The following resolution was presented and read at length: REiSOLUTION 71-6 .OF THE COUNCIL OF THE CITY OF PORT COLLINS APPOINTING MARY ELSIE GREENWALL AND MYRNA JUNE HILL, AS MEMBERS OF THE BOARD OF ELECTIONS AND FIXING THEIR COMPF,NSATiON MIEREAS, Marion A. Knight and Laura A. Straub have submitted their resignation as members of the Board of Elections, and WHEREAS, Section 6 of Article XVI of the Charter of the City of Fort Collins, provides for a Board of Elections consisting of. the City Clerk and two qualified electors, and WHEREAS, the City Clerk recommends that Mary Elsie Greenwall and Myrna June Hill be appointed to the Board of Elections to fill the existing vacancies. The follmw;tng resolution was presented and read at length: RESOLUTION 71-7 Ou THE COUNCIL OF THE CITY OF FORT COLLINS APPROVING AN AGREEMENT TO BE ENTERED INTO WITH WILLIAM H. METIER ....... ___ ... .... .. WHEREAS, it is necessnry that the City. of Fort Collins engage the services of a golf p-o in connection with the golf: courses of: the City of Fort Collins; and THTREAS, an agreement has been negotiated with William H. Metier to act as golf _ pro in connection with such golf courses; and WHEREAS, said agreement has been approved by the City Attorney and the City Manager, and the City Council now desires to approve the same. NOW, 'THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the proposed agreement with William H. Metier engaging his services as golf pro for the City of Fort Collins be and the same hereby is adopted and approved; and BE IT FURTHER RESOLVED that the Mayor and City Clerk be and they hereby are authorized and directed to execute said agreement for and on behalf of the City of Fort Collins. Kruchten Assistant Mayor ATTEST: /s/ John Bartel City Clerk The City Manager stated there were a few changes, in that there would no liquor, just beer, the golf course would be open seven days a week instead of six and would pay 51 for every ball recovered instead of 10$ per usable ball. Ile stated that applying for a beer license would have to go through the usual formalities, that the Club house is designed for beer dispensing, that Mr. Mati.er can apply for this license as a golf pro. He stated that Mr. Mati.er has a concession and gives golf lessons for the usual fee and that he pays City rent and a percentage. After considerable discussion, motion was made by Councilman Troxell, seconded by Councilman Chilton, that this resolution be adopted and -the City Clerk serve as a signator-e in the application for a Fermented Malt Beverage License. The Unit Development Plan for K-Mast Subdivision on South College Avenue, was presented. Mr. Charles Lotz of Nargde.l Corp., of Los Angeles, California, and owner of the property on South College, submitted revised plot plans with the Planning Department and the Building Department. On Reynoldi, Director of Planning, presented a report of nine points that is to be complied with by the K-Mart store, which was presented as follows: TO: Fort Collins City Council FROM: Planning and Zoning Board SUBJECT: K-71. Reynolds stated that signs i•rere discussed on on a infonua-1 bas�i.s. Assistant Mayor Kruchten asked if it rras possible for the Council to approve this, subject to the matter of the sign being brought before the Planning and Zoning Board. Jim Cox was present and asked that the location of the sign be pinned do,:m. Mr. Reynolds stated the sign i:ill be IS feet back of.the property line. Mr. Cox stated this sign shouldl�in relation to the building and of the same material so as to blend in. Mr. Reynolds stated that this will go before the Planning and Zoning Board and the rcduct:ion of the sign will go before the Zoning Board of Appeals. Stan Case, Director of Utilities, stated that evorythi.ng is in agreement frith the Light and Power Department. Pam IVashburn was present and requested a definition of a free standing sign. She was advised that: a free standing sign was not being approved and no commi.ttnients being made to K-Mart concerning this sign. After considerable discussion, motion was made by Councilman Troxell, that this plat be approved, subject to the conditions that o-:ere set forth by Mr. Reynolds and subject to the Council's approval, with a time limit of 6 months. This was seconded by Councilman Chilton. Mr. l,otz stated they planned to he under construct.]on by March 1, 1971. Tile City Manager stated he put the amending Article 15 of the Code of Ordinances relating to Local Improvements on the agenda for discussion to be introduced on first reading on the 18th day of February. Assistant Mayor Kruchten asked trhat the general nature was of thi-1 ordinance. The City Manager stated it is the classification of procedures and the ordering of improvements, stating it is pretty much the same as Colorado Springs ordinance. The Director of Public ]Yorks stated that the Council determines what improvements are needed and H that these improvements need to be made. That the procedure now takes S or 9 months before finally completed, stating the engineering department would prepare the plans, specifications etc, and if the Council approves, o-:ill service notice and set up resolution on same. The Assistant Mayor declared the motion adopted. The preliminary hearing on the application of the Town Pump, 124 North College, for a Fermented Malt Beverage License, was presented. Mr. Magee, the owner, was present and asked if he had to wait 30 days, stating he had his liquor