Legislative Review--Blair Leist
The City of Fort Collins List of Followed Bills was updated on March 26.Since only
late bills are now being introduced into the Session,the CML List of Followed Bills is
no longer included in the packet.Instead,a listing of all bills introduced,and their
status,has been provided.Since March 19th,there have been 5 house bills and I senate
bill introduced.
II.Air Quality --Lucinda Smith
SB 182:Establishes a clean screen remote sensing program as part of the AIR program
for auto emission inspections.Requires the Air Quality Control Commission to
promulgate rules governing the operation of such program.
Staff Recommendation:Fort Collins air quality policy goals would be advanced
through the passage of the bill,if amended.Staff specifically:
--supports extension of AIR program legislative authority.Amendment:Grant the
AQCC greater authority to devise rules and/or voluntary programs to meet both state
and local goals.
--supports clean screen opt-in program.Amendment:Clarify who initiates the
request,what “feasibility”means,change exemption period to one year,provide
funding for opt-in areas.
--oppose termination of basic air program.Amendment:Make it possible to also
opt-IN to enhanced I/M;OR grant AQCC authority to devise I/M programs in
cooperation with local elected officials.
--oppose elimination of the emissions test requirement at vehicle change of
ownership.Amendment:delete this portion of the bill.
Action:1.Lucinda Smith will draft a letter for Will Smith’s signature stating
position of City and requesting changes to the bill.Letter will clearly state
that City will oppose SB 182 if the elimination of emissions test at change
of ownership is not removed.
2.Will Smith will contact Senator Reeves by phone to discuss the City’s
position.
Update:Letter was signed and faxed to Senator Reeves by 9:30 a.m.
III.Finance and Taxation --Alan Krcmarik
Federal Internet Tax Bill:Compromise underway to allow a three year study.
HB 1256:Transportation funding has been increased to $80 million;K-12 and higher
education have been reduced to $50 million.Transportation funding may
go to $100 million.
SB 170:Approved by Senate Appropriations on March 25.Information not yet
available.
FIB 1030:Now may be concern to City;not originally.Will work with CML and keep
LRC updated.
HB 1165:May affect home rule cities.Will monitor and work with CML.Will keep
LRC updated.

IV.Transportation --Ron Phillips
ISTEA:Now moved to House.Funding has been increased.Will move to
Conference Committee which includes Senator Allard.
V.Other Business
Water Utilities
SB 179:Grants State authority to assess admin penalties and fines.Such
Authority is required by EPA as a condition for receiving State revolving
loan monies.Supported by the water community.
Action:Gale McGaha-Miller will draft a letter of support for the Mayor
or Mayor Pro Tem’s signature.
SJR 7:Allows the Colorado Environmental Self-Audit Law to stay intact
without EPA interference.Adopted.
HR 859:Eliminates the requirement that new toilets and other fixtures be ultra-
low flow.In direct contradiction of the Water Demand Management
Policy.The City of Fort Collins Water Board has requested that the LRC
take a position opposing this bill.
Action:Table discussion until April 9th meeting.

(Note:This summary applies to this bill as introduced and does not necessarily reflect any

Establishes a clean screen remote sensing program as part of the AIR program for auto emission
inspections.Requires the air quality control commission to promulgate rules governing the operation
of such program.
Specifies that the clean screen program shall commence on January 1,1999,in the Weld county
portion of the basic emissions program and be expanded,if feasible,to the El Paso and Larimer
county portions of the basic emissions program upon request of the lead air quality planning
agencies for the El Paso or Larimer county portions of the basic emissions program.Provides that
any motor vehicle passing the requirements of the clean screen program in the applicable portions
of the basic emissions program shall be deemed to have complied with the basic AIR program auto
emissions inspection requirement for the next inspection cycle.
Deletes the requirement that vehicles in the AIR program be inspected upon transfer.
Directs the air pollution control division in the department of public health and environment to
establish guidelines for a Denver remote sensing pilot study in the enhanced emissions program.
Requires a report on the results of such study by December 31,1999.Allows the department of
public health and environment to purchase equipment or contract for the operation of the clean
screen program and the Denver remote sensing pilot study,or both.
Requires the executive director of the department of revenue to promulgate rules to allow data from
the clean screen program to be matched with vehicle ownership information and for the transfer of
such information to county clerks and recorders for use in vehicle registration activities.
Extends the AIR program until 2020 and provides for performance audits of such program at 3-year
intervals.Authorizes the division to require the updating of test analyzer systems in the basic
emissions program.Any time prior to the 2020 termination date of the AIR program,permits the
lead air quality planning agency for any portion of the AIR program area to demonstrate to the air
quality control commission that such portion meets ambient air quality standards and transportation
conformity requirements.Upon such approval,permits the commission to specify that the AIR
program will no longer apply in that portion of the program area.
Appropriates $300,000 and 0.5 FTE from the AIR account in the highway users tax fund for contract
supervision of the Weld county portion of the clean screen program and for purposes of the Denver
remote sensing pilot program.

