HomeMy WebLinkAboutMinutes - Legislative Review Committee - 01/19/2006 -C r LEGISLATIVE REVIEW COMMITTEE Meeting Summary January 19,2006 Legislative Review Committee present:Doug Hutchinson,Ben Manvel,Kelly Ohlson Staff present:Steve Roy,Ron Phillips,Mark Radtke The meeting was called to order by Mayor Hutchinson at 7:35 a.m. NEW COMMITTEE MEMBER Councilmember Ben Manvel joined the Committee,replacing Kurt Kastein NEW BILLS The Downtown Development Authority extension bill,SB 18 has been introduced.Mark Radtke told the Committee support has been gained from Grand Junction and Longmont and discussions continue with Colorado Counties,Inc.over their position on the bill. HB 1067 would impose a statewide ban on the possession,use or sale of fireworks. Councilmember Ohlson said that sometime in the future he would like to explor o 1 ordinance that allows the use of fireworks for two or three days at Independence Day with a strict prohibition for all other days. The Committee affirmed the City’s opposition to HB 1099 that would eliminate the use of eminent domain for economic development purposes.Ron Phillips said the CML Board has discussed a second bill dealing with eminent domain that is expected to be introduced soon.This would be a constitutional amendment sent to the November ballot that bars the use of eminent domain solely for economic development but continues to allow its use to alleviate blight.Mr.Phillips said CML is working with the sponsor to find language acceptable to municipalities. Bill language of a proposed ban on indoor smoking has not yet been released. Councilmember Ohlson expressed concern that a statewide bill could dilute strict local ordinances.The Committee agreed that to support a statewide measure it must not pre empt local ordinances. Committee members requested additional information on SB 37 that sets new rules for granting water rights for recreational uses. The Committee voiced support for SB 54 that will once again allow cities to regulate the ownership of specific dog breeds.Councilmember Manvel urged support on the basis of local control of a local issue. SB 90 would prohibit local governments from creating illegal immigrant “sanctuaries” that bar law enforcement officers from inquiring about people’s citizenship.Mr.Radtke said this is one of several bills coming forward that deal with the issue of illegal immigration.A general discussion followed on the illegal immigration issue regarding local government’s role and upholding home rule authority.Staff was directed to provide a list of all bills dealing with the subject and provide an over-view of their impact on the City. The Committee voiced its support for HB 1159.The bill requires the formation of a Transition Advisory Board to be a clearinghouse of information for enclave annexations. The bill also requires disclosure during real estate transfers for properties in areas covered by an IGA that calls for eventual annexation. CACHE LA POUDRE HERITAGE AREA Background information was provided to the Committee on legislation now before Congress to solve the management issue for the Cache la Poudre Heritage Corridor. Councilmember Manvel is the Council representative for the Heritage Corridor.He told the Committee the Heritage Corridor area needs to solve this issue so that it can move forward with its educational and interpretive programs.He said it’s also important to continue the small amount of staff support from the National Park Service.The City has a support position for the bills:S.2101 and H.R.4530. FUTURE MEETINGS The Committee agreed to change the meeting times of future meetings to begin at 8:00 a.m.and conclude at 9:30 a.m.The meeting dates remain the same. MEETING SUMMARY The meeting summary for the November 10,2005 Legislative Review Committee meeting was approved with a notation regarding the Committee’s intended wording of Fire Protection policy statement #2 of the Legislative Policy Agenda.The Committee directed that the wording be corrected in the 2007 Legislative Policy Agenda. The meeting was adjourned at 8:55 a.m.