license for 1971 and asked if any of this money would be returned. Thppsold y 0torney advised Mr. Magee it would not that this hearing was to set the boundaries and set the hearing date. Motion was made by Counclmar Troxell, seconded by Councilman Logo:., that the boundaries be 2000 feet in all directions and the hearing date set for February 18, 1971. The Assistant Mayor declared the Council recessed and reconvened as a Liquor Licensing Authority. The application of the Sage Brush Restaurant, 934 Lemay Avenue, for a Liquor License, was presented. The City Clerk stated this application was presented to him, that it will be located north on Lemay where the old roundhouse formerly was. Motion was made by Councilman Lopez, seconded by Councilman Chilton, that the preliminary hearing date be set for February,l.8, 1971. The City Attorney stated the hearing date for the preliminary hearing was required to be at least 30 days from the time the application was presented. Motion was made by Councilman Lopez, seconded by Councilman Chilton, that flue preliminary hearing date be set for February 25, 1971..Roll was called resulting as follows: Ayes: Councilmen Kruchten, Troxell, Lopez and Chilton. Absent: Councilman Carson, excused. Nayes: None, The Mayor declared the motion adopted. The Assistant Mayor declared the Liquor Licensing Authority adjourned to reconvene as a Council. Stan Anderson, owner of a excavation firm, was present requesting to have operation of the Sanitary Land Pill. He stated he had presented his proposal to the County Commissioner and had talked with Mr. Li.quin concerning this. He presented the Council with copies of a letter of intent and stated it was his intentions to draw up something that is fair and right, and would like to discuss the matter with them. The City Manager stated that since we do not have a full Council, would like to study this proposal and bring it up again . Mr. Anderson stated he would like to know as soon as possible because he dial not want to break all his committments, that he had been working in the mountains, but would like to get : out of the cold work. The City Manager stated that the bidder that received the bid on the Club House at the Golf Course was not able to furnish sufficient bond and that he had an assignment and bond for Mr0hrker and had worked it out with the City Attorney. He asked the Council to approve this assignment to Mr. Barker, his bond being $65,721.00. Motion was made by Councilman Troxell, seconded by Councilman Chilton, that this assignment from W. Lockett to Mr. Barker be approved and the City Clerk and City Manager be authorized to execute the agreement. The City Manager _ purchase' 20 1/2 shares of North Poudre Irrigation stock at $1200.00 a share, from Mr. Orville Markham, the total cost being $24,600.00. Assistant Mayor Kruchten stated he thought Mayor Carson would be interested and that this matter be deferred until next week. The City Manager stated they now had copies of tho Housing Cod- Ordinance. stating that Mr. Clyde, the Building Inspector, is reviewing the Housing code and the Council further .consider its exploitation. Assistant Mayor Kruchten stated we need a housing code as we have in Fort Collins considerable private housing and violations of the housing safety by the young people. Councilman Troxell asked about the status of the sign ordinance. Don Reynolds, Planning Director, stated the Planning Department have been meeting with.the committee con- cerning signs and will have some recommendations up coming to the Council. Advanced notice of our arrival was provided lhroug: the classifi& advertising of the local newspapers and the local radio Station, if one ex1stad. Approximately `our hours were spent in each city with the interviews held at. the local State Employment Offices. The purpose of the interview was to entice the applicant, primarily the Mexican -American, to come: to Fort Collins and take our written examination. This was accomplished by explaining the job, fringe benefits, the housing sit- uation, CSU, salary and selling our City. We Of course answered any questions the applicant might pose. Also, special effort was made to _idly explain the .selection process, which is part requires all 'applicants to receive a ..._.._...um score of seventy percent on the written exa`.ination in order to ,proceed to the second phase, the oral review board. During the three day trip, a total of twenty-six people Were interviewed. Of this total, twelve, or forty-six per- cent, were. Mexican -American. Twenty, or seventy-seven percent, oxpressed an interest in.toe police department and twenty-three percent were interested in careers with the fire department. It is imperative to note that every offer: was also .Trade to inform the local Xnxican-Amarican community of the career Opportu niVas available with the City. Trip" did in fact have Ja positive effect on our local Mexican community. .here is no doubt in my ..._nd that the Coverage was complete and effective. the exams were given twice each day in order to allow everyone the orin-.r_, ty to rar`icipate. Police: initial response to the police vacancies was extremely heavy. A total of - one -hundred and thirty-one people submitted applications, with fifty-six, or forty-nine percent, taking the examination. Of this total, thirty-one, or fifty- five percent, attained a score of seventy percent or higher and twenty-five, or forty-five percent, received a score of less