Special Meeting - 4:30 p.m.
A special meeting of the Council of the City of Fort Collins 'was held on
Tuesday, June 9, 1987, at 4:30 p.m. in the Council Chambers in the City of;
Fort Collins City Hall. Roll call was answered by the, folIow'ing
Councilmembers: Horak, Kirkpatrick, Mabry, Maxey, Stoner, and Winokur.
Absent: Mayor Estrada
Staff Members Present: Burkett, Huisjen, Krajicek
Executive Session Authorized
Councilmember Kirkpatrick made a motion, seconded by Councilmember Mabry,
to adjourn into Executive Session for the purpose of discussing litigation
relating to the Transportation Utility Fee.
Councilmember Horak questioned the need for the Executive Session.
City Attorney Huisjen noted the Charter permits the use of Executive
Sessions to consider legal matters. The purpose of this Executive Session
is to discuss strategies and to obtain legal opinions in an adversarial
situation. He spoke of the District Court ruling relating to the
Transportation Utility Fee and noted he proposed discussing matters
concerning a possible appeal of the decision and also the implications of
the ruling. He stated the relationship between client and attorney was
protected by confidentiality and suggested the discussions be confidential
to facilitate open discussion. He recommended proceeding with the
Executive Session.
The vote on Councilmember Kirkpatrick's motion to adjourn into Executive
Session was as follows: Yeas: Councilmembers Kirkpatrick, Mabry, Maxey,
Stoner, and Winokur. Nays: Councilmember Horak.
THE MOTION CARRIED.
Adjournment
At the conclusion of the Executive Session, Councilmember Mabry made a
motion, seconded by Councilmember 'Maxey, to adjourn the meeting. Yeas:
Councilmembers Horak, Kirkpatrick, Mabry, Maxey, Stoner, and Winokur.
