MINUTES OF MEETING
June 17, 1971
The City Council of the City of Fort Collins met in regular session at 1:30 P.M. in the
Council Chambers of the Mi,.nicipal-Building on Thursday, June 17, 1971.
Present: Councilmen Carson, Lopez, Councilwom,.n Preble,

Councilman Peterson.
Absent: Councilman Fead.
Also Present: Tom Coffey, City Manager
Arthur E. March, City Attorney
Roy Bingman, City Engineer
Absent: Charles Liquin, Director of Public Works.
Mayor Carson presided.
DISPENSING OF MINUTES
Motion was made by Councilman Lopez, seconded by Councilman Preble, that the reading of the
minutes of June 3, 1971, be dispensed with. Upon a roll call, all members voted in the
affirmative.

PROCLAMATION -
WHEREAS, June is the month when nature bestows upon us her most
nearly perfect weather, and
WHEREAS, Milk is nature's most nearly perfect food, it seems
most appropriate to celebrate the pleasures and bone-

-fits of milk and milk products during this first month
of summer season,
NOW, THEREFORE., We hereby dedicate this glorious month of June as a tri-
bute to the American dairy industry and the dairy farm-
ers of this community whose daily wort and devotion
continually contribute so much to the nation's health
and prosperity,
NOW, THEREFORE, I Karl Carson, Mayor of Fort Collins, do proclaim the
month of June to be National Dairy Month, and do en-
courage all citizens to enjoy milk .and other dairy
foods, and do urge civic and business organizations to
cooperate in this observance in public and in private
in order that we .may enjoy continuing good health and
increased prosperity.

Mayor
Mayor Carson showed a trophy that the members of the.stdff brought back from the Colorado
Municipal League for first place in golf. He stated that the City H.nager was elected
to the Board of Directors, one of 16 members elected annually and will serve for two years,
and John Bartel, City Clerk, was elected as Chairman of the Clerk's division He said
the Colorado Municipal League will be held in Colorado Springs annually from now on.
AGENDA ITEM 2A
PRELIMINARY HEARING
Application for a Fermented Malt Beverage License by Sierra Sports, 1000 North College. ,
Mayor Carson stated that Gene Fischer, Attorney, was appearing in behalf of the applicant,
but could not be present and asked to be notified of the outcome of the hearing, concerning
the hearing date, etc. It was stated that this would ba a carry out operation only. Motion
was made by Councilman Peterson, seconded by Councilman Lopez, that the hearing _date be set
for July 15, 1971, and the boundaries of 2000 feet in all directions. Upon a roll call all
members voted in the affirmative.

SUBJECT:Application for Renewal 3.2 Beer Retail License; Southland Corporation dba Seven
Eleven Store No. 1822 58 BD, 505 South Shields, Fort Collins, Colorado
Sir:
I have checked our Department records, and find that we have not been called to the above
establishment regarding any disturbances or any liquor law violations in the past year.
I have also checked with the Juvenile Bureau regarding this place of business, and they
advise they have received no complaint concerning the sale of beer to minors.
Due to the above facts, I know of no reason why this application should not be approved.

Colorado. Application.for Renewal 3.2.Beer Retail License.
Sir:
I have checked our Department records, and find that we have not been called to the above
establishment regarding any liquor law violations in the past year.
I have also checked with the Juvenile Dureau, and they advise they have received no com-
plaints concerning this place of business selling beer to minors.
Therefore, I know of no reason why this application should not be approved.

AGENDA ITEM 3A
The City Attorney advised the Council it was necessary in a City initiated ordinance to
approve all findings and as the first reading of Ordinance No. 31, 1971, had been approved
on first reading, that the following resolution of nunc pro-tunc, meaning "now as of then"
be read at length:
RESOLUTION 71=51
RESOLUTION
OF THE COUNCIL OF THE CITY OF FORT COLLINS SETTING
FORTH FINDINGS OF FACT AND CONCLUSIONS REEGARDING THE -
SPRINGS CREEK FARM ANNEXATION
WHEREAS, annexation proceedings were heretofore initiated for lands
to be known as the Springs Creek Farms Annexation; and.
WHEREAS, pursuant to resolution after notice given as required by law,

the City Council did, on May 27, 1971, hold a hearing on said annexation; and
WHEREAS, the City Council desires to set forth in writing its _`innings f
regarding said annexation.

NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
--COLLINS :
Section 1. That the City Council hereby finds that not less than
one -sixth (2./3rd"s)of the perimeter of the area involved in said annexation is
contiguous with the City of Fort Collins.
.Section 2. The City Council further hereby finds that a community of
interest.exists between the territory proposed to be annexed and the City of
Fort Collins, and the territory proposed to be annexed is urban or will be
urbanized in the near future: and said territory is integrated or is capable
of being integrated with the City of Fort Collins.
Section 3. That the City Council further finds that none of the pro-
visions of Section 139-21-4, Colorado Revised Statutes, 1963, as amended, are
violated by said annexation.
Section 4. The City Council further finds that no elections is re-
quired under the provisions of Section 139-21-6 (2), and no additional terms
and conditions are to be imposed in connection with this annexation.
Section 5. The City Council concludes that the territory embraced
in the Spring Creek Farms Annexation is eligible for annexation to the City of
Fort Collins and should be so annexed.

ORDINANCE NO. 31, 1971
BEING AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY OF FORT COLLINS, COLORADO
Motion was made by Councilman Lopez, seconded by Councilwoman Preble, that Ordinance No. 31,
1971, be adopted. Upon a roll call, all members voted in the affirmative.

ORDINANCE NO. 32, 1971 - Worthington Farms First Annexation.
BEING AN ORDINANCE ANNEXING CERTAIN TERRITORY TO THE CITY OF FORT COLLINS, COLORADO
Mr. David Deuben, Attorney, 4315 Wadsworth Blvd., Wheatridge, Colorado, representing the
developers was present, stating that this land is eligible and contiguous to the City and there
is no land held in identical ownership, that Wood Bros., Inc. is the developer, that urbani-
zation will be completed as soon as the annexation and zoning is completed. He presented
Bill Collins, Manager and 'Marren Clinton, House Manager, of Wood Bres., Homes, Inc. It was
stated that there is 240 acres. 15 acres at the SE corner is intended to be zoned and devel-
oped as residential, the balance as single family, the price range to be from $3,000.00 for
a few, but mostly from $18,000 to 20,000 and 15 acres developed for mobile homes. He stated
there is an open ditch, and will fence part that have single family residences. That there

have been some minor changes due to drainage. Mr. Clinton presented preliminary plans of
this, stating they plan.to have more green area andlope to have some parks. After further
dicussion, motion was made by Councilman Lopez, seconded by Councilwoman Preble, that Ordi-
nance No. 32, 1971, be presented on first reading and ordered published this 17th day of
June, 1971, and to be presented for final passage on the 8th day of July, 1971. Upon a
roll call, all members of the Council voted in the affirmative.

WHEREAS, heretofore the City Council of the City of Fort Collins
initiated annexation procedures for certain property known as the Worthington
Farm First Annexatio❑ to the City of Fort Collins. more particularly
described in the "Notice of Public Hearing" attached hereto, and
WHEREAS, the owners of said property have. petitloncd that said
property be included partly in the R-L, Low Density Residential District, and .
partly in the R-P, Planned Residential District.'
WHEREAS, the Planning and Zoning Board has made a.study of said
zoning request and has held a hearing and has made a report and recommendation
thereon, all. in accordance with Section 19-46 of the Code of Ordinances of the
City of Fort Collins, Colorado,.1958, as amended, and
WHEREAS, the City Council desires to hold a hearing on said zoning
request as required by said Section 19-46.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE -CITY OF FORT
COLLINS that July 8, 1971 at 1:30 P.M., or as soon thereafter as the matter

Fort Collins, is hereby set as the time and place for a public hearing on said
zoning request; and
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to publish

THE ZONING ORDINANCE SO AS TO ALLON PET SHOPS IN
1`11E B-G, GENERAL BUSINESS DISTRICT, IN THE H-B,
HIGHWAY BUSMESS DISTRICT.
WHEREAS, the Planning and Zoning Board has made a study and has
recommended that the Zoning Ordinance be changed to allow pet shops as a oer-
mitted use in the B-G, General Business District, and the H-B, Highway Business
District; and
WHEREAS, the City Council desires to hold a public hearing upon an
ordinance so amending the Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS; that July 8, 1971, at 1:30 P.M., or as soon thereafter as the matter
may come on for hearing, in the Council Chambers in the City Hall of the City
of Fort Collins, is hereby set as the time and place for the public hearing
on said proposed ordinance; and
BE IT FURTHER RESOLVED that the City Clerk is hereby instructed to
publish a notice of said hearing as provided in Section 19-45 of the Code of
Ordinances of the City of Fort Collins, Colorado, 1958, as amended, in the
fonn attached hereto.

Councilman/asked what the int:espretation of pets was, that the word can cover a lot of
territory. City Attorney March stated that the Planning and Zoning Board can be asked
to be specific about the type of pets. Motion was made by Councilman Lopez, seconded by
Councilman Peterson, that July 8, 1971, be the hearing date and the City Attorney and City
Planner requested to define pets. Upon a roll call, all members of the Council voted in the
affirmative.

OF THE COUNCIL OF THE CITY OF FORT COLLINS ASSESSING THE COST OR REPAIR AND RECONSTRUCTION OF
CERTAIN SIDEWALKS IN THE CITY AGAINST THE PROPERTY ADJOINING THE SAME.

