Legislative Review Committee Meeting Minutes
June 2,2009
Meeting was convened at 4:07 p.m.
Present:Doug 1-lutchinson,Kelly Ohlson,Lisa Poppaw.Ben Manvel,Steve Roy.

Absent:Darin Atteberry
Former (outgoing)Committee member Ben Manvel attended the meeting to hear
the results of the 2009 Legislative Session.The Committee thanked Ben for the
many contributions he has made to the LRC and welcomed Council member Lisa
Poppaw to the Committee.
The meeting summary from April 21,2009 was approved.
Members discussed and evaluated the 2009 Legislative Session.Tess Heffernan
pointed out the memo that was included in the May 14,2009 packet,“2009
Legislative Session Recap.”Tess then reviewed the outcomes of the remaining
bills the Committee had been tracking.(See summary below.)
Members shared their insights on the 2009 Session,including “wins,losses and
wishes for next year.”All noted that budget constraints made for a difficult year.
They also expressed disappointment and stated that little significant progress was
made this session.Several bills that had great potential were amended to the
point where they will have minimal impact.Kelly Ohlson noted that harm was
done by SBI 73,which creates a mechanism for state sales tax to be diverted to
fund large scale tourism projects/zones.
Committee members expressed interest in future legislation in a number of areas,
including:
Reforms to the statutes dealing with paid petition circulators:consider
additional state regulation to address misrepresentation by circulators.
Also look into the possibility of andlor need for local legislation to mirror
recent improvements to the statutes addressing paid petition circulators.
Continue to seek reforms to the URA statutes.Steve Roy noted that one
of the best contributions the City can make is to help people focus on just
what it is about that legislation that they want to fix.Fort Collins could
play a significant role as convener or facilitator.Tess discussed recent

meetings she has had with Randy Fischer and City and County staff
representatives from Boulder and Longmont.
Steve will investigate options for recovering the costs of policing related
to the liquor tax;this might entail local or state legislation.
-Continue to pursue removing restrictions on the use of camera radar.
-A City staff team is currently reviewing a number of Jaws related to
regulation of bars and taverns and may be bringing forth recommendations
for changes in local or state laws.
Mayor Hutchinson requested that staff look into these issues in more detail,
determine what is needed from the Committee over the next several months,and
propose a strategy for how and when the Committee should provide further
direction.
The focus of the July 7,2009 Legislative Review Committee meeting will be a
discussion about potential changes to City legislative policies that speak to home
rule and local control,especially in the areas of land use and environmental
protections.
