Other business (5 minutes) • Legislative lunch • February 6 meeting City Manager’s Office City Hall 300 LaPorte Ave. PO Box 580 Fort Collins, CO 80522 970.221.6505 970.224.6107 - fax fcgov.com Legislative Review Committee Meeting Minutes December 10th, 2018, 3:00 p.m. City Clerk Large Conference Room, 300 Laporte Ave Councilmembers Present: Ray Martinez, Ken Summers, Ross Cunniff Staff Present: Ginny Sawyer, Tyler Marr, Jeff Mihelich, Carrie Daggett, Jeanne Sanford, Joe Wimmer, Ed Bowditch, Jennifer Cassell, Senator Kefalas, Representative Arndt Public Present: Dale Adamy Meeting convened at 3:02 p.m. Approval of Minutes from October 15, 2018 Councilmember Summers moved to approve the minutes from the October 15th meeting. Councilmember Martinez seconded. 2019 Session Preview with Fort Collins delegation Bowditch and Cassell update • Committee discussion on TABOR refund issue, transportation, and affordable housing. Transportation is still a top legislative priority despite failed ballot measures. • Denver Metro area may come forward with transportation ballot measure next year. • Stakeholder coalition on affordable housing proposed ideas including: expansion of low- income housing tax credit, state funding dedication, statewide housing assessment plan. Multiple bills likely. Discussion regarding Gallagher Amendment Interim Study Committee • Options presented by committee (repeal, State backfills, regional approach) would all require vote of the public, and the bills did not make it through Legislative Council. Legislative ideas proposed by CCI include a property tax assessment cycle delay. Senator Kefalas update • Provided overview on three bills that will be turned over to other legislators. o Bills related to human trafficking, protection of victims whom are minors. o Wage theft bill - adding a section regarding a felony if wage theft is over $1,000. o Bill regarding oversight regulation on massage businesses. Representative Arndt update • Provided overview of bills for 2019 session: Death penalty abolishment, national popular vote, (award electoral college votes to popular vote winner), permanent referendum C, E-Scooters regulation, mental health holds regarding police services and hospitals, state stipends to educators to now include certified school psychologists, amendment to bill regarding free speech zones on campuses. Colorado Municipal League Legislative Review of legislation discussed at CML meeting. • Allowing all easements to be used for internet services infrastructure. • Wage contribution/payroll deduction for funding family medical leave. • Allowing municipalities to set a local minimum wage. • Police Services Open Records Act bill. • Bills on Police Training mandate. • Internet Sales Tax o Fort Collins will rely on voluntary compliance and will work with CML to develop statewide proposal. Discussion about rule change of point of delivery - current Department of Revenue requirement for sales tax to be collected where the product is delivered not purchased. Comments regarding potential solutions. • Bottle recycling o Discussion regarding responsibility of manufacturers for recycling their products. Fees to assist consumers for recycling hard-to-recycle materials e.g. lead batteries. 2019 Meeting Calendar • City to continue subscription to State Bill service for bill identification. • Recommendation for City policy staff to focus tracking efforts on committees and bills of interest. • CML bi-weekly Municipal Caucus Committee assists in tracking bill and testimony opportunities. Recommendation from Council Summers for staff to spend time lobbying at the Capitol while in Denver for the CML bi-weekly meetings. • Decision for City Legislative Review Committee to meet once in January. Twice per month during legislative session, possibly the day before or after staff’s lobbying tr ip to Capital. Other Business Appreciation expressed for Bowditch and Cassell’s services.
