Regular Meeting
A regular meeting of the Council of the City of Fort Collins, Colorado, was held
on Thursday, December 21, 1972, at 7:30 P.M. in the Council Chambers of the City Hall.
Present: Councilmen Carson, Lopez, Preble and Peterson and Fead.
Staff members present: Brunton, Bingman, Reynolds, Cain, DiTullio, March and Lewis.
Absent: Chuck Liquin, Director of Public Works.
Minutes of regular meeting of December 14, 1972 '- Reading dispensed
On motion by Councilman Lopez, seconded by Councilman Preble, the reading of the minutes
of the December 14, 1972 meeting was dispensed. Yeas: Councilmen Carson, Lopez,
-Preble, Peterson and Fead. Nays: None.
Check from Board of Realtors - Received and acknowledged.
Mr. William Raddatz, Treasurer of the Board of Realtors,presented a check to Mayor
Carson in the amount of $350.00 for two lights to be placed at Spring Park.
Ilayor Carson accepted the check on behalf of the City aiid expressed the appreciation of
the Council and the City.
Boundaries set for Club License for Rocky Mountain Post #1781(Liquor License)
Veteran's of Foreign Wars
City Attorney March stated the application was in proper form, referred to the
reports of the Fire Department and Building Inspection Department, stated this was the
former location of the N 4 R Bar and that it was now proper to set the boundaries.
Quarter Master, Max Mc Dowell, representing the applicants, spoke to the problems
pointed out in the department reports and their proposed action to correct the items.
Boundaries set by C ouncil are the triangle of North College Avenue, Jefferson Street
and Mountain Avenue.
Hearing and first reading of Ordinance No. 100, 1972, being East Lincoln
Avenue Annexation - Adopted.
Motion by Councilman Lopez, seconded by Councilman Peterson, to adopt Ordinance
100, 1972. Yeas: Councilmen Carson, Lopez, Preble, Pererson and Fead. Nays: None.

Ordinance No. 104, 1972 - Being an Ordinance Vacating a Portion of the Alley in Block 123, in
the City of Fort Collins - Tabled.
Petitioner for this vacation; United Bank of Fort Collins. The Planning and Zoning Board con-
sidered this item and recommended approval subject to the developer being responsible for any
relocating expense involving any utilities.
Councilmen Lopez spoke to the question of this being a dead-end alley, and was advised by
the Director of Planning, Donald Reynolds, that the petitioners had agreed to allow traffic
to circulate across their parking area, but as no written agreement to the above had been
obtained, City Attorney Dfarch suggested this Ordinance be tabled until this requirement
was met.
Councilman Fead made a motion, seconded by Councilman Preble, to table this metter and
refer it to the Adminstration for correction action. Yeas: Councilmen Carson, Lopez,
Preble, Peterson and Fead. Nays: None.

CONCERNING A PROPOSED ORDINANCEi AMENDING THE ZONING
ORDINANCE OF THE CITY OP FORT COLLINS BY CREATING A NEW
ZONE TO BE KNOWN AS THE T-P, INDUSTRIAL PARK DISTRICT
WHEREAS, the City Planning Department has prepared the creation
of a new zoning district to be known as the I-P, Industrial Park District;
and
WHEREAS, the Planning and Zoning Board has made a study concerning
such proposed zoning district and has held a hearing and made a report
and recommendation thereon, all in accordance with the ordinances of the
City of Fort Collins; and
WHEREAS, the Council of the City desires to hold a hearing on
an ordinance creating such zoning district.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF
FORT COLLINS that January 11, 1973, at 1:30 P.M., or as soon thereafter
as the matter may come on for hearing, in the Council Chambers of the City
Hall of the City of Fort Collins, is hereby set as the time and place for