Factors/Organizations Driving the Legislation:
CDPHE’s interest in promoting remote sensing as a clean screening tool,based upon results of a
recent pilot study conducted in Greeley.CDPHE supports all of the bill except the elimination of
emissions testing at change of ownership.They encourage all local air quality planning agencies to
view the bill positively.Possibly the auto industry has lobbied to exclude testing at change of
ownership,as most of this economic burden falls on dealerships.
Bill Analysis:
The bill was analyzed from the perspective of Fort Collins’air quality goal,“to continually improve
air quality as the City grows.”and from the following policy basis:
ENV-1.1 Continually reduce the tailpipe emissions of high priority pollutants,including carbon monoxide...”
ENV-1.2 “Improve air quality by reducing total area-wide emissions into the air from motor vehicles...”
ENV-1.19 “The City will oppose any action of the State Legislature that restricts local government authority to
improve air quality beyond minimum State requirements,even as the City recognizes and seeks to strengthen the
vital role of the State of Colorado in improving air quality.
ENV-2 “Apply pollution prevention strategies to all environmental resource,including air,soil,water.”
The City air program regards I/M as an important strategy.The Air Quality Action Plan calls for
the recommendation of an improved local/regional I/M program for the future.This bill is a
potential vehicle to gain the Legislature’s consent for I/M program flexibility at the local level.
Positive features:
•opportunity to improve cost-effectiveness of J/M orogram,reducing overall burden to motorists.
•minimizing burden of I/M program increases political viability of any future I/M orogram.
•bill extends AIR (emissions testing)orogram sunset date from 2002 to 2020,and provides for
a periodic 3 year performance audit of the program.This extension of the AIR program would
allow us to legally include I/M as a strategy in the Fort Collins SIP element.
•The bill provides Larimer (and El Paso)counties the option to opt-in to the clean screening
program.Fort Collins has been interested in remote sensing as a potential beneficial component
of a future JIM program.
Negative features:
Allows lead planning agencies,upon demonstration of attainment of NAAQS and conformity
compliance to opt out of the AIR program.The NFRT&AQPC is the lead planning agency for
the Fort Collins non-attainment area.Upon their finding that Fort Collins met above criteria,they
could request that Fort Collins terminate the AIR program.
•Bill eliminates emissions test requirement at vehicle change of ownership.CDPI-IE estimates
that about 1/4 of all registered vehicles change ownership annually.This clause lessens the
stringency of the emissions testing program.CDPI-IE opposes this element of the bill.
•Bill exempts vehicles meeting the Clean Screen criteria from the emissions test requirement for
a full inspection cycle,which is two years for vehicles ‘82 and newer.We would prefer that clean
screened vehicles would be exempt for only one year.
•In order to be ideally responsive to individual community needs,the bill should provide the
flexibility for municipalities to opt-in to not only remote sensing,but other I/M program options
such as 1M240.
Concerns/Ouestions not specifically addressed by the bill:
•Although the bill provides that Larimer and El Paso counties can opt-in to the clean screen
program,it does not specify how this will be paid for,while the Greeley Clean Screen program
is granted State funds in this bill.
•The specific rules promulgated by the AQCC governing the clean screen program will be critical
to the success of the program.The bill states that the AQCC will set “the percentage of the fleet
vehicles targeted for the clean screen program.”It would be preferable for AQCC to consult with
each municipality in order to specify certain clean screen program elements (such as number of
vehicles targeted or cut points)to aid in meeting local goals.
Staff Recommendation:Support,with amendments.
Staff feels that Fort Collins air quality policy goals would be advanced through the passage of the
bill,if amended.We specifically
