Adjourned Meeting - 6:30 p.m.
An adjourned meeting of the Council of the City of Fort Collins was held on Tuesday, February
28, 1995, at 6:30 p.m. in the Council Chambers of the City of Fort Collins City Hall. Roll Call
was answered by the following Councilmembers: Azari, Janett, Kneeland, Smith and Wanner.
Councilmembers Absent: Apt and McCloskey.
Staff Members Present: Jones, Krajicek, Roy.
Resolution 95-28 Accepting the Advisory Opinion
and Recommendation No. 95-1 of the
Ethics Review Board, Adopted
The following is staffs memo:
"Executive Summary
Section 2-569(e) of the City Code provides that all opinions and recommendations of the
Council Ethics Review Board be submitted to the full Council for review and approval. The
Ethics Review Board met on February 27, 1995, to render an opinion on a question presented
by Councihnember Wanner. The Board's opinion is being presented to the Council for its
review and approval.
BACKGROUND:
Section 2-569(e) of the City Code provides that all advisory opinions and recommendations of
the Ethics Review Board be reviewed by the City Council to determine whether the opinion and
recommendation should be adopted.
On February 27, 1995, the Ethics Review Board met to consider an inquiry from
Councihnember Chuck Wanner. The question was whether Councihnember Wanner's telephone
conversations with parties -in -interest who filed an appeal of a decision of the Platiung'and'
Zoning Board created a conflict of interest which would prevent hin front participating in.,
hearing that appeal. In the Board's opinion, Councihnember Wanner's contacts vtiffh the
appellants did not create a conflict of interest. In rendering its opinion, the board applied
certain guidelines it has previously established to help Councilmembers recognize when a
social, business or political association is sufficiently "close" to create a conflict of interest.

Pursuant to the provisions of the code, that opinion and recommendation has been forwarded to the
Council for its review and consideration. Council should consider whether it agrees with the
opinion and recommendation of the Ethics Review Board. If so, passage of the Resolution would
formally adopt that opinion and recommendation. Alternatively, the Council could decide to modify
the opinion in some respect or forward the matter back to the Ethics Review Board with certain
direction."
Councilmember Wanner withdrew from discussion and vote on this item.
Councilmember Kneeland made a motion, seconded by Councilmember Smith, to adopt Resolution
95-28. The vote was as follows: Councilmembers Azari, Janett, Kneeland and Smith. Nays: None.
(Councilmember Wanner withdrawn).
THE MOTION CARRIED.
Mayor Azari stated the Ethics Review Board found that Councilmember Wanner had no conflict of
interest. The Resolution speaks to his participation in an appeal which is scheduled on the March
7 regular meeting agenda. It was timely to deal with this Ethics Review Board opinion at this time
to determine whether Councilmember Wanner would be able to participate in the March 7 appeal
hearing.
