HomeMy WebLinkAboutMINUTES-12/09/1980-AdjournedDecember 9, 1980 COUNCIL OF THE CITY OF FORT COLLINS, COLORADO Council -Manager Form of Government Adjourned Meeting - 10:00 a.m. An adjourned meeting'of the Council of the City of Fort.Collins was held on Tuesday, December 9, 1980, at 10:00 a.m. in the Council Chambers in the City of Fort Collins .City Hall. Roll call was answered by the following Councilmembers: Bowling, Gray, Reeves, and St. Croix. Absent: Councilmembers Kross, Wilkinson, and Wilmarth Staff Members Present: Arnold, Liley, Krajicek, and Lanspery. Report from City Attorney on Pending Legal Matters City Attorney Liley explained that she had initially intended to ask for an Executive Session to update Council on the City Hall litigation but that the preliminary report from Clifton, Gunderson, and Company, whom the City has hired to doan independent audit, did not get in on time for the special counsel to meet with the other attorneys and prepare a report for Council. That update will now be scheduled for December 16th. Choice Care City Attorney Liley briefed Council on the Choice Care situation. She reported that the receivership would probably terminate in May and that 50-60% of the outstanding bills will be paid. She asked Council to decide whether the City should intervene in the Hewlett-Packard lawsuit. She noted that the City of Loveland had filed their motion to intervene .and that Judge Dressel had granted their motion but had limited it to the defendants named in the H-P suit. She again requested three things: 1. that staff be allowed to prepare claims on .behalf of all City employees involved and submit them to the receiver before Decem- ber 31. ' 440 December 9, 1980 2. that we take an assignment from all City employees so that we are able to assert their claim in the H-P lawsuit. 3. that we file a motion to intervene in the H-P suit before the end of the year. She further noted that the total of the dollar amount billed to City employees by doctors and Poudre Valley Hospital is approximately $10,000. Councilwoman Reeves made a motion, seconded by Councilman St. Croix, to direct the City Attorney to take the 3 steps as she had outlined. Yeas: Councilmembers Bowling, Gray, Reeves, and St. Croix. Nays: None. THE MOTION CARRIED. Trio ity (Woodwest) Lawsuit City Attorney Liley announced that the judge had ruled in the City's favor ' on every count but that the attorneys for the plaintiffs had filed a motion for a new trial on the basis that Judge Dressel had been a member of the Planning and Zoning Board at the time some of the phases of the Woodwest subdivision had been approved. They have asked that he disqualify himself and set the matter for a new trial. Census City Attorney Liley requested direction on whether to pursue the matter further. She noted that the Census Bureau had refused to open their. records and to recount. She pointed out that two options were available: 1. to continue the administrative appeal to Washington. 2. a litigation option. Council consensus was to pursue all avenues and to work with the CML on the possibility of a joint effort to include all Colorado cities that are considering separate suits. 441 ' 1 December 9, 1980 Adjournment There being no further business to come before the Council, the meeting adjourned at 10:15 a.m. ATTEST: 442
