COUNCIL OF THE CITY OF FORT COLLINS, COLORADO

Adjourned Meeting - 3:00 P.M.
An adjourned meeting of the Council of the City of Fort
Collins was held on Tuesday, February 27, 1979, at 3:00
p.m. in the Council Chambers in the City of Fort Collins
City Hall. Roll call was answered by the following Coun-
cilmembers: Bloom, Bowling, Gray, Russell, St. Croix,
and Wilkinson.
Absent: Mayor Suinn.
Staff Members Present: Arnold, Lanspery, Ruggiero, Liley
and Lewis.
Ordinance Denied Amending Section
84-2 of the Code Relating to the Possession,
Use or Distribution of No More
Than One Ounce of Marijuana
and Setting a Penalty Therefor
Following is the City Manager's memorandum on this item:
"On Thursday, February 15, the City Clerk received an initia-
ted measure relating to the decriminalization of marijuana.
The petitions for this measure have been officially certi-
fied by the City Clerk. There are sufficient signatures to
require Council to:
1. Adopt the Ordinance;
2. Place it on the April 3, 1979, ballot;
3. Call a special election to decide the issue.
Technically, the oetition was filed too late to compel the
Council to place the issue on the April 3rd ballot. However,
there is enough time remaining before the April election for
the Council to voluntarily put the issue on the April 3rd
ballot and avoid the need for a special election.
Council considered the proposed ordinance at a work session
on October 24, 1978. By a 5 to 1 poll vote, it was decided
not to bring the matter before Council as a .formal ordinance,
proposal. Based upon this action, it is recommended that
(� Council not adopt the ordinance and submit it to the elector-
ate on the April 3rd ballot.

Also attached is a memo from the City Attorney addressing
the substance of the initiative."
The following, persons spoke to the proposed ordinance:

Councilman Russell made a motion, seconded by Councilman
Bloom to deny Ordinance No. 25, 1979. Yeas: Councilmem-
bers Bloom, Bowling, Gray, Russell and Wilkinson. Nays:
Councilman St. Croix.
THE MOTION CARRIED.
Ordinance Adopted Placing People's
Initiative No. 2 on the Ballot for the April 3rd
General Election
Following is the City Manager's memorandum on this item:
"As previously indicated by City Clerk, Verna Lewis, a suf-
ficient number of signatures were certified to qualify the
marijuana initiative to be placed on the ballot for the gen-
eral election to be held on April 3rd. As you know, on
properly certified initiated measures, Council must either
pass the proposed ordinance without changes or place it on
the ballot for consideration by the qualified electors of
the City. The attached Ordinance submits the proposed Or-
dinance concerning marijuana to the voters. In the event
that Council chooses not to pass the proposed marijuana or-
dinance as set forth on the initiative petition, then Coun-
cil should pass the attached ordinance placing the measure
on the ballot.
Staff recommends approval."
City Attorney stated this ordinance would place the proposed
ordinance concerning marijuana on the April ballot. The Or-
dinance provides a maximum fine of $5.00. Home Rule Cities
can adopt ordinances of this kind.
Councilwoman Gray made a motion, seconded by Councilman Rus-
sell, to adopt Ordinance No. 29, 1979 on first reading. Yeas:
Councilmembers Bloom, Bowling, Gray, Russell, St. Croix and
Wilkinson. flays: None.

' Board and Commission
Appointments Reviewed
Following is the City Manager's memorandum on this item:
"Mr. Robert Zimdahl, Chairman of the Human Relations Commis-
sion, wishes to review the record of appointments made to
City Boards and Commissions since last May."
Mr. Zimdahl reported on the number of Spanish sur-named and
women appointed to Boards and Commissions.
Councilwoman Gray inquired if changes had been made in the
application forms for boards and commissions and if not
she urged the forms be changes. City Council expressed their
appreciation to Mr. Zimdahl for his report.
Other Business
(a). City Manager Arnold called Council's attention to a
letter from Recycle Something, requesting Council
endorsement of a printed brochure that Recycle Some-
thing will use for solicitation of private and cor-
porate contribution.
The endorsement would read:
"The Fort Collins City Council supports the efforts of
Recycle Something and urges your support also."
Councilwoman Gray made a motion, seconded by Council-
man Wilkinson, to approve the statement. Yeas: Coun-
cilmembers Bowling, Gray, Russell, St. Croix and Wil-
kinson. Nays: Councilman Bloom.
THE MOTION CARRIED.
(b). City Manager Arnold then referred to a memorandum from
City Clerk, Verna Lewis, and Assistant City Manager,
Paul Lanspery, regarding the 1979 Legislative update.
City Manager Arnold stated there is no action required
at this time but urged Council to contact Sentor Ander-
son and Woodard on the Annexation Bill.
(c). Councilman Russell stated he wished to resign from the
Platte River Power Authority Board in order that another
' Councilmember be appointed to serve on this Board.

Councilman Bowling made a motion, seconded by Coun-
cilwoman Gray to appoint Councilman Wilkinson to
serve as the City's representative to the Platte
River Board. Yeas: Councilmembers Bloom, Bowling,
Gray, Russell, St. Croix and Wilkinson. Nays: None.
THE MOTION CARRIED.
A confirming Resolution will be brought back to the
Council on *larch 13, 1979.
Adjournment
Vice Mayor St. Croix adjourned the meeting to March 13, 1979
at 5:30 p.m.
The meeting was adjourned at 3:30 p.m.
