Hello Mayor and City Council Members
My thoughts on three of the decision points staff will present to you this evening:
YES if the activity is within City limits and NO if the activity is outside City limits on Decision Point # 3
Should the code regulate any activity that causes an adverse impact on Fort Collins
property regardless of where the construction takes place?
For activities outside of City limits, this is an overreach. Do any other local governments use 1041 regulations to
regulate activity outside their boundaries?
NO NO NO on Decision Point # 4
Should Council consider an IGA in lieu of 1041 regulations?
1041 regulations provide local governments the ability to assure all parties negotiate in good faith and provide
enforcement mechanisms.
YES on Decision Point # 5
Should the Code include the use of third-party contractors to support staff administration
of permit applications?
3rd party contractors may have more expertise in dealing with issues covered by the City's 1041 regulations
reducing the chance of staff being run over by parties who don't have the best interest of the City in mind. City staff
can decide what's best regarding the option for 3rd party contractors depending on the circumstances.
Also, I have not heard any explanation on why 1041 regulations should not cover the whole City! What or who is
behind this issue? Fort Collins residents should have the same protections with 1041 regulations as the City
does.
Why are individuals who live outside of City limits commenting on whether the City should have 1041 regulations?
The City and its residents deserve to protect themselves the best they can. Individuals who live outside City limits
with agendas contrary to what's best for Fort Collins should have their testimony disregarded.
