JeffSchneideralsospoketotheappealasthedeveloperworkingwiththepropertyowners.Hepresentedslidesasprovidedaspartofthepublicrecordfortheitem.Henotedtheworkdonebyapplicanthasincludedworkingwiththecommissionthroughouttheprocesstoberesponsivetoconcernsandinputprovided.PRESENTATIONSINOPPOSITIONTOTHEAPPEALLauraBaileycameforwardandidentifiedherselfasthedaughterofBobBaileywhoworkedtohavethispropertydesignatedasalandmarkin2014.Shesharedregardingherfather’scommitmenttosmallscalelivingandthegiftheprovidedthecommunityinensuringthispropertywouldbepreservedasadesignatedlandmarkasarepresentationofanartsandcraftsbungalow.Sheindicatedinreturnforprovidingthisgift,herfathergaveuptheopportunitytomakeadditionalimprovementstothepropertyhemayhavelikedtohavedoneandwasprovidedassurancesbytheCitythroughthisprocessthepropertywouldbeprotectedfromunnecessaryexterioralterations,whichisthecaseinthisinstancewhenchangesarebeingproposedtoallowforchangesinfurnitureplacement.•Shealsospokeabouttheextentofherfather’srelationshipwithcurrentHPCmemberMegBaileywaslimitedtotheirtimeworkingtogetheronthedesignation,whichwasproperlydisclosedbythecommissionerbeforeparticipatinginproceedings.•Shespokeregardingthewindowsincludedintheplans,andhowtheydifferfromoriginalelementsapprovedbytheCommissioninFebruary.•Shespokeregardingthesizeoftheadditionproposed,initiallydevelopedtomorethandoublethesizeoftheproperty.•Thecommissionerwhodidrecusehimselffromthehearingwasanimmediatecloseneighboroftheproperty,whichwasfairandappropriategiventhecircumstances.•Itwasstatedtheimmediateneighborwouldbemostimpactedbythedevelopmentandthereforesinceheisfinewithit,thereshouldn’tbeanissue.Shearguedtheentirecommunity,andparticularlythosewhovaluetheabilitytolookbackandseewherewecamefrom,wouldbeimpactedbythischange.•Toherunderstanding,theguidelinesarenotlooseguidelinesbutratherstandardsthatmustbecompliedwithandneedtobefollowedinordertoassuremeetingfederalandstatestandardsandenablethereceiptoffundingfromthoselevelsofgovernmentforhistoricpreservationwork.•Theprocessofgettingahomedesignatedisnotaneasyprocessandimpactstheabilityofthehomeownertomakesomefuturechangesanddosoinordertoprotectthehouse.Shesuggestedfuturechanges,includingmakingadesignationsomethingthatisnotedonthedeed.Inthisinstance,thecurrentpropertyownerswerenotawareofthedesignationofthepropertywhentheypurchasedthehome.•Sheprovidedaphoto,alsoalreadyintherecordaspartoftheappellant’spresentation,showingtheviewofthewindowsatquestionintheappeal.REBUTTALINSUPPORTOFTHEAPPEALJeffSchneideragaincameforwardtoprovidearebuttal.•Nothinginthestandardsandguidelinessayyoucannotdoanythingtoahistoriclandmark.•Ms.Dunn’spersonalbiascameoutwhenshecommented‘ifyourfurniturecan’tfitintothehouse,youcan’tbuyanOldtownhouse.”•Thecommentthefirstdesigndoubledthesizeofhouseandwouldfundamentallychangethecharacterofthehouse.Whileitwouldchangethesizeofthehouse,itmetallotherlandusecodesandguidancefordesignparametersinthezone.ThestandardsfromtheSecretaryoftheInteriordonotprecludemakingalterations.•AskedwhythebedroomwindowismorehistoricallyrelevantthanthebathroomwindowalsoproposedforremovalandapprovedbytheHPConFebruary16.CityofFortCollinsPage321CityCouncilProceedings •Regardingwindowsizes,theproposalistomatchthesamesizeanddetailofexistingwindows.•Originalplanwastoreplacealloftheexistingwindows,buttheyhavelistenedtothecommissionandstafftoinsteadrehabilitatetheexistingwindowsandonlyreplacethebathroomwindow.•Theadjoiningneighboristheonlyonewhowillbeimpactedonadaytodaybasisbytheworktothisproperty.Fromthestreet,thisworkwillscarcelybeevident.•TogowiththerecommendationoftheHPC,itwouldbenecessarytodoacasementwindowtocomplywithegress,notadoublehungwindow.BrianBerkhausenalsofolloweduponthefollowingpoints:•Newwindowsinthebedroomwouldmatchtheexistingwindowsinthehouse,andthereplacementofonewindowwasalreadyapprovedinFebruary.Denyingthisnowseemsincongruous.•Makingchangestoallowingnavigatingwithawalkertoallowaginginplace.REBUTTALINOPPOSITIONTOTHEAPPEALLauraBaileycameforwardtoprovidearebuttal.•Objectionistosomeonebuyingahomethatisadesignatedlandmarkandexpectingtobeabletomakealterationsfortheirownconvenience.•StatedshecannotspeakforMegDunn,asshedoesnotknowMegDunn,butdoesknowthattheHPCisconcernedwithonlytheexterioroftheproperty.COUNCILQUESTIONSCouncilmemberPeel•AskedifthestandardsarecodifiedandwhattheconnectionisbetweentheSecretaryofInteriorstandardsandCityCode,includingwhetherstafflookssolelyatthosestandardsoriftheyarealsolookingatothercodeprovisions.DirectorSizemorespoketotheSecretaryofInteriorstandards,notingtheyhavebeenadoptedbyreferenceintotheCityCode.TherearealsootherdocumentsliketheNationalParkServicebulletinsandadvisorydocumentsthatarenotincorporatedintoourcodebutthatdoprovideguidanceinapplyingstandards.