Regular Meeting
A regular meeting of the Council of the City of Fort Collins, Colorado, was held on
Thursday, February 1, 12173, at 1:30 P.M. in the Council Chambers of the ..ity Hall.
Present: Councilmen Carson, Lopez, Preble, Peterson and Fead.
Staff members present: Brunton, DiTullio, 1'rynolds, Liquin, Cain, March and Lewis.

Councilman Fead made a motion, seconded by Councilman Preble, to approve, as
published, the minutes of the regular meeting of January 2S, 1973. Yeas:
Councilmen Carson, Lopez, Preble, Peterson and Fead. Nays: None.
Merchant of the Month Award
Mayor Carson stated he was pleased to have this presentation started once again, as
this practice had been discontinued for some months.
Before making the Merchant oZ the Month Award to Mr. Ed Carroll, Ed Carroll Volkswagen,
Mayor Carson called on Lieutenant Hisam of 'the Fire Prevention Bureau to make
remarks on why this merchant had been granted the award. Lieutenant Hi.sam stated
Ed Carrel Volkswagen conducted a safety program each week and were deserving of the
award.
Mayor Carson presented the award and congratulated the recipient.
Application for a Hotel -Restaurant Liquor License for
Northern Hotel - taken under advisement
Mayor Carson.read the rules of Procedure at length:
City Attorney March reviewed the preliminary findings of the Authority and the
reports of the departments.
Attorney Gene Timmermans,representing the applicants, made opening r^marks relative
to the boundaries (City Limits) set by the Authority and stated the boundaries
could well be the Hotel itself, as it is proposed to be a Hotel serving the traveling
ipublic, rather than a resident hotel.
City Attorney March inquired if the applicants desired a change in the boundaries.
Mayor Carson stated he felt in fairness to other applicants, the boundaries as
previously set by the Authority, should stand.
Those giving oral testimony were as follows:
Mr. Ronald Callari 1917 South Shields, "anager of the Northern Hotel.
Mr. William R. Stark, 271S Grinell Dr., Longmont, Colorado
Mrs. Mary Ann Brantmeyer, 2700 Mountain Viow, Longmont, Colorado; applicants.
Attorney Gene Timmermanssuu,T.i.tted three exhibits which :.c petitions in support of
the application, containing 341 names. These petitions were received for what ever
value they may have in making a determination on the application.

Discussion was also held on proposed renovation of the entire Hotel complex and
compliance with Building Inspection requirements.
No opposition to this application was filed or objections voiced.
Mayor Carson declared the hearing terminated, and that the matter would be taken
under advisement, with a decision rendered in due time.
Ordinance adopted zoning the 74sz Lincoln Avenue Annexation
Councilman Lopez made a motion, seconded by Councilman Fead, to adopt the ordinance
on second reading zoning East Lincoln Avenue Annexation. Yeas: Councilmen Carson,
Lopez, Preble. Peterson and Fead. Nays: None.

Ordinance adopted on First reading approving Bookmobile Agreement between
Larimer.County.and.the City of Fort Collins
City Manager Brunton stated the agreement was self, -explanatory, that the only difference
was slightly more money. Director of Finance, Charlie Cain, stated the charge was from
$28,925 to $31,832 or a $2,907 increase paid to the City. Councilman Preble inquired
whether the City's cost was not increasing and on what basis, mileage, percentage,
other, this agreement was based on. City Manager Brunton stated he would investigate
these aspects with the Library Board this summer and make a report to the Council.
Councilman Fead made a motion, seconded by Councilman Lopez, to adopt Ordinance No.
17, 1973, approving the bookmobile agreement between Larimer County and the City of
Fort Collins. Yeas: Councilmen Carson, Lopez, Preble, Peterson and Fead. Nays: None.
Bid awarded for Street and Highway Line Striper
City Manager Brunton stated the low bid was recommended. Traffic Engineer, Joe Rice,
stated the bid included trade-.inof the old equipment.
Councilman Fead made a motion, seconded by Councilman Preble, to award the bid as recom-
mended to Unamisco, Inc., in the amount of $9,451. Yeas: Councilmen Carson, Lopez,
Preble, Peterson and Fead. Nays: None.
Bid awarded for'Poles, Controllers and Signal Heads
City Manager Brunton stated low bid was recommended. City Attorney March stated he
had reviewed the bids for possible irregularities and found no harm was done to any
bidder.
Councilman Peterson made a motion, seconded by Councilman Lopez to award the bid as
recommended to Gades Sales Company for moles ($9,224.80); to Econolite Corp. for
Controllers (ai5,850.oz); and to Eogle Signal Co. %Gades Sales Company for signal
heads ($6,439.00). Yeas: Councilmen Carson, Lopez, Preble, Peterson and Fead. Nays:
None.

Addition to Bylaws of Human Relations Commission
Approved
TO: The Honorable Mayor and City Council
FROM: The Fort Collins Human Relations Commission
SUBJECT: FUnendment to Bylaws of the Fort Collins Human Relations Commission
It is the unanimous decision of the Fort Collins Human Relations Commission to
amend the Bylaws of the Commission by the addition of the following subheading
3 to Section V, C.
"So that the conduct of business of the Commissioni can be
effectively carried out, it is necessary to have the support
of every member. Therefore, all members shall indicate their
interest in and intention of serving the Commission in good
faith by attending all meetings punctually and consistently.
If for any reason a member is unable.to attend, it is his
responsibility to inform any officer of the Commission or a
fellow member of such absence some time prior to the meeting.
Upon three consecutive unexcused absences or failure of a
member to attend at least one-half of the yearly ineetings
prior to the annual meeting, the member small be expected to
tender his resignation voluntarily, or the President of the
Commission shall exercise his duty of directing such member to
resign, so that others interested and willing to serve may be
given the opportunity."
We feel this amendment will strengthen the attendance and participation of each
member and thus the overall effectiveness of the Commission, and strongly
solicit your support and approval.

