COUNCIL OF THE CITY OF FORT COLLINS
SPECIAL MEETING
July.25, 1974 - 1:30 P.M.
Council members present: Bowling, Fead, Gray, Reeves, Russell and Wilkinson.
Absent: Councilwoman Preble.
Staff present: Brunton, Cain, Bingman, March and Lewis.
A Special Call for this meeting had been signed by Council members Bowling,
Fead, Gray, Reeves, Russell and Wilkinson on July 23, 1974 at 2:40 P.M.
(Record in Central Files).
Councilwoman Preble previously gave notice she would be unavailable for a
special meeting dates from July 12, 1974 to August 3, 1974. (Record
in Central Files).
City Clerk Verna Lewis read the resolution at length.
Councilwoman Reeves stated it was her feeling that the Council had certain
responsibilities to the Western slope in terms of water diversion and Council
had certain responsibilities as a State and as a nation with regard to the
salinity problems, and although the legal opinion that was given. says that
it is federal responsibility and therefore there is no legal binding pro-
blem as far as the State of Colorado and. the cities are concerned, she
.thought that Council did have a responsibility in terms of the salinity
problems that will develop within the Colorado River Basin, and sb&
personally does not feel that the City ..should be diverting water from
the Western Slope. She had no problems at all with Platte River and she
realizes that if Windy Gap does go through, that the water will be used,
but she found it very difficult to support the transmountain water
diversions.
Councilwoman Gray stated she felt it was the best solution to a couple of
bad alternatives, because it seemed to her that the only other alterna-
tive was to use up agricultural water and dry up the agricultural land.
Mayor Fead stated he Jolieved there were other alternatives that may be
brought forward to solve the salinity problem, such as the importation of
water from other basins to augment some of the other flow.
Bill Hansen, Consulting Engineer, spoke to his concern that the City
should retain some right in the Windy Gap Project., City Attorney March
spoke to the City's objective in developing water,as he understands it,
qL§ the development of water which the City now has. Further a provision
in the Agreement that if Platte River does make any other use of the
water that is assigned to them, the City has first right of refusal.
Councilman Bowling made a motion, seconded by Councilman Russell, to adopt
the resolution. Yeas: Council members Bowling, Fead, Gray, Russell and
Wilkinson. Nays: Councilwoman Reeves.

' RESOLUTION 74-72
OF THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING AN
ASSIGNMENT TO PLATTE RIVER POWER AUTHORITY
WHEREAS, heretofore the City of Fort Collins has participated along
with the Cities of Loveland, Estes Park,_Greeley, Longmont and Boulder in a
venture to acquire and develop additional waters from a project known as the
"Windy Gap Project", and
WHEREAS, the Municipal Subdistrict of the Northern Colorado Water
Conservancy District (hereinafter referred to as the "Subdistrict"), was formed

to develop such waters for the Cities participating, and
:z7 WHEREAS, the Subdistrict has extended to the six participating Cities
the preferential right to sign an allotment agreement for the waters to.be developed•
from the Windy Gap Project, and
WHEREAS, the Platte River Power Authority is an agency and instrumentality
of the City of Fort Collins that supplies the electrical power and energy
requirements of the City, and
WHEREAS, the Platte River Power Authority has requested that, if the
City makes a determination that it does not desire to execute an allotment
contract with the Subdistrict for its water utility, the City assign its prefer-
ential right to enter into such allotment contract to the Platte River Power
Authority, and
WHEREAS, the Water Board of the City of Fort Collins has made a study and
has recommended to the City Council that the City of Fort Collins not enter into
an allotment agreement with the Subdistrict in connection with its water utility
but that the City assign its right to enter into such allotment agreement to the
Platte River Power Authority, and
WHEREAS, it is the opinion of.the City Council that the recommendation
of the Water Board should be followed, and
WHEREAS, an assignment from the City of Fort Collins to Platte River
Power Authority has been prepared and approved by the City Attorney and the City
Manager.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that the right of the City of Fort Collins to a preferential share of one -sixth
(1/6) of the waters developed by the municipal subdistrict of the Northern Colorado
Water Conservancy District be assigned to the Platte River Power Authority, an
agency and instrumentality of the City of Fort Collins, to be used for the pro-
duction of electrical power to meet the energy requirements of the City of Fort
Collins.
' BE IT FURTHER RESOLVED that the assignment prepared and presented to the
City Council be, and the same hereby is, approved ancaccepted; and the Mayor

and City Clerk be, and they hereby are, authorized and directed to execute
said assignement for, and on behalf of, the City Fort Collins.
Passed and adopted at a Special Meeting of the City
Council on this 25th day
of July, 1974.

Special meeting adjourn. Yeas: Council members Bowling, Fead, Gray,
Reeves, Russell and Wilkinson. Nays: None.
