COUNCIL OF THE CITY OF FORT COLLINS, COLORADO

Adjourned Meeting - 6:00 p.m.
An adjourned meeting of the Council of the City of Fort Collins was held on Tuesday, January 22,
2002, at 6:00 p.m. in the Council Chambers of the City of Fort Collins City Hall. Roll Call was
answered by the following Councilmembers: Bertschy, Hamrick, Kastein, Tharp, Wanner and
Weitkunat.
Mayor Martinez was absent.
Staff Members Present: Fischbach, Harris, Roy.
City Attorney Roy explained the reason for adjourning to this date and explained the process for
retaining outside legal counsel in the pending allegations referred to an Alternate Ethics Review
board . He reported that Greeley City Attorney Rick Brady, who has agreed to serve as Special
Counsel, and Councilmember Warmer both serve on the Board of the Poudre Heritage Alliance but
noted that Mr. Brady did not believe it would present a problem; however, he requested that the
Council be polled.
There was no objection to Mr. Brady's representation. Roy suggested that this meeting be adjourned
to January 29, 2002, to take any appropriate Council action that may be necessary.
City Manager John Fischbach stated that there would also be a presentation and discussion on the
Bennett School issue at the January 29, 2002 Study Session.
Other Business
Councilmember Hamrick questioned why staff would need legal counsel
City Manager Steve Roy responded to Mr. Hamrick stating that due to questions regarding open
records, specifically audio tapes of Executive Sessions, he did not believe he should advise the City
Clerk's office due to the possibility it might be perceived as a conflict of interest. He stated that
formal Council action may need to be taken and that the City Code states that only formal action can
be taken at a regular or special meeting of the Council.
Councilmember Hamrick requested Council hold a retreat or a Study Session to discuss issues and/or
policies regarding confidentiality in Study Sessions in the near future.
City Manager Fischbach stated that staff is looking into dates for a retreat to discuss those issues.

Councilmember Kastein suggested that the retreat be held within the next three weeks.
Councilmember Wanner made a motion, seconded by Councilmember Tharp to adjourn to January
29, 2002 at 6:00 p.m. The vote on the motion was as follows: Yeas: Councilmembers Bertschy,
Hamrick, Kastein, Tharp, Wanner and Weitkunat.
THE MOTION CARRIED
The meeting adjourned at 6:10 p.m.
