The purpose of this work session is to:
1. Provide updates on progress for the Land Use Code (LUC) Phase 1 Update, which implements
several Housing Strategic Plan strategies:
a. Assess displacement and gentrification risk (Strategy 1);
b. Remove barriers to the development of accessory dwelling units (Strategy 7);
c. Recalibrate existing incentives to reflect current market conditions (Strategy 13);
d. Create additional development incentives for affordable housing (Strategy 14);
e. Explore financing and other barriers to missing middle and innovative housing (Strategy 15);
and
f. Remove barriers to allowed densities through code revisions (Strategy 16).

The purpose of this work session is to provide an update on the progress of Transit Master Plan
(TMP) projects and seek feedback from Council. Transfort currently has several projects in various
stages of completion, including the West Elizabeth Bus Rapid Transit (BRT) corridor, North College
Transit Oriented Development Study, Fleet Electrification, Funding and Fare Study, and others. This
work session will provide milestone updates on all current large projects and briefly preview future
projects.
3. Active Modes Plan. (staff: Cortney Geary; 10 minute presentation; 30 minute discussion)
The purpose of this item is to provide an update on progress developing the Active Modes Plan and
seek feedback from Council. The Active Modes Plan will combine and update the 2011 Pedestrian
Plan and 2014 Bicycle Plan as well as incorporating micromobility devices such as skateboards and
scooters. The project team is finalizing the visioning and existing conditions phases and has started
drafting recommendations and developing a prioritization framework. The plan is anticipated for
Council adoption in August 2022.

Phase 1 Land Use Code Update - Housing Diagnostic Report.
EXECUTIVE SUMMARY
The purpose of this work session is to:

BACKGROUND
In March 2021, in conjunction with the adoption of the Housing Strategic Plan (HSP), Council unanimously
approved an off-cycle appropriation to fund the Land Use Code (LUC) Phase 1 updates. These updates are
focused on housing-related changes to the code and a reorganization of the LUC to improve usability and clarity.
The LUC Phase 1 Update implements policy direction from City Plan, the Housing Strategic Plan, the Transit
Master Plan, and the Our Climate Future Plan.

The LUC Phase 1 project began in summer 2021. Work completed to date includes:
• Policy analysis and synthesis;
• A series of community engagement events to inform and seek input (September/October 2021);
• An Equity and Opportunity Assessment (November 2021); and
• The Diagnostic Report (January 2022).
Code drafting is expected to commence in early 2022 with a public review draft available in April. Staff expects to
present LUC changes for consideration of adoption in late spring 2022.
Diagnostic Report: Overview
Progress to share with Council at this work session focuses on the findings and recommendations of the LUC
Phase 1 Diagnostic Report also shared via memorandum on January 3, 2022. (Attachment 1) The Diagnostic
Report was completed to evaluate the current Land Use Code (LUC), identify existing regulatory barriers to
housing supply and affordability, and outline key findings and recommendations to guide the development of draft
code language to address the findings.
The Diagnostic Report is centered around the place types identified in City Plan. The project team analyzed each
place type and conducted pro forma (development) analyses for a range of different prototypes to determine
potential future housing capacity, estimate a place type’s affordability range, and identify barriers to housing
supply and affordability. Findings from the Diagnostic Report suggest several areas of potential improvement,
noting that the current LUC:
1. Does not support future Priority Place Types;
2. Limits housing capacity;
3. Does not prioritize housing capacity, diversity, or affordability along transit corridors; and
4. Is difficult to use.
The Diagnostic Report includes recommendations for each of the four key findings. These recommendations are
summarized below.
Finding 1: The LUC does not support future Priority Place Types
The City Plan Structure Plan <https://www.fcgov.com/cityplan/structure-plan> provides a framework for the
ultimate buildout of Fort Collins. Five Priority Place Types have been identified to help illustrate the challenges
and opportunities associated with infill and redevelopment in parts of the community that are likely to change
significantly over the next 20 years. A single place type may be implemented through multiple zone districts,
which often have varying regulations.
The Priority Place Types are important to the LUC Phase 1 Updates because they offer the greatest opportunities
for additional housing capacity and a wider range of housing options. The mixed neighborhood place type, for
example, makes up 34% of the city’s land area but accounts for 63% of our future housing capacity under the
current LUC (Diagnostic Report, pg. 20).
Recommendations: The Diagnostic Report suggests that the current LUC does not provide a clear, context-
specific framework for infill and redevelopment in the Priority Place Types. Rather, the LUC has many standards
that assume a “greenfield” or undeveloped site. As Fort Collins continues to grow, more development will take
place in existing neighborhoods and commercial areas. Adjusting land use regulations to guide infill and
redevelopment more appropriately is the focus of the recommendations for Finding #1:
1. Update the permitted residential uses and review types within Priority Place Types to allow greater housing
diversity by right (i.e., through Basic Development Review or a building permit process).
2. Update Zones that comprise Priority Place Types to more efficiently guide compatible infill (in the core) and
development patterns envisioned in adopted city plans (outside the core).
3. Update Use Standards & Definitions (e.g. ADU’s)

