At this time Councilwoman Reeves made a motion, seconded by Councilwoman Gray to adjourn the special meeting and continue into the regular meeting at 5:30 P.M. Yeas: Councilmembers Bloom, Bowling, Gray, Reeves, Russell, Suinn and Wilkinson. Nays: None. Mayor Wilkinson then called the regular Council meeting to order. Councilman Bloom inquired of the Assistant City Attorney if Council were committed to take action in a specific manner on September 21, and if so, in what manner. Mrs. Liley responded that if Council held the hearing on September 21, Council would have to decide whether or not the district will be formed, the hearing could be tabled to a later date, and Council could also condition acceptance of the petitions at that later date. Mayor Wilkinson stated he had received a letter from the Chamber of Commerce, which he read into the record. September 7, 1976 ' The Honorable Earl Wilkinson Mayor, City of Ft. Collins Ft. Collins, CO 80522 Dear Mayor Wilkinson, "Continue to support redevelopment of the Central Business District by determining an acceptable solution which will implement program. " This statement is taken from the 1976 Program of Work of the Fort Collins Area Chamber of Commerce. As you know, the Chamber has, since 1963, recognized the importance of the Central Business District to the economic stability of our community. Today, we reaffirm that position. 144 1 1 1 In light of the recent activitiy and comments made regarding the proposed redevelopment plan, the Chamber would like to offer its services as the catalyst to pull together a representative group of Central Business Dis- trict Businesses to arrive at a viable solution to implement the improve- ment of parking facilities and beautification in the core area of Fort Collins. We realize that for the Chamber to be successful, all parties involved must be willing and want to work together. That in the area of compromise, all parties will have to agree there is only one ultimate goal - the redevelop- ment of the Central Business District. Realistically, if a commitment of cooperation and compromise cannot be made, then in all essence it would be difficult for the Chamber to arrive at a final solution. The Chamber is aware the final decision must be made by Council - how- ever, please know that we are willing to assist in anyway possible a redevelopment program. Councilman Bowling made a motion, seconded by Councilman Suinn that on September 21, the Council continue the hearing to October 5, at which time formal petitions will be received; that the progress report regarding conciliation be presented on September 21, and that the Chamber of Commerce recommend three names out of which Council will select one independent moderator; by noon, Wednesday, September 8, 1976. Yeas: Councilmembers Bloom, Bowling, Gray, Reeves, Russell, Suinn and Wilkinson. Nays: None. Councilman Bowling made a motion, seconded by Councilman Suinn that Council reconsider their decision on the Remington Street bypass. Yeas: Councilmembers Bowling,.Reeves, Gray, Russell, Suinn and Wilkinson. Nays: Councilman Bloom. 145 Appeal from Decision of Zoning Board of Appeals on Variance Request for 818 West Oak Street, Denied , Following is a portion of the City Manager's memorandum on this item: "Mr. Kirk E. Jungbluth, the prospective purchaser of the property at 818 West Oak Street has requested an appeal from a decision of the Zoning Board of Appeals. The property is currently a two-family residence owned by a Roger Sneegas and is zoned R-M, Medium Density Residential. The petitioner requests a variance to reduce the minimum lot size square footage requirement from 9,000 to 8,000 square feet. Granting these two* variances will correct the non -conforming dimensions and allows construction of a third living unit on the premises. The Zoning Board of Appeals first considered the matter on July 20th and tabled it on that date in order to allow the City Attorney's office to research the question of whether the grant of the variance could be conditioned on the owners living on the ` premises. The matter was again considered at the Board meeting on August loth at which time the City Attorney's office gave their opinion that this would not be a proper condition to attach " to the variance. On a motion to deny the variance, the Zoning Board members present reached a tie vote, and no other action was taken. Therefore, the variance requested in effect died. ' At the August 17, 1976, meeting the City Council established a hearing on this appeal for Tuesday, September 7, 1976, at 5:30 p.m." *Secretary's Note: There was also a variance request to reduce the minimum lot width from 75' to 40'. Assistant City Attorney Liley gave an oral summary of the appeal. y" The petitioner was not present at the hearing. Mr. Bill Henley, 822 