•Requestedclarificationonhowtoapplystandardsandwhetheranapplicanthastomeetallthestandardsandhowfirmtheyareaspartoftryingtounderstandhowthefirstsetofwindowscouldbeapprovedandthesecondsetwasnot.PlannerBertolinirespondedwithdetailsabouthowthestandardscreateaframeworkfordecisionmakingbecausetheyapplytosuchabroadarrayofhistoricresourcesacrossthecountry,includingdifferentlandscapes,buildingsandotherfacilities.WhenStandardsarebeingusedinlocalgovernment,wearealsolookingatwhatlocalcodessay.Thedifferencebetweenthetwodecisionswasajudgementlargelybasedonthedegreeofchangetothebuildingelevation.February’schangewastoasmallwindowopening,whereasthechangeinJulyseemedmoresignificantandinvolvedthedestructionofmorehistoricmaterialtomakethatchange.•Inregardstothefairnessofthehearing,askedtheCityAttorneywhatistobeconsideredasaconflictofinterest,astheappellantalsolistedacoupleofotherthingsthatwereindicativeofbias,whichseemslikeadifferentthingthanaconflictofinterest.RequestedclarificationregardingwhattheCouncilcanconsiderinevaluatingthisclaim.CityAttorneyDaggettreadthecodelanguagepertainingtotheprovisionsdefiningtheabilitytobeunbiasedandfairintheparticipationinthedecision,notingitisthesamestandardCouncilfaceswhenevaluatingaquasi-judicialmatter.Council’sevaluationinthisinstanceistodeterminewhetherCommissionDunnwasbiasedagainsttheappellantbyreasonofaconflictofinterestorotherclosebusiness,personalorsocialrelationshipthatinterferedwithherindependenceofjudgement.CityofFortCollinsPage322CityCouncilProceedings CouncilmemberPignataro•AskedwhethertherewasarecordingfortheFebruaryHPChearing.Staffconfirmedthereisnot,howeversomeamountofinformationwasprovidedaboutwhatwasapprovedatthatmeeting,includingthedrawingsthatwererejectedwereincludedintheJulymeetingpacket.•AssistantCityAttorneyBradYataberespondedtoaquestionrelatingtoconsistencyovertheyearsandamongdifferentmembersoftheHistoricPreservationCommission,indicatinghisroleinthisappealwasinplaceofanotherattorneywhohadaconflictofinterestinthismatterandthereforestaffmaybebetterabletoaddresstheseconcerns.CouncilmemberPeelaskedhowminuteinthelevelofdetaildoesstaffgodowntoandhowconsistentisstaffonaprojectregardingrequirementstobehistoricallyaccurate.PlannerBertoliniindicatedwiththestandardsbeingwrittentocoversuchabroadarrayofthings,itisdependentonthepropertyandwhatmakesitsignificant.Thisissomethingthatideallyiscoveredintheordinanceorthelandmarknominationthatbacksuptheordinancetohelpinindicatingwhatfeaturesaremostimportanttothatproperty.Forthisproperty,becauseitwasnominatedunderstandard3fordesignandconstruction,wearegoingtolookatthosearchitecturalfeaturesthatmakeitasmall-scalecraftsmancottageasmostsignificant.CouncilmemberPignatarofollowedupwithaquestionafterseeingthepictureinthepacketofthewindowsthatwereapprovedinFebruaryifitisaccuratetosayitwasamaileroftheattentionofdetailnotbeinggiventothosewindowsgiventhelargerscopeofchangesbeingproposedoverallthatwerenotapproved.PlannerBertoliniindicatedinthestaffanalysisthatmodificationwasnotrecommendedbutwasnotspecificallyinviolationofthatstandard.ThatwasnotamajortopicofdiscussioninFebruary,butitwasaddressedinthestaffanalysis.MayorProTemFrancis•RequestedclarificationregardingwhetherthesewindowsnowproposedwerealsonotrecommendedbutfoundtonotbeinviolationofthestandardandaskedforclarificationincomparingthelanguageinthestaffreportfromtheFebruaryhearingandtheJulyhearing.DirectorSizemorefollowedupbyreadingthelanguageusedinthefindingsateachhearing.•Alsorequestedclarityontheegresswindowsandhowifthereisonewindowanditisegresshowthatfitsintothehistoricalcontext.PlannerBertoliniindicatedthatgetsbacktotheissueofcharacterdefiningfeatures,andtypicallybasementwindowsarenotgoingtobeacharacterdefiningfeaturesowetypicallyapprovethose.Thebenefitsofbeingabletoactivatebasementspaceincludeavoidingaddingmoresquarefootagethatwouldimpactcharacterdefiningfeatures.Inthecaseofasingleegresswindow,adesiretouseacasementwindowthathasasashthatvisuallylookssimilar.Aspartdoingnoharm,therewouldbeadesiretoutilizetheexistingopeningratherthanpunchingnewholesinthewall.CouncilmemberGutowskyaskedifthereisasafetyrequirementforotheregresswindowsinthehouse.JimBertoliniindicatedthereisnotastrictrequirementforanexistingbuildingwithexistingthatisthestandardforbedrooms.COUNCILDISCUSSIONMayorProTemFrancisclosedthehearingat9:33p.m.CouncilmemberPignataroindicatedshedidbelieveitwasafairhearingbasedontheparametersthatshouldbeapplied.CouncilmemberPeelalsoagreeditwasafairhearingandtherewasnotenoughevidencetoprovideproofitwasnot.MayorProTemFrancisalsoconcurred.CityofFortCollinsPage323CityCouncilProceedings
