D. 1913 at the City Hall of said City of July 28th, 1913, Present; Absent H. M. Balmer Aldermen Armitage Gohnson, Schlichter, St. Clair Watson, Yard Aldermen Abbott, Eves, Glessner, Mathews. Moved by Alderman Armitage and seconded by Alderman Schlichter that the following Cemetery Rules be adopted. RESOLVED BY THE CITY COUNCIL OF THE CITY OF FORT COLLINS THAT THE FOLLOWING RULES AND REGULATIONS BE AND THE SAME ARE HEREBY ADOPTED FOR THE GOVERNMENT AND MANAGEMENT OF GRAND VIEW CEMETERY AND THAT ALL FORMER RULES AND REGULATIONS HERETOFOP.E ADOPTED BY THE CITY COUNCIL ARE HEREBY REPEALED AND THE RULES AND REGULATIONS HEREIN ADOPTED SHALL BE IN FORCE AND EFFECT FROM AND AFTER THEIR ADOPTION. RULES AND REGULTAIONS GRAND VIED! CEMETERY. 1. The Cemetery being the property of the City all applications for lots and burlal'permYts shall be made at the office of the City Clerk, who is hereby authorized to grant burial permits and make sale of lots for the City. The City Clerk will exhibitthe plat of the Cemetery ground and schedule of prices of lots therein, but no burial permit will be granted or lot sold by the City Clerk except upon cash payment to him of the Purchase price, when the deed of the City will be delivered. No lot will be regarded sold until f lly paid for and deed issued; and if parties make interments before paying in full for their lots, the City reserves the right to remove the bodies at any time to the stranEer grave division, and to sell such lot or lots to other parties. 2. Application for perpetual or annual care of the Cemetery lots must be made at the office of the City Clerk, and payment made therefor in advance 3. The caretaker of the Cemetery is prohibited from receiving any money for the care of lots or grave digging. 4. The City Clerk shall issue all orders to the caretaker of the Ceme- tery for all funerals, the digging of graves, the removal of bodies and the per- petual or annual care of lots. 5. In the matter of disinterments and removals, notice must be given in advance to the City Clerk, when arrangements will be made for removal from or in the cemetery :s required. Removals and disinterments will be made at night or in the mornings only, on any day except Sunday, Monday or holidays. 6. No disinterments will be allowed without the permission of the Board of Health, City Clerk, the caretaker of the Cemetery, or the owner of the lot, or the surviving wife, husband, children (if of full age), or the parents of Records of the City Councii, 28th Day of July, A. And if the consent of such persons cannot be obtained, and order of the C )ounty Court shall be sufficient; and no disinterment shall be made except by cemetery -mployes. No grave or any lot shall be opened filled or sodded except by the employes )f the cemetery and under the direction of the caretaker. 7. Advance notice must be given to the City Clerk of the intention to bury the remains of any person who died of small pox or other virulent contagious disease, so the proper time may be appointed and suitable arrnagements made for the safety of the public health and the employes. No interments shall be Wade until the proper death cer- tificate required by law and all the information necessary to complete the records of the City shall have been furnished to the City Clerk, and the caretaker is prohibited from making any burials except in strict compliance with this rule. e. Orders for graves shall be furnished. the City Clerk at least 10 (ten ) working hours before the funeral. one (1) hour of time must be allowed between the burial permits to avoid confusion at the cemetery. when two funerals arrive at the cemetery at the same time the funeral in advance shall have precedence in entering the cemetery. On reaching the cemetery all funerals shall be under the direction of the caretaker or his assistant. 9. 1,1ounds over graves shall be kept low, not to exceed four inches in height, or stone or any other cover over grave will not be allowed and may be removed vrithout no- tice. 10. All graves shall be at least six inches within the line of the lot, and shall shall be at least five and one half feet deep for adults and of sufficient depth for chil- dren. The price of a single grave includes the ground, opening and closing grave and lattendenee. 11. when designating the location of graves on a lot, it is very important that the ovmer or representative should give personal attention to the same by going to the City Clerk's office or cemetery, and designating exactly where grave is to be made so ther may be no misunderstanding as to location, and that the City Clerk may have a proper reror in his interment register. The City is not liable for graves that are not properly loca- ted by the owners or representatives, and any change in location will be at the expense lof the lot owners. New -made graves may be sunk at the will of the caretaker or under his ord 12. It is not the intention to make a hardship on the lot owners, but it is almost impossible sinking new -made graves, and this matter must be left to the to ;rater the lot without discretion and j,dgment of the caretaker. 