West Oak, adjacent_ property owner_, spoke inopposition to the variance. Mr. Howard Holtzinger presented_ sketches of a private sewer system to which this proposed lot would be hooked and requested- this hook up_not be allowed as a triplex._ Councilwoman Gray made a motion, seconded by Councilman Bowling to deny the variance. Final Plat of Southmoor Village Subdivision, 6th Filing Approved Following is a portion of the City Manager's memorandum on this item: ' "Southmoor Village Subdivision, 6th Filing, consists of 31 lots on 9.6 acres located south of Swallow Road between Lemay Avenue 146 and Camelot Drive northeast of Boltz Junior High School. The property is zoned R-P, Planned Residential District. At its June 7, 1976, meeting the Planning and Zoning Board recommended for approval with some revisions recommended by staff. All the revisions have been made and conditions complied with." Councilwoman Reeves made a motion, seconded by Councilwoman Gray to approve the final plat of the Southmoor Village Subdivision, 6th Filing. Yeas: Councilmembers Bloom, Bowling, Gray, Reeves, Russell, Suinn and Wilkinson. Nays: None. Final Plat of Southmoor Village Subdivision, 7th Filing, Approved Following is the City Manager's memorandum on this item: "The Southmoor Village Subdivision, 7th Filing, consists of 26 single-family lots on 6.49 acres zoned R-P. This land was originally zoned for planned residential district. The P.U.D. would have allowed 72 units or a density of 11 units per acre. The developer would like to replat this tract into 16 single- w family lots and 10 lots for duplexes. This would reduce the number of units to 36 or a density of 5.5 units per acre. Before work can be started on this project, the petitioner and ti developer will have to come in for rezoning to R-L for the single-family lots and R-L-M for the duplexes. The Planning and Zoning Board felt, however, that it was better to approve the subdivision plat and then provide the rezoning. At its July 9, 1976, meeting the Board recommended approval of this plat." Councilman Bowling made a motion, seconded by Councilman Russell to approve the final.plat of Southmoor Village, 7th Filing. Yeas: Councilmembers Bloom, Bowling, Gray, Reeves, Russell, Suinn and Wilkinson. Nays: None. Final Plat of Silverwond Vil.l.aoa Silhriivi,cion Second Filing Approved Following is a portion of the City Manager's memorandum on this item: "The Fort Collins City Council considered the final plat of the Silverwood (E1 Dorado Springs) Subdivision, Second Filing at its August 3rd, 1976 meeting. This subdivision is located on the south side of East Drake Road between Lemay Avenue and Timber Lane Road. This site was formerly designated as a church site; however, the ' size of the site is inadequate. Therefore, the developer requested 147 that this acreage be subdivided into 10 lots on 2.7 acres. This is an overall density of 3.7 lots to the acre. At the August 3rd meeting the Fort Collins City Council tabled this item until the developer's requested it. The developer is now requesting this item be placed on the agenda. Traffic Engineer, Joe Rice has made the conclusion that he cannot see any traffic hazard or probelm of safety for vehicles entering the arterial street at this location. There would be relatively few cars since there are only 10 units in the subdivision. The developer does not want to wait until some- thing is done with the Vance property to the west before developing this property. It does not appear that any of the roads will go through to connect up with Brookwood Drive. Also it would be a matter of the vehicles from 10 units entering onto Drake or onto Lemay. From a traffic standpoint, the Drake Avenue side is receiving and will continue to receive less traffic than Lemay Avenue. The Planning and Zoning Board recommended for approval at its May 10th meeting." Councilman Bowling made a motion, seconded by Councilwoman Gray to remove this item from the table for consideration. Yeas: Councilmembers Bloom, Bowling, Gray, Reeves, Suinn and Wilkinson. Nays: None. (Councilman Russell out of room.) Mrs. Helen Hall, 421 South Loomis presented a petition requesting immediate Council action to spray trees in the 400 block of South Loomis with a repellant to rid the area of starlings. The Administration will respond to Mrs. Hall's request. b. Proclamation for Sister City International Day. Report from City Council on Committees a. Councilman Russell reported he had attended the last Platte River Power Authority meeting as the Council appointed alternate. b. Councilman Bloom stated there was a report entitled "Environment the Price of Purity" which he encouraged Councilmembers to read. Review of Seven -Year Capital Improvement Program ' Mayor Wilkinson stated he would limit discussion time on this item_. to two