Councilman Lopez spoke to the recommendation, saying while he supported it in princi-
ple, lie felt i»ore effort on the part of the commission Secretary should be made to
remind members of meeting dates.
Mayor Carson stated he felt this was being done and that copies of minutes were mailed
out to members. Ile also stated the purpose of the request was to strengthen the
attendance and participation of members.
Councilman Preble made a motion, seconded by Councilman Lopez, to approve the
addition to the bylaws of the Human Relation Commission. Yens: Councilmen Carson,
Lopez, Preble, Peterson and F^_ad. Nays: None.
Changes in Council Agenda Prodedure Approved.

City Manager Brunton stated one of the recomrn-rded changes in the Council Agenda
procedure would be to start the meeting one half hour earlier, at one o'clock P.M.
and 7:00 o'clock P.M. City Attorney Marsh pointed out the problem of notices and
advertising setting forth a specific time.
Councilman Preble spoke to the question, stating this could take the place of the
Wednesday Night talk sessions. Mayor Carson stated lie was concerned that this half
hour session would become a public forum.
City Manager Brunton stated that answers could be given to some items, others could be
referred to the staff for reporting back at the next meeting, and if Council approved
the changes in principle, additional changes could be made from time to time as needed,
Coun Gilman Fead made a motion, seconded by Councilman Preble, to try the system and
see how it works out. Yeas: Councilmen Carson, Lopez, Preble, Peterson and Pead.
Nays: None.
City Manager's Report on Street Lights
City Manager Brunton stated that alternative programs for street lighting and the
alternative costs will have to be discussed prior to the 1974 budget preparation. Also,
the City gets many requests, equally split, from persons who want less lighting and
persons who want more lighting.
Mr. Brunton stated these matters should be looked at from a Traffic and policing
standpoint, he also read from a request for removal of a street light from a Street
Improvement District. Mayor Carson, along with the City Attorney, expressed concern
on what this request would do to the district.
City Manager Brunton stated he would review the request with the City Attorney and
report back.
Report on new Comprehensive Health Maintenance and
Lifa Insurance Program
City Manager Brunton stated he had no comments on the proposal, that bids were being
taken and a report would be given Council at a later date.
Councilman Preble inquired into benefits'for part-time employees and Councilman
Lopez inquired into definitions on conversion factors of the proposals. Brief
reports on the two above items were given and the item will appear on the agenda
next week for further review.
Ordinance adopted on first reading submitting Charter Amendments
to the Electors at the April 3, 1973 General Election
Mr. Charles N. Shepardson, Chairman of the Charter Review Committee read from the
Committee's prepared report on the rational for the drafts of the Amendments submitted.
(Report in Central files).
Considerable discussion was held on a proposed amendment to Article XXI defining
the terms "elector" and "elector or taxpayer"." Mayor Carson stated this md,ter should
be corrected.
City Attorney March stated the conditions were almost impossible on requirements
that the Clerk and Election Board check the percentage set forth, and that absent

any -requirement or certain requirements need to be specified.
Councilman Lopez stated he would like to enhance the initiative process. Mayor
Carson requested a detailed study be made oil legal problems surrounding petitions
adding that this amendment would not be included on the ballot in April.
City Attorney gave a detailed report on the recommendations of the Bonding Attorneys
in regard to munis.i,,al b^rrowing and issuance of Bonds.
Councilman Lopez made a motion, seconded by Councilman Peterson to adopt Ordinance
18, 1973, on first reading sumitting eight proposed Charter Amendments at the
General City Election April 3, 1973. Yeas: Councilmen Carson, Lopez, Preble,
Peterson and Fead. Nays: None.
Communication from Advisary Commitee on the Employment
of the Mandicanned.

Dear Mayor Carson:
The Advisory Committee on the Employment of the Handicapped has reviewed
many standards relevant to specifications for making buildings and facilities
accessible and usable by the physically handicapped population. Paramount
among those considered was the Tulsa City Ordinance #7776 which ammended the
building code in that city pertinent to building and construction. We have
found, after considerable study, that the Tulsa program adheres to the American
National Standards published by the National Society for Crippled Children and
Adults and approved by the President's Committee on Employment of the Physically
Handicapped.
This Advisory Committee on the Employment of the Handicapped categorically
recommend that all building codes for the city of Fort Collins be reviewed in
light of the standards specifically notPa by the American National Standards.
Institute. We further recommend that all inconsistencies or deficits identified
in the current building code of Fort Collins be ammended so that our building
code is compatible w.ith the American National Standards.
Obviously, members of this ccirmittee do not have the experti.se to accom-
plish this recommendation and, therefore, we formally recommend that appropri-.
ate individuals be named by the City Council to take appropriate steps to update
the Fort Collins building code in a manner which will eliminate any discrepancy
between the existing code and the National :standard.

REPORT OF CITY ATTORNEY
city Attorney March reported that the recent suit agains the Licensing
Authority by Sportsman's Bar had been taken under advisement by the Court.
Also the decision on the Occupational Tax for Hotel -Restaurant Liquor Licenses
has been appealed; therefore if the Council desired they should authorize him
to continue on the City's behalf.
Councilman Preble made a motion, seconded by Councilman Lopez to authorize the
City Attoreny to continue in both cases on behalf of the City. Yeas: Council-
men Carson, Lopez, Preble, Peterson and Fead. Nays: None.