Finding 2: The LUC limits housing capacity
City Plan estimated that a total of about 30,000 additional homes will be needed in Fort Collins by 2040. Homes of
all types are necessary; however, higher-density housing (>20 units/acre) must be built at the fastest rate of all to
keep up with demand (Diagnostic Report, pg. 44). The Diagnostic Report indicates that the amount of housing
permitted under the current LUC is too low to meet our community’s needs for housing now and into the future.
Additionally, data compiled for the Housing Strategic Plan (HSP) found that the housing needs in Fort Collins are
concentrated at the lower end of the income spectrum. For renters, the need is greatest at 60% AMI and below
($57,540 for a 4-person household or $46,080 for a 2-person household); for owners, the need is greatest at
120% AMI and below ($115,000 for a 4-person household or $92,160 for a 2-person household). The City’s
current regulations and the cost to construct housing make it infeasible to produce new housing that would be
affordable at these income levels in most zone districts.

Recommendations: To ensure that Fort Collins has sufficient housing capacity to meet our community’s needs
now and into the future, the recommendations in Finding #2 suggests several changes to the ways the LUC
currently regulates housing development. More effective incentives for deed-restricted Affordable housing are
also suggested to support housing that is more aligned with the community needs identified in the HSP:

Finding 3: The LUC does not prioritize housing capacity, diversity, or affordability along transit corridors
When City Plan was updated in 2018, it also included updates to the City’s Transit Master Plan
<https://www.fcgov.com/cityplan/> and Transportation Master Plan <https://www.fcgov.com/cityplan/>. To achieve
the vision of City Plan, our regulatory structure for land use must support our investments in transit and multi-
modal transportation infrastructure. And to achieve the vision of the Our Climate Future plan, a greater emphasis
on the links between land use and transportation is needed to achieve reductions in Greenhouse gas emissions
(GHG), fewer Vehicle Miles Traveled (VMT), and higher transit ridership.
The Diagnostic Report shows that the most prevalent zone districts within ¼ mile of transit corridors are Low-
Density Residential (RL) and Low-Density Mixed-Use Neighborhood (LMN). The amount of housing permitted in
these zone districts is too low to support higher-frequency (30 min or less) transit service. Additionally, the
Diagnostic Report indicates that the existing Transit-Oriented Development (TOD) Overlay Zone does not have
effective incentives to encourage the development of Affordable housing along transit corridors.
Recommendations: To better support current and future transit investments, and to encourage more Affordable
housing near transit, Finding #3 suggests allowing more housing by right within a 5-minute walk of transit
corridors, enhancing incentives for affordable housing, and recalibrating parking requirements.
7. Update Zones within a 5-minute walk to transit to allow greater housing diversity and capacity by right.
8. Calibrate effective bonus incentives for deed-restricted affordable housing and develop monitoring tools.
9. Recalibrate parking requirements to improve residential capacity in TOD.
Finding 4: The LUC is difficult to use
There are many different people who need to use and interpret the LUC. Residents, developers, staff, Planning
and Zoning Commission members, Council, and many others interact with the LUC. Some may encounter the
LUC only once when they try to build an accessory unit or expand their home, for example. Others consult the
LUC daily. Regardless, anyone who needs to use the LUC should be able to find the information quickly and
easily, and in an accessible, understandable format.
The Diagnostic Report identifies many areas where the current LUC is hard to follow or where text could be
transformed into an illustration or graphic instead. Graphic styles throughout the LUC are also inconsistent, which
is likely the result of many separate amendments and changes to the code since its adoption in 1997.
Recommendations: To make the code easier to use and understand, Finding #4 recommends a more graphic
approach to communicate land use standards, along with a review of the definitions and rules of measurement in
the LUC to ensure that those standards are consistent throughout the LUC and aligned with adopted plans.
10. Develop consistent graphic templates for building form and use standards.
11. Reformat Zones so Form Standards and Graphics are consistent and more effectively communicate
requirements.
12. Update Use Standards, Definitions, and Rules of Measurement in alignment with adopted plans and define
density consistently.
13. Change name from “Land Use Code” to “Land Development Code”.
14. Rename Zones (without boundary changes) and consolidate to be more intuitive with clear hierarchy.