MIEREAS, heretofore the City Council by resolution pursuant to
the provisions of Section 22-44.3 of the Code of Ordinances of the City
of Fort Collins, Colorado, 1953, as `amended, ordered•that certain, side-
walks, curbs and gutters in the City of Fort Collins be repaired and re-
constructed in order to protect the public; and
14HEREAS, in acco dance with the provisions of Section 22-44A
of the Code of Ordinances of the City of Fort Collins, Colorado, 1953,
as amended, the City Engineer caused said work to be done, in cases where
the owners of said property failed to perform the same; and
WHEREAS, said repairs and reconstruction have been completed
and the City Engineer has made a report to the City Council setting forth
the total cost of the work done, the portion thereof chargeable to the
City of Fort Collins, the portion thereof paid for by the property owners
affected and the portion remaining to be assessed against the property
adjoining the sidewalk, curb or gutter which was repaired or reconstructed;
and
WIIERFAS, the City Engineer in accordance with Section 22-44.6
of the Code of Ordinances of the City of Fort Collins, Colorado, 1958, as
amended, has heretofore mailed to the property owners affected notice that
the City Council would hold a hearing on May 20, 1971, on his report, and
said hearin; was duly held a::d continued to this date; and
WHEREAS, the City Council has reviewed the report of the City
Engineer and has considered all complaints presented in person or in
writing and has made adjustments for any objections which. the City Council
has found to be valid.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
FORT COLLINS:
Section 1. That the report of the City Engineer be and the
as a hereby is accepted and approved except as the same has been adjusted -
by the Cit- Council.
Section 2. That the remaining unpaid cost of such repair and
reconstruction work, to -wit: $11,060.63, including the mount required
by Section 22-44.7 of the Code of Ordinances of the City of Fort Collins,
Colorado, 1953, as amended, to cover the cost of engineering and other
incidentals, -is hereby assessed upon the respective properties adjoining
the sidewalks, curbs and gutters repaired and reconstructed and the amount
assessed upon each lot or tract of land shall be as follows:

Section 3. All assessments heroin provided for shall be due
and payable within 60 days after the date hereof without demand and shall
be payable at the office of the Director of Finance of the City. The
amounts herein assessed shall bear interest from the date hereof at the
rate of six per cant per annum.
Section 4. The Director of Finance shall prepare an assessment
roll in proper form and shall keep a record of all payments made during
the 60-day period from the date of this resolution and upon the expiration
of said 60-day period he shall deliver said assessment roll to the County
Treasurer of Larimer County with his warrant for collection of the same.
On such date to the amount hereby assessed stall be added a ten per cent
penalty to defray the cost of collection, all as provided in Section 22-
44.9 of the Code of Ordinances of the City of Fort Collins, Colorado, 1958,
as amended.
Section S. All collections made by the County Treasurer on
said assessment roll in any calendar month shall be accounted for and paid
over to the Director of Finance on the first day of each and every month
with separate statements for all such collections for each month in the
same manner as general taxes are paid by the County Treasurer to the City.

- STADIUM HEIGHTS SUBDIVISION
Location: East side of Overland Trail and North of Prospect. Utility agreement has been
signed. Motion was made by Councilman Peterson, seconded by Councilwoman Preble, that
this plat be approved. Upon a roll call, all members of the Council voted in the
affirmative. '
PLAT - POUDRE VALLEY MOTORS ADDITION
Don Reynolds, Planning Director, presented a plat and Unit Development plan, stating this
was south of Swallow Drive He explained the unit development plan and the median strip,
saying that Swallow Road will be the main access road and recommended approval. Councilman
Lopez asked if there would be curb, gutter and paving. The City Engineer stated there
would be. After discussion, motion was made by Councilman Lopez, seconded by Councilwoman
Preble that this plat and development plan be approved. Upon a roll call, all members
of the Council voted in the affirmative.
DISCUSSION
There was an unusual number of students present from the Communication Class from C.S.U.
and the Professor. They showed a great deal of interest by asking questions concerning
Council procedure such as boundaries, plats, the budget, railroad tracks, the recycling
of water, the expansion of Fort Collins and congestion that might result, slums, etc.
These questions were answered by the Mayor, City manager and City Attorney. Mayor Carson
extended an invitation to the class for another visit and other classes and said the
Council was trying to make government responsible and responsive to others. Councilman
Lopez expressed appreciation for the class being at Council and encouraged discussion,
stating that the Council -members do not act in a personal intent and that the questions
asked by. the students were not on a personal basis, that they are elected at large and
thereby make a real effort to serve the people.

