The meeting was called to order by Mayor Hutchinson at 9:00 a.m.
MEET[NG SUMMARY
The meeting summary for November 9,2006 Legislative Review Committee meeting
was approved as written.
NEW BILLS
The Committee discussed HB 1006 dealing with distracted drivers.The bill would double
the penalty for any traffic violation that occurred as the result of distractions to the driver
such as eating,reading or cell phone use.Mayor Hutchinson said this was a good way to
approach the problem of distracted drivers.Councilmember Ohlson agreed that it is a step
in the right direction.The LRC confirmed a support position for HB 1006.
Mark Radtke reported that HB 1010 passed out of House Judiciary Committee with a
unanimous voted yesterday.The bill submitted by Fort Collins Police and would
authorize the electronic transfer of search and arrest warrants.
HB 1110 is a bill that would require local governments to provide compensation to
property owners who lose more than 20°c of the value of their property due to a change
in regulations.Committee members agreed this was an unacceptable measure and
endorsed opposition to the measure.
Every city and county would be required to adopt at a minimum the 2003 International
Energy Conservation Code if HB 1146 is enacted.Mr.Radtke reported that the City is in
the process of adopting the 2006 version of the Code and the issue will come before
Council by this summer.Councilmember Ohlson requested that staff report on how often
the City updates its residential and commercial building codes.The Committee adopted a
neutral position on the bill after expressing concern over the issue of pre-emption of local
control.
Senator Johnson has introduced SB 21 that limits to ten minutes the amount of time a
railroad may block a grade crossing.The Committee supports the bill.Councilmember
Manvel suggested the City support an amendment that would increase the $1,100 fine
incrementally the longer the crossing is blocked.The Committee endorsed that idea and
directed staff to transmit the amendment to Senator Johnson.

SB 25 would add sexual orientation and religion to the non-discrimination protections for
employment and compensation in Colorado.The Committee adopted a neutral stand on
the issue.
The Committee adopted a position in opposition of SB 89.The bill would require an
affirmative vote of enclave residents before a municipality could annex an enclave.
CML LEGISLATIVE WORKSHOP
Mayor Hutchinson and Councilmember Manvel indicated they would be attending the
Colorado Municipal League Legislative Workshop on February 15.The LRC meeting
for that date will be rescheduled.
OTHER BUSINESS
Councilmember Ohlson asked that following the seating of a new City Council in April
Councilmembers be given the opportunity to review the Legislative Policy Agenda and
discuss potential changes in policies.