Tensions and Tradeoffs:
As with any significant change to City policies and regulations, drafting the LUC Phase 1 Updates will require
careful consideration of tensions and tradeoffs. At this work session, the project team is seeking Council’s insights
on the tradeoffs involved in addressing the Diagnostic Report recommendations; in particular:
a. Enabling more housing diversity and capacity by right in Priority Place Types and within a 5-minute walk
to transit. (Recommendations 1, 4, and 8)
b. Recalibrating parking requirements in Priority Place Types and within a 5-minute walk to transit.
(Recommendations 4 and 10)
c. Regulating development through form-based standards. (Recommendations 2, 5, and 7)
d. Expanding incentives for Affordable Housing development. (Recommendations 6 and 9)
NEXT STEPS
As the LUC Phase 1 Update shifts into the drafting phase, Council can expect an approach that incorporates
broad community engagement and education leading up to the release of a public draft this spring. Planned
engagement activities include:
• Virtual engagement opportunities to educate, seek input, and keep the public informed
• Presentations to a wide range of Boards and Commissions
• Briefings with all Councilmembers and Planning and Zoning Commission members
• Dialogues with community groups and interested members of the public
• Monthly advisory meetings with the Land Use Code Phase 1 Working Group
A public draft code is anticipated in April 2022. Staff intend to schedule a final work session with Council to
discuss the draft code prior to consideration of adoption in late spring 2022.
The LUC Phase 1 updates are focused on housing-related changes and code reorganization, and multiple phases
will be required to update the entire LUC. Accordingly, staff is also planning a LUC Phase 2 update, which will
address remaining issues in commercial and industrial areas and will also incorporate code changes that are not
directly tied to housing (e.g., landscape standards, site design). Staff anticipates preparing a Budgeting for
Outcomes (BFO) offer to fund the LUC Phase 2 project for the 2023-24 budget cycle.

Priority Place Types Overview
The Place Types with the greatest supply of vacant and
redevelopable land and zoned capacity are Mixed
Neighborhoods and four Mixed Use Districts comprised of Mixed
Employment, Urban Mixed Use, Suburban Mixed Use, and
Neighborhood Mixed Use Districts.
City Plan acknowledges that much of the needed growth is going
to be infill and redevelopment, however, the current code does
not provide clear guidance for these situations – most of the
standards and guidance are for greenfield development. This
mismatch is most apparent in the “Core” and nearby areas where
there are a significant number of non-conforming lots and
structures that resulted from code changes made after 1929 to
bring these areas up to “modern” postwar standards. While
investment and infill activity in these older neighborhoods are
proof of their desirability today, the code makes it difficult to
develop buildings that “fit” in context sensitive ways.

in most commercial/mixed use zones and the
Employment (E) zone. A small infill lot is used to
test feasibility where site area is more constrained.
●Minimum feasible rent on this prototype is
estimated at about $2,100. This is affordable to a
household earning about $92,000, or 96% of AMI.
●The primary barrier to deeper affordability for this
prototype is minimum off-street parking
requirements. A lower parking ratio would allow
more efficient use of the site and to spread fixed
costs across more dwelling units.
●A secondary barrier to affordability is minimum
setbacks. Residential buildings are subject to
minimum yard setbacks, even in commercial or
employment zones. These setback areas occupy
28% of the site, preventing additional units and a
more efficient use of the site.

prototype for mixed use districts.
●The city’s current commercial/mixed-use zones (CC, CG, NC)
and the employment district (E) apply a similar set of
standards to mixed use development.
●The NC and the CC zone allow up to 5 stories; however, it is
generally not feasible to reach a 5-story density level on a
smaller site unless the parking is structured or underground.
This adds significant costs compared with surface parking. In
most locations, market rents would not offset those costs.
Thus, this prototype tests the affordability of a 4-story mixed
use building with surface parking.
●Minimum feasible rent on this prototype is estimated at
about $2,500. This is affordable to a household earning
about $110,000, or 115% of AMI. This estimate is higher than
other multi-family prototypes due to higher construction
costs associated with mixed use buildings and relatively low
estimated rents on the commercial space in the building.
●The primary barrier to deeper affordability for this
prototype is minimum off-street parking requirements. This
prototype assumes a ratio of 1.88 spaces per unit, including
spaces for the commercial uses. About 2/3 of the site is
occupied by surface parking. A lower parking ratio would
allow more efficient use of the site.

