COUNCIL OF THE CITY OF FORT COLLINS, COLORADO

Adjourned Meeting - 1:00 p.m.
An adjourned meeting of the Council of the City of Fort Collins was held on
Tuesday, June 10, 1980, at 1:00 p.m. in the Council Chambers in the City of
Fort Collins City Hall. Roll call was answered by the following Council -
members: Bowling, Gray, Kross, Reeves, St. Croix, and Wilkinson.
Absent: Councilman Wilmarth.
Staff Members Present: Liley, Lewis, Lanspery, and Mabry.
Resolution Adopted Approving Application
for a Preliminary Loan from the Department of
Housing and Urban Development
Following is the City Manager's memorandum on this item:
"This Resolution was tabled to this date at the June 3rd meeting and autho-
rizes the filing of a loan application for $11,000 to be advanced by H.U.D.
for the preliminary planning of approximately 22 units of housing for
elderly and handicapped individuals."
Assistant City Manager Lanspery stated that Council was provided with
additional information on this item. He also stated that Ray Hale from the
Housing Authority was present to address any questions that might arise.
Mr. Hale stated that the budget request resulted from a change in the
manner in which the project was being done. Mr. Hale also stated that the
statistics show that there are 265 elderly people waiting for housing at
this time, and the proposed 22 units would certainly not take care of the
need.
Councilman St. Croix stated he had this item pulled off the Consent Calen-
dar because he didn't think it was appropriate for Council to make an
official finding with no back up material. He also questioned the statis-
tic of 265 people.
Mr. Hale replied that he was given this figure from the DMA Plaza and
Oakbrook Apartments and he had not confirmed how they arrived at that
figure.

Councilman Kross_made a motion, seconded by Councilwoman Reeves to adopt
the Resolution. Yeas: Councilmembers Bowling, Gray, Kross, Reeves, St.
Croix, and Wilkinson. Nays: None.
THE MOTION CARRIED.
Councilman Wilkinson asked about the options the Housing Authority has on
property.
Mr. Hale replied that there are 12 outstanding options among the three
active projects. The average age of these options is three months and
the oldest is five months. There have been approximately 49 options, and
20 have been dropped for various reasons.
Mr. Hale then suggested two alternatives to the Council. One would be
to get a local appraiser approved by HUD whose appraisals would be binding
on HUD. The second would be to develop a disclosure statement to formalize
procedures.
Councilman Wilkinson suggested the Housing Authority might provide addi-
tional information on negotiations for the 12 options. He supported the
Housing Authority's efforts to get an appraiser in Fort Collins approved by
HUD.
Mr. Hale suggested that maybe the Council and the Housing Authority could
take another tour to see the units that have been completed.
Other Business
1. Assistant City Manager Lanspery briefly reported on a meeting held
with John Dennis of Columbine regarding complaints that have been
received regarding Cable Television. He.stated that Marlene Balok
will now be handling all such complaints. Councilman Bowling recom-
mended that a letter be submitted to Dolph Simons of Columbine, making
him aware of the local problem.
2. Mayor Gray commented on the Boards and Commissions interviews that
were to be held. She stated that Council's recommendations should be
turned in by the end of the month including a second and third choice.
3. Assistant City Manager Lanspery reported that the Downtown Parking
program will begin on June 23, 1980 and distributed copies of the
parking brochure and poster.

Mayor Gray reported that she will be writing a letter to the Attorney
General regarding the PUC hearings on Swallow Road. She felt the
hearings were handled in a biased, intimidating, and harassing manner
and would state that in the letter. Her letter would also state that
the City is not trying to influence the decision on the case, but is
simply protesting how we were treated by the Attorney.
City Attorney Liley stated that there would be 25 days to file a brief
and then a 30 to 60 day period for the hearing officer to examine the
briefs and evidence and then make a ruling. There would then be an
additional three to six months before a hearing and decision from the
Commission. It will then be six more months before the City could get
to District Court if the Council decides to appeal the PUC ruling.
5. City Attorney Liley distributed copies of a draft agreement the City
has sent to the District Boards relating
to a proposed merger between
the Fort Collins -Loveland Water
District, the South Fort Collins
Sanitation District, and the City.
This agreement basically provides
that the Districts and City would
consolidate, the City would assume
all the District assets as well
as obligations, and that after a
five-year period, the District would
file a dissolution under the
applicable State statutes. During
would be allowed representation on
that five-year period, the District
the City's Water Board.
A Work Session will be scheduled
in July to fully discuss all issues
regarding the Districts.

Mayor Gray adjourned the meeting to the Work Session. The meeting adjourned at
1:45 p.m.