hours. Those making presentation were as follows: a. Fred Sill and Bob Lee spoke for the Chamber of Commerce. The Chamber recommended that the entire program as it was voted by the voters in 1973 be implemented, even though the sales tax has to be extended,.. b. Ray Dixon, Cultural Resources Board, made his remarks pertingnt to a report on the Seven Year Capital Program provided by the DT Steering Committee and a memorandum written by the Cultural Resources Director Ellen Thexton. He then called upon John Curfman of the Cultural Resources Board who presented slides of possible uses for the Lincoln Community Center. C. Nick Leonard, Chairman of the DT2 Steering Committee reported on a special committee who had recommended that the entire capital improvements, as approved by the voters in 1973 be completed,_with the understanding that the sales tax be extended past 1980. The r sub -committee had also ecomen mded that the footing -and foundation be set for the auditorium this fall. 1 149 d. Howard Alden, President of the Poudre Valley Greenbelt Association, read from a prepared statement supporting the total program with emphasis on purchasing the Pine Ridge property. e. Jim Bailey, north side _of Fort Collins, spoke to the citizen questionnaire which gives priority_to open space. f. Molly Nortier, League of Women Voters, read from a prepared statement supporting the acquisition of open space. g. Herb Brauer, 421 South Howes, spoke in support of the acquisition of open space, adding that Council should remove the sales tax on food and place the extension of the sales tax on the April, 1977 ballot. h. Robert Aukerman, CSU, spoke to some of the items presented as uses for the auditorium art center complex which might be better met by other professionals such as recreation professionals. i. Preston Davis, 1004 Commanche Drive ;poke in support of the -total capital improvement program. j. Will Swartz, of the Fort Collins Symphony, spoke in support .-of building this auditorium art complex. At the conclusion of public participation, Mayor Wilkinson stated he felt the City Hall was in his estimation, the first priority in the program. He then called on City Manager Brunton to give a report prepared at his request on a possibility of going ahead with short term borrowing to finance various seven year capital projects. Following is the report: The following analysis has been prepared in response to your question this morning concerning the figancing of various Seven - Year Capital projects through short-term borrowing mechanisms. We have developed this analysis. based on the following assumptions which you developed: 1. Start construction immediately of a City Hall annex at a cost not to exceed $1,866,000. 2. Start construction of an Auditorium/Art Complex in July, 1977, at a cost not to exceed $2,200,000. 3. Plan on a City commitment of no more than $250,000 to the Downtown Redevelopment Project_. 4. Spend $1,109,000 from 1977 to 1980 on the Open Space Program. 150 1 1 5. See if a short-term financing arrangement can be developed to finance the above project schedule with the intent being that short-term interest costs would be cost efficient as opposed to higher project costs in future years. In order to implement the above schedule, the City would need to borrow on a short-term basis $575,000 during mid-1977. Repayment of the principle and interest on the loan would take place during 1978 and.1979 from the Seven -Year Sales Tax Program with interest costs for the loan totaling $43,125. This is an annual effective rate of 5% which appears to be the.most realistic estimate available to us at this time. Councilman Russell made a motion, seconded by Councilman Bowling that there be a 2.2 million dollar community center as the first priority. Yeas: Councilmembers Bowling, Gray and Russell. Nays: Councilmembers Bloom, Reeves, Suinn and Wilkinson. Councilwoman Reeves made a motion, seconded by Councilman Suinn that the Lincoln Community Center be first priority at 2 million dollars. Yeas: Councilmembers Bowling, Reeves and Suinn. Nays: Councilmembers Bloom, Gray, Russell and Wilkinson. Councilwoman Gray made a motion, seconded by Councilman Russell that the next building project be the auditorium art complex. Following further discussion, Mayor Wilkinson called a five minute recess. Upon reconvening of the meeting, the above motion was withdrawn. Councilman Russell made a motion, seconded by Councilman Bowling that the Council start construction of an auditorium art complex at a cost not to exceed 2.2 million dollars, that the Council start drafting immediately the City Hall Annex, at a cost not to exceed 1.866 million dollars and that Council spend 2.3 million ' dollars on open space and that interim financing be secured on the balance not covered by our capital fund