13. Fences, railings, hedges, coping or other inclosures around lots or part of lots or graves are prohibited and may be removed without notice. Owners of lots and graves are prohibited from placing thereon toys, shells, stones, mineral specimens, broken en glass, boxes, grave covers, either metal or cement, metal fl.owe] chine, photographs, brok es, broken vases, old chairs, settees, bricks, tiles, etc. as such bead designs, glass eas larticles are objectionable and will be removed without notice. The following fees shall be collected for opening and closing all graves: Opening and closing all graves up to and including 3 feet 6 inches- - - - -$3.00 Opening and closing -all graves 4 feet to 5 feet 6 inches- - - - - - - - - - 4.00 Opening and closing all graves 6 feet 6 inches to 7 feet 6 inches--- - - - 5.00 Brick graves not over 5 feet 6 inches inside length - - - - - - - - - - - 10.00 Brick graves not over 6 feet 6 inches inside length- - - - - - - - - - - - 15.00 Brick graves not over 7 feet 6 inches inside length- - - - - - - - - - - - 20.00 For transferring bodies to any other position in cemetery- - - - - - - - - 10.00 For raising body to be transported outside Ce:,etery- - - - - - - - - - - - 6.00 All extra expense incurred, except opening and closing grave must be paid by party ordering same or the lot owner. All extra wide graves must be paid for at the rate of 0 2.00 for every four inches in width over what is known as standard width grave clearly meaning for extra wide boxes, vaults, cement and stone linings. For gardening, dressing and sowing lots to lawn Annual charge for irrigating and care of lot 05.00 3.00 16, The boundaries of lots may be obtained from the careeaker at any time who will give the centers upon the lines bounding the lot, provided the applicant gives the correct location and number of the lot wanted. Corner stones may be set by lot owners, but must not project above the level of the lot. Corner stones shall not be less than six inches square and dressed on all sides, and not less than ten inches long. All corner stones must be set under the supervision of the caretaker of the cemetery. Corner stones set by the caretaker will be charged for at 01.00 per set of four, when set in the ground, and if set in cement 1$2.00 per set of four. 17. No monumental work of any kind, steps or corner stones, will be admitted to the cemetery, or foundations built for same, until permit has been obtained from the City Clerk. All orders for foundations must be paid for in advance. No foundation will be constructed for less than $2.500 and thirty-five cents per cubic foot will be charged for all foundations. Foundations for grave markers shall not be less than eighteenninches deep, Foundations for mon- uments shall not be less than twenty four inches deep. Foundations will be re- quired for all monuments and markers of every description in the grounds, and they must be constructed by the caretaker of the cemetery or under his supervision at the expense of the firm or person erecting the monument. Ten days' notice must be given in which to ecnstruct a foundation. No foundation will be put in between May 25th and June 1st, or during freezing weather. Bases for monuments and markers must be dressed sufficiently to allow them to rest firmly on the foun- dation. No wedging with spalls, wood or dirt will be permitted, but may under the supervision of the caretaker be set in cement at the expense of the party setting; the stone. 18. Persons engaged in erecting monuments or ot:,er structures are prohibited from attaching ropes or guys to other monuments or trees. Guy posts must be set on the walks or drives. They shall be requires to set their work or complete theris labors as soon -L possible after entering the cemetery, and remove the rubbish at once, under the instructions and discretion of the caretaker. In case of neglect such removal of rubbish will be made by ti-e cemetery caretaker at the expense of the lot owner or contractor, who shall be severally responsible. 19. Monumental firms will be held responsible for any damage done by them to other monuments, grass, trees, or any other object whatsoever in the cemetery, and shall at all times be subject to the cobtrol and direction of the Caretaker. Planks must be provided for dumping and rolling stone on walks or grass. Pdonumental firms and others (prohibited from placing their names on signs, with a view of advertising, within the limits of the cemetery. 