Unrecorded/Non-approved Rental Dwelling Units

Staff presented Council a brief overview of the issue of unrecorded/non-approved dwelling units. An
unknown number of rental dwelling units exist, never having been inspected or approved for use that may
pose a risk to occupants. To encourage widespread compliance of minimum health and safety standards,
staff proposes an incentive for rental property owners to come forward and identify their unrecorded/non-
approved rental housing.
The proposed incentive includes an amnesty period. During this time, rental property owners would be
encouraged to identify their unrecorded/non-approved rental housing for inspection of minimum health
and safety standards. The primary incentive is that any unpaid impact fees (for infrastructure and public
services) and related taxes would be waived.
Council expressed general agreement with the importance of an amnesty period to'encourage compliance
and is supportive of staffs outreach efforts thus far. Councilmember Troxell recommended consulting
with the CSU. Everitt School of Real Estate for more data on the number of affected rental housing units.
Council's discussion focused on the proposed length of time allowed for rental property owners to come
forward with their unrecorded/non-approved dwelling units. Staff recommended a twenty -four -month
voluntary application period. Some Council members expressed reservations with twenty-four months
when combined with the additional; proposed six-month implementation. delay after adoption. The delay
would be for a comprehensive public outreach campaign to inform all interested parties of the incentive.

RE: February 24, 2009 Work Session Summary for Art in Public Places Overview
'Staff presented an overview of the Art in Public Places program. Staff asked Council for any
comments or concerns on the future of the Art in Public Places Program (APP).
Staff showed an overview of past APP Utility projects, new projects to be funded by APP Utility
reserves and a plan for placing artwork in prominent downtown locations. An overview was
given of the 1% ordinance, APP process, new partnerships, and benefits to Fort Collins and the
community.
Council had previously requested information on the option of excluding utility underground
projects from the program. Council discussed what APP projects have been funded by
underground Utility projects, along with plans for future projects, including the Pickle Plant
Entryway Feature, FC Museum/Discovery Science Center and a prominent downtown artwork.
Council requested staff provide information on Utility contributions to the APP program
relative to the overall Utility budget. Although municipally owned utilities are limited in the
region, Council also requested information on whether other APP programs have contributions
from their Utility underground projects.
Council also discussed the plan for spending down the APP Utility reserves. Clarification was
made that although there are concerns about the money held in reserve, that decisions on
spending that money should be goal driving and meet the objectives of the project and program.
Council requested staff to assess the reserves and the future needs of the program to make sure
they are compatible with planned reserve expenditures.
In general, there was unanimous support for the APP Program. The program is seen as adding to
the City's unique image and economic health. Council suggested that the program look towards
future partnerships with Colorado State University on the Mason Street Transportation Corridor,
and towards promoting the program. Council also suggested the idea of promoting the program
with a photo exhibit in one of the City's gallery spaces. The City Manager recommended that
APP prepare a written semi-annual report of projects for City Council to review.

Re: February 24, 2009 Work Session Summary — Water Conservation Plan
At the February 24 Work Session, City Council discussed the Utilities' Water Conservation Plan.
Staff brought the Plan to Council to determine if additional information or revisions were
needed.
Council discussed the goals of water conservation, including reducing or eliminating the need for
additional storage, such as expanding Halligan Reservoir. Council members had specific
questions regarding:
• Water Storage
• How the conservation goal was established
• How the City's goal compares to other Front Range communities
• How Halligan Reservoir project participants' plans and goals compare to our Plan
Council members requested additional information on the financial benefits of water
conservation and supported use of the Budgeting for Outcomes process for evaluating the costs
and benefits of the conservation measures.
Utilities staff will prepare answers to the specific questions of Council members in a separate
memo.