program. Yeas: Councilmembers Bowling, Gray, Russell and Wilkinson. Nays: Councilmembers Bloom, Reeves and Suinn. - Councilman Bowling made a motion, seconded by Councilman Russell that the City Council place the question of the extension of the sales tax on the ballot in April. Yeas: Councilmembers Bowling Gray, Reeves, Russell, Suinn and Wilkinson. Nays: Councilman Bloom. Councilman Suinn stated he would like to go on record as also wishing to place the sales tax on food on the ballot. Ordinance Adopted on Second Reading Assessing Sidewalk Improvement District No. 5 Following is the City Manager's memorandum on this item: "At its August 17, 1976, meeting the Fort Collins City Council adopted Ordinance No. 63 on first reading. This ordinance assesses the cost of the Sidewalk Improvement District No. 5 located on Shields Street between Prospect'and Drake Road. There was one objection filed at the Council meeting which was subsequently denied." ' Councilman Bowling made a motion, seconded by Councilwoman Gray to adopt Ordinance No. 63, 1976 on second reading. Nays: None. 152 ORDINANCE NO. 63, 1976 BEING AN ORDINANCE ASSESSING THE COST OF IMPROVE- MENTS IN SIDEWALK IMPROVEMENT DISTRICT NO. 5 AND PROVIDING FOR THE PAYMENT AND COLLECTION THEREOF WHEREAS, heretofore by appropriate ordinances and resolutions duly adopted by the Council of the City of Fort Collins, there was established Sidewalk Improvement District No. 5 for the purpose of installing sidewalks in the right- of-way adjoining the property to the district, all pursuant to Chapter 16 of the Code of the City of Fort Collins; and WHEREAS, pursuant to said ordinances and resolutions, said improvements have been installed and accepted by the City of Fort Collins, Colorado; and WHEREAS, upon accepting said improvements, the City ^ Council adopted the report of the City Engineer respecting the cost of such improvements and the schedule of assessments prepared by the City Engineer and ordered notice to be published as provided in Chapter 16 of the Code of the City of Fort Collins, which said notice was duly published as therein provided; and _ WHEREAS, August 17, 1976, is the date set for the hearing of complaints and objections and the determinations of the same and for acting upon an ordinance assessing the cost of such improvements; and WHEREAS, all complaints and objections in writing filed by property owners within the District have been considered by the City Council. Before the Fort Collins - Loveland Water District will make any study or any commitments on the cost of water, we are required to petition for annexation into the district. Repair of Erosion Damage at Water Plant No. 1 Following is the City Manager's memorandum on this item: "We have been working with the Department of Army Corps of Engineers for the last several weeks in connection with the damage done to our stream bank erosion during the high water period the latter part of July. The part of the work under C-14 Erosion Contract is paid for 100 percent by the Federal government through the Corps of Engineers. The City's obligation is to guarantee up to $500 if needed annually for operation and maintenance. Initially, it was estimated that this repair work would cost $25,000. The latest estimate is $55,000. The Corps of Engineers would like to start work on this project as soon as possible. It is necessary that the City Council adopt a Resolution authorizing the City Manager to execute a contract for this work on behalf of the City. This Resolution is attached. It will be also necessary for the City Council to pass a Resolution granting the Corps of Engineers right of entry onto the City property to perform this work. This Resolution is to be on a form submitted by the Corps of Engineers, which we do not yet have. Nays: None. 185 Ordinance Adopted on First Reading Prohibiting Loitering in the Center Parking Area of the Downtown Business District Following is the City Manager's memorandum on this item: "At its August 31, 1976, work session, the City Council discussed the loitering problem in the center parking areas of the downtown business district. City Council members had received complaints and had seen various offenses and problems including the use of obscene language and pushing people out in the .lane of traffic. At the present time we are informed that we do not have an ordinance allowing our Police Department to enforce against this public nuisance. The center parking area is defined as the area in the center of College Avenue reserved for parking of vehicles from Mountain and College extending southward to the intersection of Maple Street. The proposed ordinance stipulates that no one shall park a vehicle in center parking, emerge from such parked vehicle, and remain other than momentarily in the center parking - area.
