COUNCIL OF THE CITY OF FORT COLLINS, COLORADO

January 15, 1980 - 10:30 a.m.
An adjourned meeting of the Council of the City of Fort Collins was held
on Tuesday, January 15, 1980, at 10:30 a.m. in the Council Chambers in the
City of Fort Collins City Hall. Roll Call was answered by the following,
Councilmembers: Bowling, Gray, Kross, Reeves, St. Croix, Wilkinson and
Wi 1 rnarth.
Absent: None.
Staff Members Present: Arnold, Lanspery, Lewis, Liley, Deagle, O'Neill,
R. Smith, Nazarenus.
Resolution Tabled Approving a
Jail Agreement with Larimer County
Following is the City Manager's memorandum on this item.
At the January 8th meeting, Countil tabled this resolution to this
date.
The purpose of the tabling was to allow the legal staff time to
review the agreement to change the term of the agreement from
four years to three years; to incorporate a definition of "low i
risk" prisoner; to define the term "City prisoner"; and to deter-
mine who bears the cost. Council also requested a specific written
plan with guarantees on the handling of juveniles.
Negotiations with Larimer County on items of concern are continuing.
A revised agreement will be sent to Council under separate cover

City Attorney, Lucia Liley, reported the City Legal Staff had met with the
County Legal Staff to attempt to resolve issues of use of the jail,
definition of "City Prisoners", and costs associated with those issues.
Discussions are still ongoing and the Legal Staff would like some additional
time to put the agreement into final form and bring it back to the Council.
IF: Sheriff, Jim Black, addressed Council's concern regarding the separation of
juveniles and adults.

Ms. Linda Brubaker of the League of Women Voters urged the City and County to
work together to provide adequate jail facilities and strict interpretation
of the Colorado Children's Code until a new jail facility is built.
Councilman Kross made a motion, seconded by Councilman Wilkinson, to duthorize
the City Attorney to negotiate the agreement and bring back the agreement for
Council review.
YEAS: Councilmembers Bowling, Gray, Kross, Reeves, St. Croix, Wilkinson and
Wilmarth.
NAYS: None.
THE MOTION CARRIED.
Executive Session Authorized
Councilman Wilkinson made a motion, seconded by Councilwoman Gray, to adjourn
into executive session for the purpose of discussing legal matters concerning
the airport.
YEAS: Councilmembers Bowling, Gray, Kross, Reeves, St. Croix, Wilkinson
NAYS: Councilman Wilmarth.
THE MOTION CARRIED.
Upon reconvening the adjourned meeting; Aayor Bowling made the following
statement:
"The Council has met regarding the update on the problem of the Fort Collins/
Loveland Airport and all we have done is to receive a legal update of the
problems that exist"
Councilman St. Croix made a motion, seconded by Councilman Wilkinson, to
authorize the legal staff to negotiate with the legal staff in Loveland
to prepare answers for the Sheriff' s sale on January 22, 1980.
YEAS: Councilmembers Bo,vlin�, Gray, Kross, Reeves, St. Croix, Wilkinson and
UiImarth.
NAYS: None.
THE MOTION CARRIED.
Other Business
a. City Manager, John Arnold, requested Council establish a date for a
Council retreat.

After conferring, Council set February 12, 1930, as the date of the retreat.
b. City Attorney then discussed a request from ASCSU and CALM for setting
ahead the date of the Special Election. She then stated that there is
no question of the legality of the February 26, 1980, date.
City Clerk, Verna Lewis, informed Council of the added expense if the date
was changed.
Mayor Bowling inquired if Councilmembers wished to consider changing the
date of the election. No one responded and Mayor Bowling declared the
February 26, 1980, Special Election date would remain as established.
Adjourment
The Meetinq was adjourned to 5:30 p.m. on January 16, 1980.
The meeting adjourned at 11:20 a.m.
