Re: June 28, 2022 Work Session Summary: Draft 1041 Regulations
On June 28, 2022, Mayor Arndt, Mayor Pro Tem Francis, and Councilmembers Peel, Pignataro, Ohlson, and
Gutowsky participated. Staff members included Kelly Smith, Caryn Champine, Rebecca Everette and Paul
Sizemore.
Staff presented an overview of key components of the Draft 1041 Regulations, the outreach and research
performed to date, next steps in the engagement process, and schedule for full adoption.
Discussion:
x Staff clarified that regulations apply to only development within City limits.
x Staff clarified the scope of the regulations versus the scope of the moratorium.
x A desire was expressed to establish a time period for holding a pre-application process to align with
the legislative intent of the 90-day period.
x Some concern over the term “significant” as being arbitrary and potentially too high of bar.
x There was support for a tiered review process and the overall timeline as long as the regulations are
done right.
x Take a closer look at the exemptions to make sure they don’t result in loopholes.
x Requested a SAR response from staff that addresses comments on the draft regulations from Save
the Poudre.
x Requested a balanced engagement process to ensure entities being regulated are not carrying more
influence than those affected by projects we are regulating.

x Staff has included a list of focus group participants in the engagement plan to provide transparency
on who has been engaged in discussions so far.
Next Steps:
x Staff agreed to communicate schedule delays that may warrant an extension on the moratorium.
x Staff will begin engaging focus groups and the public on draft regulations for refinement.
x Staff will be responding to comments from Save the Poudre through a formal SAR.
