Legislative Review Committee
Meeting Summary
February 16,2010 4:00 p.m.
Present:Mayor Doug Hutchinson,Mayor Pro Tem Kelly Ohlson,City Manager

Roy,Legislative Policy Manager Tess Heffeman
Absent:Councilmember Lisa Poppaw
Guests:Councilmember Ben Manvel,Rick Price,Lt.Jim Szakmeister
Discussion began with HB 1147.Lt.Jim Szakmeister noted that Police Services
does not support the bill for a number of reasons,including:
-liability of an officer does not stop a child who is subsequently involved in
an accident
-potential for frightening a child
-public intrusion into family issues
-Fourth amendment issues;no consequences
He also noted that Police Services supports the education components of the
legislation,and he praised the strides that have been made over the past several
years.
Rick Price provided a handout with details about the bill and spoke in support,
noting the following:
-this bill came from Fort Collins,at the urging of citizens from our
community
-education components are critical;a helmet law by itself is not a good idea
-the Colorado State Patrol supports the bill
-other states have a similar law
Committee members discussed various components at length.Comments
included support for educational components,concern about helmet requirements,
and practical concerns about officers’time limitations and that the provisions
cannot be enforced.The Committee voted to take a position of Neutral.
The meeting summary from November 3,2009 was approved.

applaud the intent of the legislation,however,question the 30%standard
given what it would take to get there.
•HB 1012 Limit Surveillance Workers’Comp Claims —Oppose
•HB 1052 Recycle Resources Econ Opportunity Fund Support
•HB 1068 White &Yellow Page Delivery —Support
•HB 1082 Bar Felons From School Employment —Support
•HB 1088 Devolve State Commuter Hwys To Local Govs —information only,
as bill had been Postponed Indefmitely;Opposed the same bill in 2009.
•HB 1107 Urban Renewal Area Ag Lands —Support;Committee members
affirmed support for the valuation provision as well.
•HB 1147 Safer Streets For Nonmotorized Transport —Neutral;see notes
above
•HB 1162 Retainage Construction Contracts —Oppose
•HB 1259 Conform Annex Act to State Const Neutral
•HB 1284 Medical Marijuana Regulations Support with amendments;
Committee members agreed with Steve Roy that cities should have the ability
to prohibit new or amortize existing dispensaries
•SB 84 Peace Officers’Bill of Rights Oppose
