Adjourned Meeting - 6:30 p.m.
An adjourned meeting of the Council of the City of Fort Collins was held on Tuesday, September
24, 1996, at 6:30 p.m. in the Council Chambers of the City of Fort Collins City Hall. Roll Call was
answered by the following Councilmembers: Apt, Azari, Janett, Kneeland, McCluskey, Smith and
Wanner. Nays: None.
Staff Members Present: Fischbach, Roy, Krajicek.
Resolution 96-111
Recommending Certain Amendments to the State Urban
and Rural Enterprise Zone Act of 1986 as Amended in 1996 Adopted.
The following is staff's memorandum on this item.
"Executive Summary
During the September 17, 1996 City Council discussion of the proposed expansion oJ' the Fort
Collins section of the Larimer County Enterprise Zone, Council Member Wanner requested that
Council fonvard a strong message to the soon -to -be -established Economic Development
Commission concerning possible limitations on the use of the Contribution Tax Credit. The
resolution that follows requests that the Commission consider, and bring fonvard to the state
legislature the following revisions to the State Urban and Rural Enterprise Zone Act:
require the Economic Development Commission to implement neiv procedures and reporting
requirements to determine the impact that the Enterprise Zone Program is making in
providing employment and training opportunities and wage enhancement for low-income
residents within each designated ,one, as well as in assisting such residents in moving from
welfare to self-sufficient employment.
2. eliminate State income tax credits for contributions to Enterprise Zone projects that are
undertaken by private sector entities that do not directly preserve or create jobs, provide job
training or make major capital investments; examples of such entities would include, without
limitation, economic development corporations, chambers of commerce, and other
promotional organizations.

3. direct local Enterprise Zone Administrators to present the aforementioned data to the local
jurisdictions within which the Enterprise Zone is contained on a semi-annual basis. "
Councilmember Janett made a motion, seconded by Councilmember Wanner, to adopt Resolution
96-111.
Councilmember Wanner gave a brief presentation on the item.
Councilmember McCluskey stated the proposed Resolution is consistent with what the State has
approved and spoke in support of non-profit and charitable organizations receiving funding from the
zone.
Assistant City Manager Frank Bruno clarified the types of organizations that qualify for Enterprise
Zones designations.
Councilmember Kneeland opposed the motion stating she did not agree that the Chamber of
Commerce should be excluded. She spoke of the benefits the Chamber provides to many small
business owners.
Mayor Azari stated she did not support the motion and spoke of the need to work on broader tax
code matters. She stated although she appreciates being able to communicate concerns of the City
of Fort Collins to the State, this is already State law.
The vote on Councilmember Janett's motion was as follows: Yeas: Councilmembers Apt, Janett,
McCluskey, Smith and Wanner. Nays: Councilmembers Azari and Kneeland.
THE MOTION CARRIED.