20. Workmen must suspend labor in the immediate vicinity of a funeral until the conclusion of all services.No Monumental work will be permitted in the cemetery on Sunday: or holidays. Lot owners are required to go to the cemetery and locate their monuments and markers prior to the construction of the foundation, otherwise the City will assume no responsibility for the correct location, and any changes ordered by the owners will be made at their expense. All foundations shall be constructed of granite or stone spalls, concrete and Portland cement, and wben completed the surface shall be level. All foun- dations shall be not less than eight inches longer and eight inches wider than the base stone of the monuments. Base stones may run over or under size as given the City Clerk wgen application for foundation permit is granted, but not to exceed two inches. in width or two inches in length; and if the base stone is over or under size the caretaker may refuse to allow such stone to be set until satisfactory arrangements have been made with the City Clerk and a suitable foundation provided according to these rules. The City assumes no responsibility for the correct dimensions of the foundations only so far as the sizes riven by the firm, the individual or the lot owner, and any alterantions or corrections to a different size than g'.ven to the City Clerk at the time of the applicatic for foundation permit must be paid by the firm, individual or lot owner. 21. Feavy teaming will not be allowed in the cemetery when the caretaker decide that such teaming will cause injury to the driveways. Gradeing and digging on lots by other than employes of the cemetery is strictly prohibited. 22. The caretaker shall have charge of the planting of trees and shrubs for the ornamation of the grounds . Addition planting by the owners will be allowed and is invited, especially with plants, flowering shrubs and evergreens,provided the caretaker approves of the trees, shrubs and flowers to be planted and the location of the so -me. 23. If any tree, shrub, vine or plant crowing upon any lot, walk or road, shall by me-ars of its roots, branches or otherwise become detrimental to the adjacent walks or reads or dangerous or inconvinient, or interferes with the general design, the caretaker shall have the right to remove or cut the same out when in his judgment he may determine it to be for the best interests of the cemetery grounds. 24. No one excepting an employe of thecemetery, or by permission of the caretak shall be allowed to disturb the sod on any lot or grave, and then under the strict 452 Records of the City Council, 28th Day of July A. After a flower bed is repairs or a grave is edged with sod, the owner may, if they choos, set their own flowers thereon, subject to the rules of the cemetery. Lot owners wishing to remove from their lots plants, flowers trees, or shrubs, must have permission from the caretaker and no person shall be permitted to interfere with or disturb any tree, plant or shrub within the bounds of the cemetery. 25. The hitchir_g of horses or mules within the cemetery grounds is hereby strictly prohibited. 26. Monuments on lots are not restricted as to style, but should harmonize with the size of the lot, where there is a monument, oe where one is to be erected on a lot the marker for the grave shall be'constructed of one piece and shall not be less than eight inches thick nor more than twenty four inches lcng, and shall riot exceed eighteen inches in height. In the single grave division markers for adult graves shall not exceed three feet long and eighteen inches wide by three feet high, and for children they shall not exceed two feet long and eighteen inches wide by two feet high. No monuments or grave markers will be admitted to the cemetery when made of wood, iron, plaster of Paris, cement, limestone, soap stone, artificial stone, slate or metal composition. All monuments shall be constructed or granite, standard bronz, marble or sand stone and set upon bases as herein required. No markers with rough butts will be per- mitted. They must have level bottoms and set upon foundations. No employe of the City shall be permitted to solicit orders or receive any compensation whatever for the sale of monuments to the owners of lots, 27. The City Council reserves the right from time to time to lay out and alter such avenues and walks, and to amend these rules and make such further rules and regulations for the government of the cemetery as they may deem re- quisite. D. 1913 IyI 453 Moved by Alderman and seconded by Alderman St. Clair that the following resolut be adopted. Whereas, the privileges and franchises granted to the Colorado Telephone Com- pany under Ordinance No. 102 1893 have expired under and in pursuance of the terms and limitations of s id Ordinance; and Whereas, The Mountain States Telephone and Telegraph Company which claims to the successor in interest to said rights, privileges and franchises so granted to the said The Colorado Telephone Company has failed and refused to file any application for renewal of the rights and privileges now enjoyed by it on the streets, alleys and public grounds of the City of Fort Collins, therefore be it RESOLVED, by the City Council of the City of Fort Collins that the rights, privi- leges and franchises heretofore granted to The Colorado Telephone Company under and by visrtue of Ordinance 'o. 10, 1893 have expired by limitation and that all rights, privileg and franchise acquired thereunder by said Company and claimed by The Mountain States Telephone and Telegraph Company as successor in interest have ceased and determined from this date.
