HomeMy WebLinkAboutMINUTES-06/04/1913-Adjourned418 Records of the City Council, Day 191 Minutes of an adjourned regular meeting of the City Council of the City of Fort Collins, held at the C ity Hall on June, 4th, 1913 pursuant to adjourn me nt of of May, 29th, 1913, The following proceedings were had. Present Absent, Alderman, Abbott, Armitage, Eves, Johnson Mathews, Schlichter, St. Clair, Watson, Yard. Hon. H. M. Balmer. Mayor Alderman Glessner. Moved by alderman Schlichter and sec ended by alderman Eves and when put to a vote carried that the petition of certain people requesting permission to tap the Water Main outside the City be referred to the Committee on Water Works to report June 16th, 1913. Moved by ce.ldernan Abbott anti seconded by alderman ide, thews and when put to a vote the petition of withdrawal from the College Avenue Improvement District of certain property owners in said District was ordered refered to the Street and alley Committee to report on same in conjunction with the original petition of said District, at the next regular meeting. Moved by alderman Abbott and seconded by alderman Armitage that the Purchasing Committee be instructed to purchase the Chemical Tanks and automatic feeders, for the new subsidence basin at the Filter Plant. The roll being called the vote stood as follows. Ayes Alderman Abbott, Armitage, Eves, Johnson Mathews, Schlichter, St. Clair, Watson, Yard. Nays, Aldermen. . . . . . . . . . . . Absent alderman Glessner. All aldermen present voting in the affirmative the motion was carried and so declared by the Mayor. Moved by alderman Yard and seconded by aldermen Schlichter that the following,' - report be adopted. To the State Board of Agriculture; Gentlemen: June 4, 1913 At a regular adjourned meeting of the City Council of the City of Fo't Collins held on the 26th day of May, 1913, your President, together with the Prey ident of the College, appeared before that body in regard to the care and mainte— nance of that portion of College Avenue ly ing east of the college grounds, and it appearing from statements made that some doubt had existed in the minds of the former members of the City Council respecting title to that portion of College Avenue above mentioned, on motion the matter of ascertaining the exact legal status was referred to the Street Committee and the undersigned as City Attorney for the purpose of investigation and report. Records of the City Council, I)ay 191 419 Since that time an investigation has been made in behalf of the City through the abstract office, and it has been ascertained that the strip of ground now occupied by College Avenue east of the College buildings from Laurel Street to Elizabeth Street on th South, das never been conveyed or expressly dedicated by any conveyance to a public use as a street or road, and the title is now apparently in the State Board of Agriculture. Undoubtly the strip has been opened and used for a sufficient length of time to con- stitute a dedication to a public use so far as the state Board of Agriculture is concerned but in order to save any question in the future, and that the city may assume the burden e the care and maintenance, I shall make a report to the City Council at an adjourned meet- ing to be held this evening recommending that the City accept from your Board a q uit Claim Deed of a strip of lend 140 feet wide across the east end of the south half of the North east quarter of Section 14, Township 7 north, Range 69 West, being that portion of College Avenue extneding from Laurel Street to Elizabeth street in said City. I an taking the liberty to address you respecting the matter at the suggestion of Committee on Streets and Alleys so that if any action is desired by your body the same can be taken before the aajournement of your semi-annual meeting. FAST OF THE COLLEGE GROUNDS AND LYING BETWEEN LAUREL ST. AND ELIZABETH ST. TO THE HON`?RABLE MAYOR AND CITY COUNCIL. Gentlemen: your committee on streets herewith report that pursuant to motion adopted at adjourned meeting held may 26th, 1913•they have caused the matter of the title to College Ave between Laurel Street and Elizabeth St. to be examined and find that the apparant title to that portion of the tract is in the State roard of Agriculture end with a view of getting the matter fully and completely settled so that the City Council could assume absolute control of that portion of the street, the City Attorney was instructed to write the State Board of Agriculture, now in session, for the purpose of having the title settled, a copy of which letter is hereto a torched end made a part of this report, We therefore recommend that a deed be accepted from the State Board of Agriculture for said r trip of Ground being 140 feet off the east end of the south half of the N. REPORT OF "HE COMMITTEE ON LAWS AND ORDINANCES RESPECTING AN ORDINACE GRANTING PRIVILEGES To THE COLORADO Tr1,EPHONE COMPANY IN THE CITY OF i'ORT COLLINS STAttE 0 COLORAi:O. TO THE HONORABLE SIIAYOR AND CITY COUNCIL Oi' THE CITY OF FORT COLLINS: Gentlemen: Your Committee begs leave to call your attention to Ordinance No 10. 1993 beinf "An Ordinance Granting Certain Privileges to The Colorado Telephone Company in the City of Fort Collins, State of Colorado," passed and adopted July 13, 1593, wherein it is provided, in section 1 thereof, " For the full and com— plete period of twenty years The Colorado Telephone Company, e, corporation or— ganized and existing under the laws of the State of Colorado, shall have and it is hereby granted the right, privilege and license to erect in the City of Fort Col— lins, such poles, wires and fixtures, and construct such underground conduits as may be necessary for the operation of a telephone exchange in said City" The right and privilege granted by the foregoing ordinance will expire in the Month of July, 1913, and with a view of getting an expression from the successor in interest of The Colorado Telephone Company as to what it desires respecting a renewal of the Privileges now enjoyed by it, and for the purpose of opening ne— gotiations to that end, the Committee has prepared a resolution which is submitted with this report and its adoption recommended. Whereas, the right, privilege and license granted to The, Colore(' o Telephone Company under and in pursuance of Ordinance No. 10, 1893, will expire by kimi— tation in the minth of July 1913, and Whereas, The City Council of the City of Fort Collins desires to be advised Records of the City Council, hay 191 421 as to what proposition is to be submitted by the successor in interest of the Colorado Telephone Company respecting a renewal of the right, privilege and license heretofore enjoyed by it, and upon what terms;therefore be it RESOLVED, by the City Council of the City of Fort Collins that the Mountain States Telephone & Telegraph Company, successor in interest of the Colorado Telephone Compe.ny under said Ordinance No. 10 of 1893 be and is hereby requested to submit to the City Council any proposition it may have to make respecting a renewal of the right, privilege'' and license now enjoyed by it in the City of Fort Collins, in order that the City Coun- all may give the matter proper consideration and determination before the expiration of the period covered by said ordinance No. 10, and that the City Clerk be and is hereby authorized and directed to transmit a copy of this resolution to the said Company without delay. 7 Mayor ity Clerk. Moved by alderman Eves and seconded by alderman Abbott that the report of the City Engineer be accepted and placed on file and that the City Council accept the Building at the Filter Plant known as the Subsidence Building and that a warrant be drawn in favorl of Mr. Robt, Lindenmeier in accordance with the Contract and report and that the City Cler k. be instructed to place the 0 750.00 insurance money in the fund of Salaries and Mairi- tenance of Water Works.
