Present, Samuel H. Clammer, President, Commis loners Armitage and Edwards, City Attorney Prank J. Annis, On motion the reading of the minutes of February 2nd approved. On ;notion the regular order of business suspended inorder to give Messrs Lee and Aylesworth attorneys for the }.fountain States Telephone and Telegraph Co, a chance to talk over the Telephone sistuation and make a definite meeting to meet Mr. Hamlin of the Phone Co. On motion regular order of business res::med. On notion the Commissioner of Supplies was instruced to order a carioad_of,Alum. The roll being ea led the vote stood a s follows. Ayes Commissioners Clammer, Armitage and Edwards Nays Commissioner-- - ---- All c ommissioners voting in the affirmative the motion was carried and so declared by the President. On :notion the Commissioner of Works was instructed to expend not over ,50.00 in repairix the Engineers office. The roll being called the vote stood as follows. Ayes Commissioners Cla�mcer, Armitage and Edwards Nays Commissioner,-- -- -- - All commissioners voting in the affirmative the motion was carried and so declared by the President. On motion the eo=rmissioner of works was instructed to repair and fix up the room of Walnut st. in the Elks Bldg, to be used for a public rest room for women and not to exceed 4? 50.00 in the expenditure. The roll being called the vote stood as follows. Report of the City Attorney To the Honorable City Council Gentlemen: In the matter of the Claim of the Jewel Company respecting infringement upon th patent filter used by the city in its rater system, I have to report that I co_nunicated with the City Solicitor of the City of Harrisburg Pa., respecting the suit pending agains said city, and have received the following response. "lnswering yours of the 2d inst. I beg to say that the patent suit referred to is pending in the Circuit Court of Appeals at Phildelphia, and will probably be heard some time in March or April. We feel very confident of obtaining a reversal. Our supply of paper book has long since been exhausted and therefore I am unable to comply with your request. Yours very truly. D. F. Seitz, City Solicitor." The latter part of Mr. Seitz co;yriunication refers to copies of the pleadings and briefs 1 the case which he says are exhausted. In these circimstanoes I recommend to the Council that no further action be taken in this matter until the final determination of this cont versey. In the matter of the resolution authorizing the widening of the walks upon both side of College Avenue from Oak Street to L.iurel Street I have suggested to the Commissioner o Public Works that a list of all the frontage and the owners thereof on said avenue requirj widening of walks be prepared so as to be inserted in a resolution. It has further been gested that the same requirement be extended to Mauntain Avenue and if this action is tak( by the Council then the same resolution can cover both Avenues for the required work and extension. I would further report that I have advised counsel for the Jewell Company of the substance of my report to the Council upon the filter matter Respectfully Submitted Frank J. Annis City Atty. On motion the matter of wideni ng the sidewalks from College Avenue on Ht. Ave west to Shield s be taken up and that Com. Armitage be instructed to bring in a list of the walks be widened. On motion the report of the City Engineer was order placed on file. On motion Com. Edwards was instructed to have printed a requisition book. On motion the report of the Fire Chief was accepeted and ordered .)laced on file.