As a member of the Fort Collins Human Relations Commission, I have been considering my
contribution to the activities and progress of this organization. My record of attendance
at meetings for tie past six months has been rather unsatisfactory, having been absent from
the past five meetings. I have been out of the state for four months and plans call for
my being away from Fort Collins in September. Plans for 1972 include my being out of the
state for three months. This Commission needs members who can attend meetings regularly
and take an active part in all phases of the program.
In view of the above circumstances I feel it best for all concerned that I resign from said
Commission effective immediately. This will enable the City Council to appoint a successor
who can give far more support to this important program.
I appreciate having the honor to serve on this Commission and wish it success in carrying
out the program of this important undertaking.

growth.

I wish to thank you for the copy of Sections 8-22
through 8-24 of your ordinance regarding the sale of real
estate owned by the City, and the copy -of Article IX, Sec-
tion 3, of your Charter, which contains restrictions on the
sale of water rights owned by the City. I have reviewed
these and would like to suggest that your resolution state
that the Council has determined or found that the use of
these particular claims and water filing are not useful
to the City of Fort Collins in their present form Because
of the unavailability of physical works to divert and carry
this water from the Colorado River to the City of Fort
Collins.

OF ThM COUNCIL OF THE CITY OF FORT COLLINS APPROVING
THE: CONVEYANCE OF CERTAIN HATER RIGHTS TO MUNICIPAL
SUBDISTRICT, NORTHERN COLORADO WATER CONSERVANCY DIST-
RICT
WHEREAS, heretofore, Ralph R. Price, as trustee for Longmont, Love-
land, Fort Collins, Greeley, Estes Park and Boulder, filed certain claims on
water rights; and
WHEREAS, certain water rights are more particularly described as
situate, lying and being in the County of Grand, State of Colorado, to -wit,
I. Statement of Claim of Ralph R. Price, as Trustee for
Longmont, Loveland, Fort Collins, Greeley, Estes Park and
Boulder for the JASPER PU1dP, PIPELIIIE AND CANAL which
represents a claimed right to 300 cubic feet of water per
second of time through said structure with an alleged date
of appropriation of October 29, 1953, which right was
initiated by said Ralph R. Price, as Trustee, and submitted
for adjudication in the.currently pending Supplemental
Adjudication of Water Rights in Water District No. 51,
being case No. 1768 in the District Court of Grand County,
Colorado.
2. Statement of Cl-im of Ralph R. Price, as Trustee for Long-
mont, Loveland, Port Collins, Greeley, Estes Park and Boulder
for JASPER RESERVOIR With a claimed right to store 11,292.58
acre feet to the waters of the Colorado River in said structure
with an alleged date of appropriation of October 29, 1953,
which right was initiated by Ralph R. Price as Trustee and
submitted for adjudication in the currently pending Supplemen-
tal Adjudication of Water Rights in Water District No. 51,
being case No. 1768 in the District Court of Grand County,
Colorado.
3. Statement of Claim of Ralph R. Price, as Trustee for Long-

for AZNDY GAP RESERVOIR with the claimed right to store 1,546.14

River through said structure, with an alleged date of appropria-
tion of October 29, 1953, which right was initiated by Ralph R.
Price as Trustee and submitted for adjudication in the currently
pending Supplemental Adjudication of Water Rights in Water
District No. 51, being case No. 176E in the District Court of
Grand County, Colorado.
5. The map and sworn statement for Jasper Pump, Pipeline
and Canal, Jasper reservoir, handy Cap Reservoir, and
Windy Gap Pump, Pipeline and Canal filed in the office of
the State Engineer of t':e State of Colorado on October 27, 7
1967, as Filing No. 23151.
WHEREAS, the City of Fort Collins has participated in the formation
of Municipal Subdistrict, Northern Colorado Water Conservancy District for the
purpose of developing said water rights; and
WHEREAS, it is not practical for the City of Fort Collins to
construct the necessary physical works to divert and transport such water
to the City and because of this, such water rights are not useful to the
City in their present form; and
WHEREAS, if such water rights are developed by Municipal Subdistrict,
Northern Colorado rater Conservancy District, the residents of the City, which
is a part of the said subdistrict, would be able to obtain the beneficial use
of said water rights.

NOW, THF,RUI,F MS, BE IT RESOLVED BY THC COUNCIL OF THE CITY OF FORT
1. That the City Council hereby finds and determines that the
water rights above described in their present form are not capable of being
uscd by the City, and it is for the nest interest of the City that the same
be conveyed to unicipal Subdistrict, Northern Colorado Water Conservancy
District.
2. The mayor and the City Clerk be, and they hereby are, authorized
and directed to execute aadeed for.and on behalf of the City of Fort Collins
conveying the above described water rigiits to_:uaicipal Subdistrict, Northern
Colorado Water C>nservancy District.
Passed and ado -)tad at a regular meeting of the City Council held
this 17th day of June, A. D. 1971,
