Meeting Notes
March 23,2010,4:00 p.m.
Present:Mayor Doug Hutchinson,Mayor Pro Tern Kelly Ohlson,Councilmember
Lisa Poppaw,Assistant City Manager Wendy Williams,City Attorney Steve Roy,
Legislative Policy Manager Tess Heffeman,Deputy City Attorney Carrie Daggett
Absent:City Manager Darin Atteberry
The meeting summary from March 9,2010 was approved.
Legislation update and review of bills:Tess Heffernan provided updates on
several bills and the Committee determined the City’s position on additional
(new)bills:
-SB 185 Residential Warranty of Habitability —City position is Neutral as
currently written;Committee members wish to see the bill arnended to reduce
landlord liability and make real impacts for tenants.As written the bill does
not significantly help tenants and could harm landlords.The City owns
several residential properties and could be at risk if the bill passes as written.
-SB 135 Low-income 911 Charge Exemption —postponed indefinitely
-SB 120 Prepaid Wireless Telephone 911 Surcharge —City position is
Support.Members asked for demographic information on people who
purchase pre-paid wireless phones;are these predominantly low-income?
-SB 98 —Allocate Moneys Conserve Nat Resources —Previously had taken a
position of Oppose.Concerns have been raised about the potential use of CT
funds outside their original purpose (in this case,for weed control on ANY
kind of public land vs.just open space and parks.)Rep.Hullinghorst is
working on a clarifying amendment.City position remains Oppose in current
form;Support if amended.
-SB 85 —Peace Officers’Bill of Rights —City has taken position of Oppose.
Bill is finally scheduled for committee hearing on 032910.
-SB 29 Create Efficiencies in State &Local Gov —City position is Oppose.
-HB 1358 Water-smart Homes —City position is Support.
-HB 1284 Medical Marijuana Regulations —majority of bill was rewritten;an
overview was provided of the 15 amendments considered by Judiciary
Committee on 032210.City position is Deliberating until revised bill is
published and can be studied further.Most important message to convey to
legislators is to allow local control over additional (local)licensing
requirements.
-RB 1279 Grocery Store Acquire Retail Liquor Lic City has taken a position
of Neutral;no change.This issue is not currently addressed in the Legislative
Policy Agenda and will be addressed in the next update.
-RB 1107 Urban Renewal Rea Ag Lands House has concurred with all
Senate amendments.Next step:bill signing by Governor.
Other business:Tess provided a brief update on the latest efforts to resolve the
non-levee embankment issue.A detailed memo will be in Council’s packet on
032510.
