Summary This session ——continue to monitor and respond to legislation in the current session,as in the past.No legislative initiative is proposed for this session.Next session (94—95)——possible introduction of a locally-developed emissions testing bill, Emissions testing The Committee is aware that,with the consent of the Legislature, southeast Larimer County could ‘opt-in to a more effective,high technology emissions testing program,similar to that adopted for the Denver area.We also have the opportunity to tailor an emissions testing program to local needs,blending together the “basic and “enhanced’programs along with remote sensing,mechanic training,and public education. Because emissions testing is controversial,I suggest that a task force be convened to study the issues and to propose a recommended approach to emissions testing.If adopted by City Council (and by Loveland Council and the County Commission,as appropriate),then the proposal would become the basis for a state legislative bill, which could he introduced in the 94-95 session or later. 281 N.College Ave.•P.O.Box S80 •rod Collins,CO 80S22-0580 (303)221.6600 Air toxics Committee members have inquired about legislation to strengthen air toxics emissions limits for commercial/industrial sources. Although staff members have much more to learn about this issue,it appears the City could be more effective by working within the existing legislation (SB 92—105)than by proposing a new bill at this time. For example,the state health department is now building a data base of air toxics emissions,based on Air Pollution Emission Notices (APENS)filed by emission sources in our area.We need to obtain and study this information.Second,if we are concerned about a particular toxic chemical that is not listed in state regulations,then we can petition the Air Quality Control Commission (AQCC)to include it.Similarly,if we are concerned about a particular source type (e.g.,furniture finishing),then we can petition the AQCC to adopt an emission standard for that source type on a high priority basis. Gasoline formulation Although gasoline formulation affects air quality,changing gasoline formulation clearly requires state rather than local action.For example,oxygenated fuels reduce carbon monoxide emissions,the aromatic content of gasoline contributes to air toxics,and the vapor pressure of gasoline contributes is important in ozone formation.These issues should be explored with other municipalities over the next two years,to determine whether state legislation should be introduced.
