Re: July 12, 2022 Work Session Summary: Water Adequacy Determination Review Process

On July 12, 2022, Mayor Arndt, Mayor Pro Tem Francis, and Councilmembers Peel, Pignataro, Ohlson, Canonico,
and Gutowsky participated. Staff members included Jenny Axmacher, Caryn Champine, Rebecca Everette, Eric
Potyondy, and Paul Sizemore.
Staff presented an overview of key components of the Draft Water Adequacy Determination Review Process,
including the existing process, the need for updates, proposed changes, the proposed project milestones, outreach
and plan for the adoption for code updates.
Discussion:
x Staff clarified that the current process does not include significant review of established provider operations.
x Staff clarified that the details on how a new provider might be less expensive are unclear as we do not
currently have a proposal to consider.
x Staff clarified that water impacts density because tap fees for multifamily or mixed-use buildings are
cumulatively higher than a tap fee for a single-family home.
x Staff clarified that financial stability of new providers will be assessed, the need for a security will be
evaluated, and there are opportunities to consider what CDPHE does already to streamline the process.
x A desire was expressed to provide more in-depth review of the established providers as part of the updated
process.
x Concern about utilizing Water Commission in the decision-making process, and support for staff-level
decisions.
x Support for creating criteria that would apply to any new entity and not specifically for a single project.
x Questions about how tap fees are set for the various providers.
Next Steps:
x Staff will move forward with drafting updates to the process.
x The first milestone will be to review established service provider requirements for new development and
information on how tap fees are set will be obtained and communicated back to Council.
