Other Next Meeting: Tuesday, April 9, 4:00 pm City Manager’s Office City Hall 300 LaPorte Ave. PO Box 580 Fort Collins, CO 80522 970.221.6505 970.224.6107 - fax fcgov.com DRAFT Legislative Review Committee Minutes Wednesday, March 5, 2024 3:00-4:10PM Councilmembers Present: Councilmember Canonico (chair), Councilmember Pignataro, Councilmember Ohlson Staff present: Tyler Marr, Ginny Sawyer, Sylvia Tatman-Burruss, Jenny Lopez-Filkins, Lockie Woods, Megan DeMasters, Jessica Jones (virtual), Brian Tholl (virtual) Guests present: Jennifer Cassell (lobbyist, virtual), Kevin Jones (virtual) 1. Approval of the minutes from the February 14th meeting. Pignataro moved and Ohlson seconded. Passed 3-0. 2. Bill Review a. HB 1237 Programs for the Development of Child Care Facilities i. This bill has strong bipartisan sponsorship but its fate will depend on funding. b. HB 1296 Modifications to the Colorado Open Records Act i. Bill passed committee despite opposition testimony from Parents of Poudre School District. c. HB 1239 Single-Exit Stairway Multifamily Structure i. There will be opposition to this bill from Fire Chiefs. d. HB 1313 Housing in Transit-Oriented Communities i. It is likely that the HUTF funding punishment will come out of this bill. ii. Staff/Jenn will let Representative Boesenecker know how much money the City receives from HUTF money (~$3M) iii. The City has identified its high frequency transit corridors. e. HB 1330 & SB 165 & SB 166 Air Quality Related Bills i. The business community is working as a coalition to defeat these bills. ii. CC4CA supports all three bills. iii. Bills will likely go through significant changes and few cities have taken positions on these bills. iv. Suggestion that staff focus on these bills over the next two weeks and determine whether they advance the City’s air quality goals. v. Councilmember Pignataro spoke about the City’s inability to regulate oil and gas production to the east and how these bills might be able to fill that gap. vi. HB 1330 will be up for discussion on 3/7. The other 2 bills will be up for discussion on 3/20. vii. Councilmember Ohlson expressed his preference to take a support position on these bills. viii. Discussed taking a support position on HB 1330. The City will move to a support position on HB 1330 and will ensure it meets our goals. ix. In response to a question on how positions are taken, staff clarified that positions are based on the Legislative Policy Agenda (LPA). The LPA indicates positions on a wide array of bills and attempts are made to only weigh in when there is a high probability of 2 influence or when a bill could impose negative impacts to City operations. Bills are typically added to the tracker to highlight potentially important bills without taking a position. Councilmember Canonico shared an example of navigating a position prior to testimony. f. HB 1334 Broadband Service for Multiunit Buildings i. Connexion’s has been involved in the drafting of this bill. ii. Discussion about how staff declared a support position for this bill. g. SB 36 Vulnerable Road User Protection Enterprise i. Bill would apply to two counties who would hit their TABOR cap and be ineligible for the grant funding resulting in a delay. h. SB 92 Cost Effective Energy Codes i. Councilmember Canonico testified against this bill. It was defeated. i. HB 1141 Local Government Control over Burn Barrel Regulation i. Bill will likely be defeated. j. HB 1168 Equal Access to Public Meetings i. The bill will likely be amended to only apply to the governing bodies of local governments. The City would likely already be compliant with the reduced version of this bill. If the changes are unlikely to occur, the City will plan to move to an oppose position. ii. Discussion on the impacts of the bill in its current form. k. HB 1304 Minimum Parking Requirements i. Bill passed committee with amendments. ii. CC4CA has taken an amend position on this bill because of how severely it limits local control. Their suggestion is for a model code that accounts for best practices. iii. Discussion about how staff balances home rule concerns with the LPA on bills that might conflict. iv. This bill will be added to the tracker with a monitor position. l. HB 1308 Effective Implementation of Affordable Housing Programs i. A variety of bills related to housing are coming forward. ii. Councilmember Pignataro asked if we have heard from Affordable Housing providers about this bill. Staff have not, but staff members do have offered feedback to include donation of land within the Bill. m. SB 106 Right to Remedy Construction Defects i. Councilmember Ohlson asked about this bill. The City currently has a monitor position on the bill. ii. Tyler spoke about the LPA’s general support for construction defect reform but the details are important on these bills. iii. The bill will likely be amended in the future and currently does not have sufficient support. n. SB 53 Racial Equity Study i. Clarification that this bill will only analyze state policies. 3. Other Business a. CML will be sending out a letter regarding housing in general. Staff does not plan to sign on unless they receive direction from this committee. b. The agenda for the Congressional delegation will be heavily grant-focused for the NLC conference. c. Staff asked to look at scheduling LRC more frequently.