than seventy percent. :he written examination scores ranged from a high of ninty-five percent to a low of forty percent. Furthir analysis reveals that seve-teen Mexican -Americans appli.ci and thirteen, or seventy-six percent took the Britten` examination. Of the thirteen, three, or twenty-three percent, received a score of seventy percent or higher. From this field of thirteen, eight, or sixty-one percent, were from the cities visited b;: the recruiting team and five, or thirty-eight percent, were from the Fort Collins area. Finally, of the total number of applicants who took the examination, seventy- seven percent were Anglo ant t'wonty-three percent were Mexican -American. Also, . of tie total number of applicants who received a passing score of seventy percent on the written exam, twenty-eight, or nifty percent, were Anglo and _.tree, or ten percent, Were Yexican.-American. Final selection for the six positions will be made from an eligibility list consisting of the highest eighteen scores. The total score is a composite of the :•:ritten and oral exams. Each exam is given the neigh„ of fifty percent. Also, the successful candidate must satisfactorily pass a back -ground check and a polygraph test. Although final selection has not been ..lade, it does appear that one Mexican -American will be offered a position. Fire: interest in tie fire department was moderate, with fifty applications being filed and twenty-eight, or fifty-six percent, taking the exam. Of this.total, fourteen, or fifty percent, received a score of seventy percent or higher. Fur- ther, three, or eleven percent, were Mexican -American. Of this number, one received a passing score of seventy percent. All of the Yexican-Americans who too-! the test were from the so`J.tlern Colorado cities. From the field of twenty- eight, :Benty-.live, or RjHty-.nine percent were Anglo. Oi this t'wc ty--_. . 3, thirteen, or fifty-two percent, passed the exalt. An eligibility list of fourteen candidates was established to fill the seven vacancies within the Department. From this list, one 0xican-American, Ma_tin Xariu;o of Rocky Ford, ..as offered and has accepted a Firefighter position. He will begin his emplo;men.. on January 25, 1971. Another Mexican- Amorican, Rudolph Vargas of Fort Collins, has been employed as a Fire Dispatcher. Comment: 1 personally believe that the "charge" given to the Administration by fie City Coun.c`_i has been successfully carried out. A concerted effort has been made to ~_tract qualified members of the minority groups into the police a :' fire departments. Mr. De Tullio stated wE had made progress in this recruiting program, that 78%'bf those who were interviewed gook the examination. Councilman Lopez commended him on the fact that they got so many to apply but the fact st:il.l remains they did not pass the screening process. Assistant Mayor Kruchten stated it was his opinion; that progress has been made and more will be made. The City Manager stated that Councilman Lopez requested a report on information concerning the clogs that are running loose, the dog pound, etc. Chief Smith of the Police Department presented a verbal report on the above matter. lie stated he had had to use the Dog 11'arden.on other assignments and therefore he has not -been able to spend much if any time as a Dog Warden, that he has been short: of a jailer and the Dog Barden has been helping with that. lie stated they will be hiring another Dog Barden who will be able to devote his time as such. lie stated they had had someone at the dog pound, but not for some time. Had contacted the Humane Society, that a problem had developed between them and the Dog Warden, that they are at present drawing up a job description for a dog warden examination in accordance 1c.tin the humane Society. He stated they had rote yeti 1476 animal calls 799 dog calls, 226 ca,t calls and 39 miscellaneous, and that 389 dogs had been inlpoUnded. He stated they need some than ges in the ordinance before i:e can go in this agreement with the Humane Society and discuss a Barden, that there is nothing in the ordinance that we can adopt. Fie stated that dogs put in the pound must be destroyed if not claimed, we have no way to vacinate a dog on the scene and C.S.U. has no way to do this, that we have issued only oral i•:arni.ngs but they will be: written in duplicate. He stated he is requesting a ,`-till time Dog Barden and a part time one through the summer months who will work from -even to seven. The problem is how do you .catch dogs, that we do not really have a leash law. lie stated they have a capture gull but it is not: too satisfactOry as if wE use too much, can kill the dog and if not enoagh the clog runs, that it is a najor problem and would like to have some changes in the ordinance. A gentleman in the audience suggested a trap to catch stray dogs without hurting them as they do with cats. Assistant Mayor Kruchten asked if a person wanted a dog hpp in the pound, could he becc,ne an -owner if -.he wished and if the dog was not claimed. Chiof Smith stated that he could. Councilman Chilton staged he had attended a meeting of the Parks and Recreati)n Department: , that the program includes Timnath, Wellington and Waverly, and they need more facilities. The City Manager stated he had approached Poudre R-1 to use their facilities. The Director of Public Works stated that Sewer Plant No. 2 was now 96% BOY Councilman Troxcll suggested that the press elaborate on this report.