rt on request from Trash Haulers for Rate Increase
City Manager Robert Brunton gave an oral report on the request of the trash haulers, and
stated the City had a duel responsibility in trying to keel, the rates as low as possible and
yet allow the trash haulers to make a return on their investment.
Mr. Brunton also stated the City had no means of establishing an equitable rate increase, that
any rates established would have to go to the PUC for review and that he felt the PUC should
establish the rate initially. In addition, Mr. Brunton furnished Council with a status sheet
of other cities in Colorado, as well, as reports published in The American City and Public
Management Magazines dealing with the matter.
December 21, 1972
Attorney Maurice Nelson, representing the trash haulers, introduced the members of the
Association present; and stated he felt the trash haulers had been very patient in waiting
for a determination on this matter. Mr. Nelson also inquired what the City's position was
on an increase at the land fill and was advised by Mr. Brunton that no increase would be
imposed until May 1, 1973.
Speaking to the question were Mr. Jim Darnell, Mr. Art Gallegoes and Mr. John. Elley.
Councilman Preble spoke to the question of the Association complaint department.
Following further discussion, the City Manager stated the administration will be pursuing
the points raised but that the study would only include the present system, the request to
increase to $3.50 and the limit to four cans. Mr. Brunton also stated he felt the trash
haulers deserved an answer and he would report back by January 4, 1973.
Plat of Brown Farm First Filing, dedicating common areas - Approved.
This item had been tabled at the request of the City Attorney for clarification of the language
in regard to the dedication. City Attorney March stated this was in order now, as it was
dedicated for public use. Councilman Lopez made a motion, seconded Dy Councilman Peterson to
approve the Plat. Yeas: Councilmen Carson, Lopez, Preble, Peterson and Fead. Nays: None.
Planned Unit Development for the A & W Restaurant - Approved
Don Reynolds, Planning Director, stated the landscape plans have been revised.
Motion by Councilman Preble, seconded by Councilman Fead, that this plat be approved. Yeas:
Councilmen Carson, Lopez, Preble, Peterson and Fead. Nays: None.
Bids for construction of,6-inch Pennsylvania Street Water Main (Water Improvement District
No. 6) - Approved. '
Motion by Councilman Fead, seconded by Councilman Peterson, that Gurwell Construction Company
be awarded the bid in the amount of $1,774.00. Yeas: Councilmen Carson, Lopez, Preble,
Peterson and Fead. Nays: None.
Auditors retained for 1972 Audit
City Manager Brunton spoke to the question of Charter requirements as pertain to the audit,
the date the City closes it's books and his desire to retain an auditor early in the year, add-
ing an auditor must work at the peak time for income tax in order to accomplish the require-
ments of the Charter, thus precipitating a higher cost.
Mr. Brunton stated a good auditor would not only make spot checks, but would analyze books
and make recommendations. Also, the best time table for hiring an auditor would be right
after the audit was received, then the City should proceed to hire an auditor at a price
not to exceed, or, the City could change the Charter.
The recommendation from the City Manager was to retain the firm of Greagor, St. Croix, Ray
and Company for the 1972 Audit.
Councilman Lopez made a motion, seconded by Councilman Preble, to approve the recommendation
of the City Manager. Yeas: Councilmen Carson, Lopez, Preble, Peterson and Fead. Nayes:
None.
Robert Brunton appointed as Alternate to the Larimer Weld Regional Planning Commission
City Manager Robcrt Brunton stated Dr. Fead was the City's representative, but that it
was not always possible for him to attend, therefore, an alternate would be desirable.
Councilman Fead made a motion, seconded by Councilman Preble, to approve the appointment of
an alternate, and that that alternate be the City Manager. Yeas: Councilmen Carson, Lopez,
Preble, Peterson and Fead. Nays: None.

Adoption of Codification of Code of Ordinances - Set for Hearing and First Reading
City Attorney March stated the urgency,of getting;,the codification adopted, as we were
constantly behind. hie also spoke to the question of establishing charges for selling the
Code and the problems of supplementation.
Councilman Preble stated she would like to have the Attorney authorized to draft an ordinance
adopting the Codified Code. Mr. March stated it would be on the next week's agenda.
Inquiry from General Public
Mr. Joe Coria requested information on the status of th'e North Side Park. The City Attorney
advised him the condemnation case had been postponed, but was proceeding.
City Manager Robert Brunton stated it was the Number I priority in park acquisition.
Report of Night Watch Session
Councilman Fead stated four people attended the Wednesday evening session. Items of dis
cussion were trash hauling, ice removal and the section of the dog ordinance pertaining

to noise nuisances.

City Manager Brunton stated a Joint Council and Planning and Zoning Board meeting had been
scheduled for February 3, 1973, from 9:00 A.M. to 9:00 P.M.. Also announced a meeting in
Estes Park on January 24, 1973, with the Four -City Platt River Municipal Association
