MINUTES OF A REGULAR MEETING OF THE COUNCIL OF THE CITY OF FORT
COLLINS, Held Thursday, February 12, 1970, at 1:30 o'clock P.M.
Present: Councilmen Carson, Troxell, Lopez, Kissock and Kruchten.
City Manager Coffey, City Attorney March and Director of Public Works Liquin.
Motion was made by Councilman Kruchten, seconded by Councilman Kissock,:
that that reading of the minutes of the last regular meeting held February 5,
1970, be dispensed with. Roll was called resulting as follows: Ayes:, ".c ,
Councilmen Carson, Troxell, Lopez, Kissock and Kruchten Nayes: None' The
Mayor declared the motion adopted.
Mayor Carson welcomed a group of Fourth Graders from O'Day School,
and stated they were interested in Government and Government procedures and that
they had a Mayor and Council within their class.
The Merchant of the Month award was awarded to Mr. John Benton of
Miller Tire Sales Company for outstanding work in eliminating fire hazards -at
his place of business. Chief Yogkers and Lieutenant Jewert inspected his
place and praised the maintenance of his premises regarding fire safety.
The following ordinance was presented on second reading:

BEING AN ORDINANCE AMENDING ORDINANCE NO. 70, 1969, REiATING TO TFF COLLECTION,
REMOVAL AND HAULINS OF HOUSEHOLD GARBAGE AND HOUSEHOLD TRASH
Motion was made by Councilman Lopez, seconded by Councilman Troxell,
that Ordinance No. 8, 1970, be adopted. Roll was called resulting as follows:
Ayes: Councilmen Carson, Troxell, Lopez, Kissock and Kruchten Nayes: None.
The Mayor declared the motion adopted.
The City Attorney advised the Council that West LaPorte Avenue Third
Annexation was a forced annexation, therefore would have to hate a noticeof public
hearing.
The foilowing ordinance was presented on first reading and read at

Motion was made by Councilmen Kissock, seconded by Councilman
Kruchten, that Ordinance No. 11, 1970, be considered favorably on first reading
and ordered published this 12th day of February, A. D. 1970, and to be present-
ed for final passage on the 5th day of March, 1970. Roll was called resulting

OF THE COUNCIL OF THE CITY OF FORT COLLINS SETTING FORTH THE INTENT OF THE CITY
COUNCIL TO ANNEX: CERTAIN AREA TO THE CITY
WHEREAS, the property hereinafter described has had for more than
three (3) years prior to this date two
(2/3) of its boundary contiguous
to the boundary of the City of Fort Collins; and
WHEREAS, the City Council of tje City of Fort Collxjbq-.Faesires to annex
said area to said City.

it will hold a hearing to determine if the proposed annexation complies with
the provisions of the laws of the State of Colorado, the date, time and place
set forth in such notice as provided in C.R.S., 1963, Section 139-21-7.

PUBLIC NOTICE CONCERNING A
PROPOSED ORDINANCE CHANGING THE ZONING MAP OF -THE CITY OF FORT COLLINS AND
AMENDING CHAPTER 19 OF THE CODE OF ORDINANCES OF THE CITY OF FORT COLLINS,
COLORADO, 1958, AS AMBNDED, COMMONLY KNOWN AS THE ZONING ORDINANCE
WHEREAS, a written petition has been presented to the City Council
requesting that the zoning classification for th=property more particularly
described in the Notice of Public Hearing", attached hereto be changed from
R-H, High Density Residential District, partly to R-M-P, Medium Density Planned
Residential District, and partly to R-P, Planned Residential District; and
WHEREAS, the Planning and Zoning Board has made a study of said
rezoning request and has held a hearing and made a report and recommendation
theeeon, all in accordance with the provisions of Section 19-46 of the Code

annexationandhas held a hearing and made a report and recommendation con-
cerning the zoning for said property, all in accordance with Section

RESOLUTION 70-21
of THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING NEGOTIATIONS FOR A PAR-
TICIPATING AGREEMENT BETWEEN THE PLATTE RIVER MUNICIPAL POWER ASSOCIATION AND
THE CITY G' FORT COLLINS IN ORDER TO OBTAIN ADDITIONAL SOURCES OF POWER AND
ENERGY
WHEREAS, it appears that additional sources of power and energy will
be required by the City of Fort Collins about the year 1975; and

the minimum area of lot provisions specified in the applicable zoning district
regulations. The Planning and Zoning Board and Council shall retain the
right to establish general design standards which shall apply to any.or all
unit developmpt plans based upon such factors as the proposed housing type,
unique features of the site, and the surrounding neighborhood.

OF THE COUNCIL OF THE CITY OF FORT COLLINS GIVING NOTICE CONCERNING A PROPOSED
ORDINANCA AMENDING SECTION 19-44 OF THE CODE OF ORDINANCES OF THE CITY OF
FORT COLLINS, COLORADO, 1958, AS AMENDED, AND RELATING TO SPECIAL REQUIREMENTS
FOR UNIT DEVELOPMENTS
WHEREAS, the Planning and Zoning Board has made a study and has
recommended that the Zoning Ordinance be amended, changing the requirements for
residential unit developments; and
WHEREAS, said proposed amendment is more specifically set forth in
the Notice of Public Hearing attached hereto; and
WHEREAS, the City Council desires to hold a public hearing upon an
ordinance accomplishing such amendment.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that March 5, 1970, at 1:30.P.M..' or as soon thereafter as the matter
may come on for lhearing, in the Council Chambers in the City Hall'of the City

said proposed ordinance; and

BE ENTERED INTO BETWEEN THE CITY OF FORT COLLINS AND THE NORTHERN`COLORADO
WATER 'CONSERVANCY DISTRICT
WHEREAS, the City of Fort Collins has acquired 41 acre feet units of
the waters of the Northern Colorado Water Conservancy District; and
WHEREAS, said units have not been put on permanent contract but are
held by the City under a temporary use permit which expires on March 1, 1970;
and
WHEREAS, the City of Fort Collins desires to renew said.temporary
use permit, and a temporary use permit has been submitted to the City by the
Northern Colorado Water Conservancy District which has been approved by the
City Manager and the City Attorney.

