HomeMy WebLinkAboutMinutes - Legislative Review Committee - 11/10/2005 -r LEGISLATIVE REVIEW COMMITTEE Meeting Summary November 10,2005 Legislative Review Committee present:Doug Hutchinson,Kurt Kastein,Kelly Ohlson Staff present:Darn Atteberry,Wendy Williams,John Mulligan,Ron Phillips,Carrie Daggett,Mark Radtke The meeting was called to order by Mayor Hutchinson at 7:34 a.m. MEETING SUMMARY The meeting summary for the October 13,2005 Legislative Review Committee meeting was approved as written. LEGISLATIVE POLICY AGENDA The Committee discussed changes to the Legislative Policy Agenda proposed for the 2006 edition. Councilman Ohlson had asked that a policy statement in support of incentives for renewable energy sources be included.The statement was adopted without objection. Tlwee proposed policy statements dealing with support for fire protection systems and carbon monoxide detectors were outlined by John Mulligan.The Committee adopted a policy statement that reads:“Support legislation that requires the installation of fire protection systems in structures to enhance life safety and property protection.” CORRECTED MINUTES:The Committee at its January 19,2006 meeting amended the minutes to reflect the Legislative Policy Agenda statement referenced above should have included the phrase “when appropriates’and directed staff to include that correction when presenting the 2007 LPA. Mr.Mulligan said the fire safety issues included a push for mandatory installation of carbon monoxide detectors in new homes,as the number of carbon monoxide deaths each year is increasing across the nation.The Committee adopted a second statement supporting the mandatory installation of carbon monoxide detectors in new structures. Rejected was a third proposed statement specifically requiring fire protection systems in affordable housing properties.The Committee noted that affordable housing was already covered with the adoption of the first fire protection statement. On the recommendation of the Housing Authority,the Committee removed a policy statement dealing with rent controls that no longer remains an issue. 0 A policy statement supporting continued municipal authority to establish public improvement fees was approved.Darin Atteberry had asked for inclusion of the statement and told the Committee this is an important tool for economic development that must be protected. Councilmember Kastein asked what the fUture holds for the inspection/maintenance (I/M) program which is supported by a policy statement.Ron Phillips said the JIM program is currently set to expire in 2006 and has been kept in place to address the growing ozone problem.He said work continues on finding an acceptable replacement for JIM.Carrie Daggett said the best approach to emission programs is through the state which has the power to levy registration fees and enforce regional programs.Councilmember Kastein requested additional information on the status of the JIM program.Councilmember Ohison asked for a report on recent changes in federal vehicle emissions standards. Councilmember Kastein suggested phrasing that mentions “global warming”be deleted from policy statement #7 under Air Quality Vehicle Emissions saying the wording adds unnecessary editorial content.The wording was struck without objection. Following suggested rewording from Councilmember Kastein and Mr.Atteberry,the Committee rewrote policy statement #2 in the Finance section to read:“Support legislation that is consistent with the City’s economic policies.” The Committee shortened policy statement #9 in the Planning and Land Use section to read:“Oppose legislation that limits a municipality’s right to annex.” A policy statement supporting ease in eviction of public nuisance tenants was discussed and supported.Councilmember Ohlson said this may be an area in which the City should initiate legislation to facilitate the removal of public nuisance tenants.Staff will provide information on the current laws dealing with tenant removal. Councilmember Kastein asked about the Committee’s past opposition to bills requiring “keg tags”to track the use of beer kegs.Mayor Hutchinson asked that staff provide reaction on the keg tag issue from the police chief and CSU officials. Councilmember Ohlson stated his objection to a policy statement opposing the direct election of directors for the Northern Colorado Water Conservation District.The Committee kept the statement in the final draft but asked Utilities to provide the context for this opposition. FUTURE MEETINGS A meeting schedule for 2006 was distributed reflecting the bi-weekly frequency of meetings during the General Assembly session. The meeting was adjourned at 8:47 a.m.
