D. 1914 191 535 Regular meeting of the City Council held at the City Hall on the 2d day of March 1914, 5.00 P. M. Present, 'Commissioners Clammer, Armitage and Edwards and City Attorney F. J. Annis. The City Clerk, Ray Baxter being absent on account of illness on motion of Commissioner Armitage, seconded by commissioner Edwards, F. J. Annis was elected temporary Clerk. The minutes of the regular meeting held February 23rd were read and approved. The president then stated that the regular order of business would be suspended for the purpose of hearing from citizens, Messrs. Vandewark and Lloyd constituting a commit- tee from the Poudre Valley Good Roads Association, presented and application for an allowance of $ 35.00 to help out the demonstration of the split drag by D. W. King. Moved by Commissioner Armitage and seconded by commissioner Edwards that the sum of $ 35.00 be appropriated for the demonstration of the split drag, payable to the Good Roads Association. The roll being called resulted as follows-; Ayes Commissioners Clammer. Armitage and Edwards; nays none. The president declared the motion adopted. Commissioner from the Public Works Department submited a report covering the trip o himself and the City Engineer to Colorado Springs and Pueblo for the inspection of the fire departments and street improvements of said cities. On motion by Commissioner Edwards, seconded by Commissioner Armitage that the repor be received and ordered placed on file, and that the recomendations be acted upon sepa- rately, the roll being called resulted as follows: Ayes Commissioners Clammer, Armitage and Edwards, The president declared the motion adopted. Commissioner Armitage made a further report on Prospect Park. On motion of Commissioner Edwards seconded by commissioner Armitage the report was received and ordered placed on file, separate action to be taken upon the recomendations therein contained. Commissioner Armitage made a special report upon the matter of olaeniing the settling basin and filter, and asked for authority to employ men and board them for this work. On motion of Commissioner Edwards, seconded by Commissioner Armitage, the Comnissioner of Public Works was authorized to employ the necessary men and arrange for boarding them for the purpose of carrying on the work of cleaning and repairing the settling basin and filter. Roll being called resulted as follows: -Ayes, Commissioners Clammer, Armitage and Edwards; Noes , none. The president declared the resolution adopted. Commissioner Armitage also reported that the rest room on Walnut Street had been completed and was ready to turn over to the Womens Club for use. He also reported that the fence on Mulberry Street, corner of Smith and Mulberry is in the street sixteen feet and ought to be moved. On motion of Commissioner Armitage, seconded by commissioner Edwards, the Commissioner of Public Works was instructed to notify the owner of the the fence to remove the same at once, and if not done within a reasonable time to have the same done at the City's expense. Commissioner Armitage presented a communication from the Mountain States Telephone & Telegraph Company as follows. Upon the execution of the receipt in full settlement, the case will be dismissed in the District Court at the costs of the City for the dismissal only. In as much as there is a sufficient amount to the credit of the City on its docket fee in this case to pay said costs no further advances will be required by the City. During the past week my attention has been called by Municipal Judge Frey to the pendency of a large number of cases against divers and sundry persons for gambling, but with which I have had no connection in the matter of filing complain is or the prosecution thereof. A question arose concerning one of the casesin which counsel for the defendant sought to instruct the Municipal Judge to dismiss without any authority from the Mayor or from the City Attorney, and when my at. tention was called to the matter I advised the Municipal Judge not to dismiss any case nor to settle any case without authority from the Mayor or the City Attorney. I would suggest that the Commissioner of Finance prepare a form of report to be used 1�y the Municipal Judges, and in fact all other officers collecting funds in behalf of the City, which should be used in making reports to that officer This would enable the city auditors to cheek the books of the Municipal judges In connection with the other books of the City when examining the same respecting the proper accounting of all officers receiving or collecting moneys in behalf of the City. In accordance with the instructions contained in the resolution of the City Council I notified Mr. Tom Beach respecting the delinquent rental on lands belong- ing to the city, and the same has been paid into the City Treasury. Moved by Commissioner Edwards and seconded by Commissioner Armitage that the Mayor be authorized to advertise for bids for the construction of the improvements in Jefferson Street Improvement District No. 1, and that each and every bid be accompanied by a certified check of One Hundred Dollars ($100.00) Bids to be opened March 232 19149 at 4 P. M. Rool being called resulted as follows. Ayes Commission- ers Clammer, Armitage and Edwards. noes none, The President declared the motion carried. The following resolution was offered by Commissioner Edwards: Resolved by the the City Council that the offer of Harriet Raynor Wallace to accept One Thousand Dollars in full settlement of all claims and demands against the City of Fort Collins on account of her suit now pending in the District Court of Larimer County, together with all claims for damages to date, be accepted and the Commissioner of Finance be and is hereby authorized to settle said claim and cause warrants to be issued upon the general fund un payment therefore in said amount, upon a duly executed receipt by said Harriet Raynor Wallace. Seconded by Commissioner Armitage, Roll being called resulted as follows. Ayes Commissioners Clammer, Armitage and Edwards, noes none. The President declared the resolution adopted. The City Engineer presented his report for February, 1914. On motion of Commissioner Armitage, seconded by Commissioner Edwards, the report was received and the recommendations taken under advisement. The City Engineer also presented a report respecting the matter of a street affording an outlet to the residents formerly using Pine Street: Moved by Commissioner Edwards that the City Engineer be instructed to circu- late two subscription agreements for two different outlets for Pine Street, one based upon widening the alley in Block two (2) and the other widening Willow Street on Lots2, 49 6, 8 and 10 in Block 2, and report to the council the result of such subscription, Seconded by Commissioner Armitage and being put to vote was declared carried by the President. A petition of H. A. Greenamyre and others to lessen the width of Sycamore Street from one hundred to eighty feet presented, Moved by Commissioner Armitage and seconded by Commissioner Edwards that the petition be referred to the City Engineer to report upon the signatures of the property owners at the next regular meeting of the Council.
