The meeting was called to order by Mayor Hutchinson at 9:05 a.m.
MEETING SUMMARY
The meeting summary for February 1,2007 Legislative Review Committee meeting was
approved as written.
NEW BILLS
SB 157 is a bill that would require property owner notification when a Urban Renewal
slum sttLdy was started,would allow former owners of URA property that was
condemned to repurchase the property under certain circumstances and would limit the
amount of land zoned agriculture to 1000 of a total URA area.The Committee discussed
the issue of greenfields use of URAs and agreed the lO0o limit may be too low a figure.
Based on this concern the Committee adopted an “oppose”position.
The Committee took an “oppose”position to HR 1124.Information from City Utilities
staff indicated the bill would create statewide rules that would make it more difficult to
store carry-over water in state reservoirs.The bill would make it impossible for the City
to carry through with the partnership envisioned for an enlarged 1-lalligan Reservoir.
Colorado Counties has put forward HR 1264 that would require cities to annex any road
right-of-way that abuts annexed property.The Colorado Municipal League has been
working on an amendment to require annexation of right-of-way only if the road is a
primary access to the annexed property.The Committee took a position of “support”if
the CML amendment is adopted.
The Committee adopted a “support”position for HR 1281 that increases the statewide
renewable energy standard.Municipal electrics’standard will climb to 1000 by 2020.
Assistant City Attorney Carrie Daggett told the Committee that HR 1218 would greatly
increase the City’s exposure to liability in connection with waterways that the city
discharges storm and waste water into.The bill strips the City’s government immunity
for incidents in downstream rivers and ditches.The Committee took an “oppose”
position.

UPDATE ON LEGISLATION
Mr.Radtke gave the Committee information on the progress of several bills:
-SB 103 that would have created a liquor license that would have also allowed
smoking on premises was defeated in Committee
-SB 120 that would have allowed smoking in veteran’s clubs was defeated in
committee.
-HB 1196 that would allow smoking areas in assisted living centers passed from
Committee to the House floor for action
-SB 149 that raises liquor license fees passed to the floor for debate after an
amendment was adopted eliminating the fee increase for license renewals.Mr.
Radtke said it’s expected the increase from $50 to $100 will be reinstated in the
bill on the Senate floor.
-SB 151 that makes failure to use a seat belt a primary traffic offense has moved to
the Senate floor.
-HB 1222 that would have pre-empted local franchising of cable television and
moved the franchising decisions to the Public Utilities Commission was killed in
Committee.
-HB 1010 that allows for the electronic transmission of search and arrest warrants
was sent to the Governor for signature.
-SB 21 that would have fined railroads for blocking grade crossings for longer than
ten minutes died in Senate Transportation Committee.Mr.Radtke noted the issue
will be discussed next summer by the Transportation Legislation Review
Committee.
OTHER BUSINESS
Councilmember Manvel suggested that the City create a fiscal note for ordinances similar
to the fiscal notes prepared for state legislation.
