declared the motion adopted.
The following ordinance was presented on second reading:

Motion Was made by Councilman Kissock, seconded by Councilman Troxell, that
Ordinance No. 58, 1968, be adopted and become a law u pon passage. Roll was callIed
resulting as follows: Ayes: Councilmen Carson, Troxell, Kissock, Kruchten and Bennett.
Nayes: None. The President declared the motion adopted.

BEING AN ORDINANCE AMENDING CHAPTER 19 OF THE CODE OF ORDINANCES OF THE CITY OF FORT
COLLINS, COLORADO, 1958, AS AMENDED, COMMONLY KNOWN AS THE ZONING ORDINANCE AND CLASSIFY-
ING FOR ZONING PURPOSES THE PROPERTY INCLUDED IN THE SMITH ANNEXATION TO THE CITY OF FORT
COLLINS, COLORADO
Attorney James Beatty, representing Robert Smith, called on Professional
Planner Gene Allen who gave a very fine statement why this area should be zoned as request
ed. Attorney John Kochenberger, representing a group of neighbors, called John 0.
Richard of 1305 Skyline, James R. Goodman of 1313 Skyline Drive, Planning Consultant of
Nelson, Haley, Patterson and Quirk, Bob Reitzman of 2021 Clubhouse Drive of Greeley and
Stephan Peranki, 1865 Michael Lane, in opposition to the zoning of this property. After
considerable discussion among the attorneys, Attorney Kochenberger stated he objected
to the notices as,presented by our Planning and Zoning Board in rezoning this property,
also both attorneys agreed to wager the swearing in of any called witnessess. After
this discussion, the Council requested a 10 minute recess, after which the following
letters were presented and read at length:

Gentlemen:
As adjacent property owners to the 4.6 acres at 1717 W, Prospect being considered
for annexation under Planned Residential zoning, we are strongly opposed to this possible

action. We regret that, due to prior committments, we are out of town at the time of this
hearing.
The people of the Fort Collins area have a lack of confidence in the public
interests being protected by current planning and zoning procedures. Where people ask,
can one build or buy a home in Fort Collins with reasonable assurance that the surrounding
neighborhood will remain a single family residential area? Public confidence in planning
and zoning has eroded because of lack of responsiveness to the citizenry. It is time for
the City Council to evaluate the situation, and seek means to restore public confidence.
The "Plan for Piegress" was adopted by the City Council as a guide for growth.
The area of Southwest Fort Collins is shown as "low density". Now we are told by the
former City Planner that "low density" means anything less than "high density". We
question that public understanding of the "Plan for Progress" is based on a definition of
"low density" other than the low density residential which now exists in the area.
The Planning and Zonng Commission seems to believe that "Planned 4esidential"
(12 units/acre max) is suitable anywhere in Fort Collins. Is this the City Councals-
position also?
The property under question is surrounded on three sides by land either devel-
oped as low density or zoned for low density. One side is still farming, but will
also bae apartments if this request is approved. Densities of 12 units per acre are
not compatible with the neighborhood.
Over 907o of those living within 500 feet of the property signed petitions
against Dr. Smith's requested zoning.
If this zoning is approved, precedent for multiple family units will be estab-
lished in the Taft Hill -Prospect area. The City Council is making a decision;now on
several sections of land, not just 4.6 acres. If approved, the many apartment dwellers
will demand, and probably receive commercial developments to serve their needs. Is
this area where the Council wants more commercial development to further drain the down-
town?
The spokesman for this petition claim no increase in density over what would
be permittd under County FA zoning. If the City Council succombs to this threat, per-
cg:atives of good planning will be lost for the entire region!
We ask that the City Council take a long serious look at what approval of this
petition will do for public confidence and future possibilities for good planning in the
community.

of the Fort Collins City Council
I would like to go on record as opposing the annexation of 4.6 acres at 1717
West Prospect St., which would permit the construction of an apartment complex.
I don't believe you as City Council members should ignore the desires of many
to satisy the desire of one individual. You are elected represent the people as a whole.
The building of an apartment complex would tax the school facilities of the area and gener-
ally lower property values of property adjacent to them.
Please consider the desires of the neighborhood before permitting this annexa-
tion.

The Fort Collins City Council:
We would like to express our opposition to the proposed zoning at 1717 West
Prospect. As property owners in an adjaniing area we are concerned that the neighborhood
remain a single family residential area.
We believe that the City Council should be influenced by the expressed opinions of
hundreds of residents opposing such a zoning request.

Gentlemen:
This letter is written concern with the proposed annexation of the property of Dr. Robert
Smith of 1717 West Prospect.
We are against zoning and annexation of this type of property because of future conjestion
of traffic, schools and the constant moving in and our of this type of housing.
Our property is across the street from this address and we feel that not only would this
type of construction make the appearance of the neighborhood less desirable, but it would
also lower the property value of homes and make our schools become over crowded with the
addition of more families that this type of housing has to offer.
In view of all this, we are in support of those who are against the zoning and annexation
of this type of building.

Gentlemen:
I am writing this letter on behalf of my husband and myself to let. it be known that we would
prefer to maintain a single family residential neighborhood in the area surrounding our
property at 1304 Shamrock Drive.
We are referring to the specific property proposed at 1717 West Prospect, 150 apartment
dwellings, proposed by Dr. Robert Smith.
One of the appealing features of Fort Collins has been the ability to enjoy country
living, without traveling great distances to do it.
There are needs for apartment houses in the community, but their locations should be decide(
with great care, as I feel our Council will give this matter. Larger cities have their
tall apartment dwellings in downtown areas and consider the school locations as well, in
the planning. Do ".hope our Council will be concdrned in these matters and conclude the
Prospect location is not a feasible location for so many apartments.

After further comments by those opponents and proponents, motion was made by
Councilman Troxell, seconded by Councilman Bennett, that Ordinance No. 1, be tabled for
one week. Roll was called resulting as follows: Ayes: Councilmen Carson, Troxell,
Kissock, Kruchten and Bennett. Nayes: None. The President declared the motion
adopted.

We received two bids for the Reel Trailer mentioned above. These bids were opened at
10:00 A.M. this morning. I have listed them below:
Truco Denver 3,679.99 f.o.b. Denver
Elder Trailer and Body 4,875.00 f.o.b. Long Beach
Others were asked to bid but could not meet our specifications. The low bid (Truco
Denver) meets our specifications. The other bid has some exceptions to our specification
A copy of each bid is attached for your information.
I recommend that we accept the low bid and proceed with the purchase from Truco.

The following resolution was presented and read at length:
RESOLUTION bill
OF THE COUNCIL OF THE CITY OF FORT COLLINS COMMENDING MILES F. HOUSE FOR HIS SERVICES TO
THE CITY OF FORT COLLINS
WHEREAS, Miles F. House served as City Clerk of the City of Fort Collins from
August 16, 1937, through December 31, 1968, and also during said time served as Assistant
Director of Finance from April 12, 1955, to January 1, 1962, and as Director of Finance
from January 1, 1962, to January 1, 1966; and
WHEREAS, said Miles F. House in his official capacities as City Clerk, Assistant
Director of Finance and Director of Finance performed his duties in such a conscientious,
faithful and capable manner for the City of Fort Collins and the citizens thereof that
appropriate recognitaion should be made thereof.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that
Miles F. House be and he hereby is commended for his valuable services to the City of
Fort Collins during the period August 16, 1937, through December 31, 1968; and
BE IT FURTHER RESOLVED that a copy of this resolution be spread upon the minutes
of the City Council of the City of Fort Collins and a certified copy thereof be delivered
to said Miles F. House.
