MEETING SUMMARY The meeting summary for the April 11,2002,Legislative Review Committee meeting was approved as written. PENDING LEGISLATION -LATE BILLS INTRODUCED SB 209 sets out rules for the transfer of development rights between local governments. Tom Vosburg explained the bill and told the Committee it affirms TDR agreements already in place between the City and Larimer County.Mr.Vosburg said the most encouraging element to the bill was the elimination of the 35-acre rule which currently exempts parcels of that size of greater from subdivision regulation.John Fischbach said this has been a problem in managing development at the fringes of the City.Landowners have been using that rule as a loop-hole to avoid the subdivision process. RB 1449 restricts police ability to gather information on citizens unless it is directly linked to an investigation of a serious crime.Mayor Martinez stated the bill would be a significant handicap for police investigations.Councilmember Tharp noted police should show restraint in what information they gather and retain.Mayor Martinez noted Fort Collins police are sensitive to not holding information that is not tied to criminal activity. ITEMS FOR INFORMATION Mark Radtke distributed a CML summary of a proposed compromise on transportation funding (SB 179 and HB 1310)The compromise would direct 75%of the proposed “growth dividend”to the HUTF to be shared with city and county governments.Mr. Radtke noted that is more finds for local needs than is contained in either of the original bills.Mr.Fischbach noted the CML executive board has been polled and is backing the compromise. Mr.Radtke brought the Committee up to date on several bills they have been following: HB 1400,that places further restrictions on the use of photo radar,could face additional amendments.Senate Public Policy Committee is scheduled to take up the bill Thursday afternoon and Denver is proposing two amendments.The first would change the definition of a neighborhood street while the second would remove the requirement that an officer staff the photo radar van. Senate Public Policy Committee will also hear RB 1404.The Governor has tak position against the bill and has stated he would like to see fluids gained from police seizures continue to be used by law enforcement. RB 1410,the compromise concealed weapons bill,has now passed the House and moved to the Senate.The bill language pre-empts local ordinances on conceal and carry. RB 1411,the “pre-approval”of the Fort Collins carbon monoxide attainment and maintenance plan,has also passed the House without amendment in accordance with our agreement. SB 156 was debated on second reading in the House yesterday and will be debated again today.Councilmember Hamrick asked about opposition to the measure.The primary group opposed is the Colorado Farm Bureau,while most water interests are supporting the bill. SB173,that expands worker’s compensation awards for police and firefighters,has now been assigned to House Business Affairs. Councilmember Hamrick asked about the status of SB 74.The bill concerning sexual orientation discrimination in the workplace has passed the Senate and is assigned to House State Affairs. The next meeting of the Legislative Review Committee is scheduled for May 16,2002,at 8:00 a.m.in the City Manager’s Conference Room. The meeting was adjourned at 8:40 am.
