Approval of the minutes from the January 23rd meeting. Pignataro moved and Ohlson seconded. Passed 3-0. 2. Motion to nominate Canonico as the Chair of the Legislative Review Committee. Pignataro moved and Ohlson seconded. Passed 3-0. 3. Tyler provided background to the new Committee members on the function and approach of the LRC. Discussion about the commitment evaluation process. 4. Bill Review a. Ed provided an overview of the current situation and key themes. Jennifer spoke about some bills on housing, land use, and air quality. Ed spoke about accessibility and open records bills. b. HB24 – 1152 i. Requires certain cities to allow ADUs. c. HB24 – 1168 i. Requires all public bodies to live stream all meetings. ii. Tyler explained that this bill would pose a significant logistical challenge for the City. iii. Ed provided additional context on the political environment around this bill. iv. CML is opposed to this bill. v. The LRC will stay at monitor for now. d. SB24 – 095 i. Would establish a high-emitter vehicle rebate program. ii. Unclear political future. e. HB24 – 1141 i. Gives local governments control over regulating burn barrels. ii. CC4CA is recommending an oppose position. f. HB24 – 1007 i. New Era has asked the Mayor to sign on to this bill. ii. LRC has taken an amend position on the bill. iii. Jennifer does expect this bill to make it through the Senate. iv. Staff’s occupancy work is operating under the assumption that this bill will pass. v. Councilmember Ohlson expressed opposition to this bill. 2 vi. Councilmember Pignataro asked about our influence on the lifecycle of a bill. Tyler spoke about the Committee’s historical approach. Ginny spoke about the need to focus in on significant and feasible bills. g. HB24 – 1173 i. Councilmember Canonico mentioned this bill as one in which CML and CC4CA are taking different stances. ii. Tyler talked about these conflicts as good ones for the LRC to discuss. iii. This bill would fast-track permitting for EV chargers, guaranteeing approval if the review was not completed within 30 days. iv. Tyler spoke about Utilities concerns with understanding the impact of EV charger facilities on the electrical grid. v. CC4CA took an amend position to change the 30-day timeline. They also recommended establishing a voluntary model code. vi. Ed expressed doubts that this bill will pass in its current form. vii. Tyler spoke about ongoing staff work to improve the permitting process for EV charging and the potential complications caused by this bill. viii. The LRC agreed to maintain the current oppose position while continuing to monitor the bill. h. SB24 – 036 i. Would assess a small fee on most cars and trucks, scaling based on weight, in the most populous counties of the state. The money raised would be used for grants to the source counties for use in pedestrian improvement projects. ii. CML testified in support of this bill. iii. Councilmember Canonico spoke about a potential amendment to allow some counties to opt-in. iv. Municipalities are eligible for the funds. CDOT would attempt to balance the money given out and the money collected. v. LRC will adopt a support position. i. SB24 – 106 i. This construction defects bill contains a right to remedy and would require 2/3rds of unit owners to support litigation. ii. The Trial Bar is the main support of opposition, the Homeowner’s Opportunity Alliance is the main source of support. iii. Tyler spoke about the Legislative Policy Agenda’s general support for construction defect reforms. iv. Councilmember Ohlson expressed hesitancy about supporting this bill. v. The LRC is not confident enough in the details of the bill to support recommending City endorsement. 5. Other Business a. Discussion about the timing of the LRC meetings; they will be moved to 4-5pm in the future. Adopted March 5, 2024