WHEREAS, at a meeting of the Platte River Municipal Poster Association
held December 19, 1969, the Board of Directors recommended the investigation
of the possibility of negotiating a participating agreement with other power
suppliers, such as the Salt River Project Agricultural ImproveTnent and Power
District, for the construction of a generating station and associated trans=
mission facilities; and
WHEREAS, a majority of the City Council is ._now satisfied that the
explorationof such a joint participation agreement with other power supplier
is advisable; and
WHEREAS, the necessary lead time for the construction of such a plant
in time to meet the needs of the City of Fort Collins is critical.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the City of Fort Collins' representative on the Board of Directors
-of the Platte River Municipal Power Association is hereby directed to use his
best efforts to obtaii, the expeditious negotiation of such a participating agree-
ment between the Platte River Municipal Power Association and any other
supplier or suppliers of electricity to the end that a form of agreement-
-may be submitted to the City Council for its consideration at the earliest prac-
tical time; provided, however, that no such agreement shall be binding upon
the City of Fort Collins until formally approved by the City Council
BE IT FURTHER RESOLVED that the City of Fort Collins; representative
be and he is hereby authorized to join wife other directors of the Platte
River Municipal Power Association in employing the professional assistance
deemed advisable in the conduct of such negotiations.

(3) Residential unit developments in areas with R-P zoning may have
a maximum density of 12 units per net acre provided the rationof floor area to
lot area of the R-L, Low Density Residential zone is not exceeded, except in
such cases where the development has at least 50 percent of its boundary adja-
rent of its boundary adjacent to an R-H district or to a non-residential city
zoning district in which .case the maximum density may be 20 units per net acre,
provided the ratio of floor area to lot area of the R-M, Medium Density
Residential zone is not exceeded. The maximum overall density of the resi-
dential unit developments in all other residential zones shall be based upon

The matter of the by-laws of the Senior Citizens Commission was
presented. Article III, Item No. 2, does not comply with the regulations of
the City Charter and should be amended to read that the Council may by ordi-
nance create additional boards, the members of which shall serve without pay,
and shall serve for four years or until their successors are appointed.

The City Manager advised the Council that at the last meeting of the
Board of Directors of the Fort Collins Municipal Golf Asso., they requested
the approval of the City Council to increase the green fees at the Municipal
Golf Course .251 per round from $1.75 to $2.00 on weekdays and from $2.75 to
$3.00 on weekends and holidays. He stated that this .2V increase be earmarked
for the new clubhouse at the Warren Lake Golf Course for 1970• After dis-
cussion, motion was made by Councilman Kruchten, seconded by Councilman

The Commission and staff of the Colorado Game, Fish and Parks Division have
been interested in Seaman Reservoir as an open, public -use area.
We are respectfully roq_uesting that you discuss with the Fort Collins City
Council.the possibility of opening this area to the geneia public for purposes
of.fishing. We will cooperate with the City of Fort Collins as much as possi-
ble in this matter.

The City Manager stated that two years ago this request was turned
down baeause of the dust, but that the Game, Fish and Parks Department had
agreed to maintain the bridge and oil mat the road past the buildings to where
the road widens, that he had contacted Greeley and it was agreeable with them,
and recommended that this request be granted. Motion was made by Councilman
Kruchten, seconded by Councilman Troxell, that this request of the State Game,

Gentlemen:
I hereby tender my resignation. because my residence after February
17, 1970, will be outside the city limits of Fort Collins, Colorado.
I was honored by the appointment to the Personnel Board and have found
pleasure in -serving with the other members and assistant manager Burgess, I
am sure that the continuation of this board will be productive for the city and
its employees and I am pleased with the councils approval of anddunding of the
pension plan. I want to thank you gentlemen for giving me the opportunity to
serve our,fair city.

The City Manager stated that the personnel rules state 5 days emer-
gency leave and requested that the Council authorize him to ex tend this emer-
gency leave for an employee who has-been`witH the City for 18 years and whose
wife is in the hospital, until such a time that this be relieved. Motion
was. made by Councilman Troxell, seconded by Councilman Lopez, that this request
be granted. Roll was called resulting as follows: Ayes: Councilmen Carson,

The Gity Attorney advised .the Council that the suit against Mr. Morger
was completed. The, action in Municipal Courtlasted all day and he was.found
guilty on three charges of $300.00 each and another $100.00. The Judge

suspended these charges for six months to comply with the ordinance. /. stated
that he had hauled many truck loads away and;.had many more yet to haul.
Councilman Lopez stated that he had attended a meeting. of the Human
Relations Commission's report on the housing and they urged Fort Collins establish
a Housing Code to improve same. The Mayor recommended a copy of housing code
be sent to Senior Citizens to see their reaction. The Human Relations Com-
mision is seeking to have Fort Collins develop a.housing code for students,
that there would public discussions in the near future.
Councilman Troxell asked when the signs would be put up on Impala
Drive. The City Manager advised him that the new Traffic Engineer would

start.to work the 16th of February, 1970, and was sure he would take care
of this metter.
