Absent: Council members Fead and Gray. Staff present: Brunton, DiTullio, March, Cain and Hoffman, and Lewis. q0 Election of Presiding Officer of the Day Councilman Bowling made a motion to nominate Mabel Preble as the presiding officer over the Special meeting, seconded by Councilman Russell. Yeas: Council members Bowling, Preble, Reeves, Russell and Wilkinson. Nays: None. Personnel Policies and Procedures City Manager Brunton stated that a meeting with the Police Department had been held on Jive 12, 1974. Also, the rules had been reviewed again at staff meeting. The recommendation of the administration is that the rules be approved with the following changes: With the understanding. that a standing committee will be appointed to discuss personnel rules and regulations, periodically, and in November of each year the Personnel Board will review the rules for any suggested changes. Changes for Personnel Policies and Procedures June 13, 1974 Page 7. SECTION 3-2. PERSONNEL BOARD Under Subsection b, change last sentence as follows: "...except those grievance hearings where both the City and the employee have requested a closed meeting; if only one party re- quests that the meeting shall be closed, the Personnel Board shall make the determination. The Board shall also have the power to close a meeting where it deems it to be in the interest of the concerned parties." Page 11. SECTION 4-4. ADMINISTRATION OF CLASSIFICATION PLAN Paragraph 3, line 6: Change as follows: ' "If the Personnel Division determines that the position has changed sufficiently it will recommend reclassification to the City Manager,; such reclassification will be considered as a change in position, and rules and pay policies applicable to a position change will apply. If the Personnel Division rerrimmends that a reclassification is not 378 justifiable, this may be appealed to the City Manager. If denied, no similar request may be submitted within six (6) months." Page 27. SECTION 9-3: SEPARATIONS Under Subsection a, change line 4 as follows: "The department head may, with the. concurrence of the Personnel Division, agree to permit a shorter period of notice due to ex- tenuating circumstances or when it is in the best interests of the City. Failure..." Page 28. Under Subsection d, add at end of paragraph: "However, every effort will be made to reassign the employee to a position within the employee's physical and mental capabilities." Page 29. SECTION 10-1. CONDUCT Under Subsection c, paragraph 3, change "sick leave or disability leave" to "injury leave..." Page 32. SECTION 10-6. DEMOTION 1 Change last sentence as follows: ' "A lareer employee, with the exception of an employee on probationary status, demoted or reduced in grade, shall have the right to appeal ' to the Personnel Board as provided in Article XI." . Page 34. Under Step 4, paragraph 2, line 7, change as'follows:s "Manager. Step 5. The City Manager shall, within ten (10)...." Page 35. SECTION 11-4. IMMUNITY Change line 4 as follows: "writing. The City Manager shall authorize an investigation of such complaints...." FRINGE BENEFITS: Under LEAVES Under SICK LEAVE, line 1 of paragraph: Insert the word "disability," after "actual illness,". i 770 1 W /01 1 Councilman Russell inquired of Section 3-2 personnel Board, as it relates to open versus closed meetings. The Council discussed this provision at length and City Manager Brunton sug- gested this provision be struck and reviewed by the committee. Mr. Steve Hughes spoke to the Department views on the subject. Councilman Russell requested clarification of Section 3-2, subsection c. Investigation and Hearings. City Attorney March spoke to the spirit of the rule. Art Eckdahl representing the interest of a substantial majority of the employees, inquired if Council had any questions of general employee attitudes. Councilwoman Reeves inquired if the suggested standing committee' review would be taken back to the employee's committees. It was stated that it would be. Councilman Bowling made a motion, seconded by Councilwoman Reeves, to approve the rules, as stated, with the understanding that the administration would set up a standing committee to continue to review the rules. Yeas: Council members Bowling, Preble, Reeves, Russell and Wilkinson. Nays: None. Other Business Councilman Wilkinson inquired into the appointment of the Executive Direc- tor 6f DT2. City P4anager Brunton stated this.would be reviewed by the Council at a future date. 2. City Attorney March stated in the case of Nichols versus Chismar et al, he would like permission to enter an appearance on behalf of the City and the City Council, City Manager and other City employees, where we are not covered by insurance. Councilman Russell made a motion, seconded by Councilwoman Reeves, to authorize the City Attorney to enter an appearance in the case on behalf of the City. Yeas: Council members Bowling, Preble, Reeves, Russell and Wilkinson. Nays: None. Adjournment Councilman Wilkinson made a motion, seconded by Councilman Russell, that the special meeting adjourn.