The purpose of this work session is to provide an update on the progress of Transit Master Plan (TMP) projects
and seek feedback from Council. Transfort currently has several projects in various stages of completion,
including the West Elizabeth Bus Rapid Transit (BRT) corridor, North College Transit Oriented Development
Study, Fleet Electrification, Funding and Fare Study, and others. This work session will provide milestone updates
on all current large projects and briefly preview future projects.
GENERAL DIRECTION SOUGHT AND SPECIFIC QUESTIONS TO BE ANSWERED
What feedback and questions do Councilmembers have regarding work underway and next steps?
BACKGROUND / DISCUSSION
The Transit Master Plan (TMP), adopted by Council in April of 2019, outlines the vision and policies for expanding
the transit system through 2040, according to current and future demand. With the implementation of MAX,
Transfort saw ridership skyrocket, while nearly all transit systems in the country saw declines in ridership. From
2014-2019 Transfort ridership more than doubled.
Building on this success, the TMP is an ambitious plan intended to transform mobility options throughout the City
and region. This plan is also key to the City’s Climate Action Plan. Plan highlights are described in the following
graphic:

Current Transit Conditions
Transit ridership was significantly impacted during the early phases of the pandemic. In April of 2020, ridership
plummeted, down 92%. While still in recovery, ridership has slowly returned, today down more than 50% below
2019 baselines. Results from surveys conducted in quarters three and four of 2020 suggest riders will return to
transit when they feel the pandemic is no longer a harm to themselves and their families. The most recent surge
of the Omicron variant has stalled previous growth trends.
Also, current service reductions are heavily impacting ridership. While an estimated 20% of service was
suspended during the first phases of the pandemic, current service reductions are due to extreme bus operator
shortages. Like many service industries around the country and the region, the transit industry has experienced a
similar “great resignation.” Many operators chose to leave the profession for different work or take earlier than
expected retirement.
Further exacerbating the situation, the summer of 2021 saw the slowest recruitment in years, with several months
where zero applicants applied for dozens of open positions. Transfort has responded by raising wages and
creating hiring incentives. The workforce is only now beginning to see impacts as hiring has improved and several
new operators have begun training. Staff are optimistic that some services will return in the coming months.
Despite these setbacks from the pandemic, staff continues work on a variety of projects and plans to advance
initiatives outlined in the Transit Master Plan. With the recent passage of the Federal Infrastructure Investment
and Jobs Act, many of these projects may come to fruition sooner rather than later. While specific apportionment
tables have not yet been released from the Federal Transit Administration (FTA), it is expected that transit grants
for both operations and capital projects could increase by 30-40% each year of the 5-year spending package.
Transfort is well positioned for this increase in Federal support, with several projects likely eligible for grant
funding.
Current Transit Projects
Even with these extreme operational impacts, staff have continued to plan and prepare for a return to past growth
trends and future projections. Several major projects are in various stages of development in support of the
Transit Master Plan, including:

West Elizabeth Bus Rapid Transit (BRT) - This project is near completion of 30% design which will result in
eligibility for Small Starts grant funding (the same program that helped complete MAX) as early as 2023, if local
match can be secured. This project is currently in Project Development with the Federal Transit Administration
(FTA).
North College BRT extension - A transit-oriented development (TOD) study is currently being conducted and is
expected to complete in quarter 2 of 2022.
North Transit Maintenance Facility - Transfort has exceeded capacity at the Transit Maintenance Facility on
Portner Road and further service expansion will require an additional facility. Staff are currently identifying
potential locations for the new facility and will soon have a funding need to purchase this real estate. Once design
is complete, staff will seek federal grant funding to build this project.
Fleet Electrification - Phase one of the Transfort Fleet Electrification Plan is complete with phase two expected
in quarter 3 of 2022. Staff have had great success securing grant funding for battery electric buses and charging
equipment. The first two electric buses were delivered in January and will be in service this spring. Over the next
two years nine more electric buses will be purchased which will replace approximately 20% of the Transfort fleet
of diesel and compressed natural gas (CNG) fueled buses.
Poudre School District Collaboration Study - A 2022 budget offer was advanced to perform an in-depth study
of the operations, planning and budgets of PSD student transportation and Transfort to determine areas where
improved efficiencies and collaboration could occur. This study will research and examine models in cities where
there is more robust use of the public transit system by K-12 students, and where both physical and financial
resources are better coordinated between the transit provider(s) and the school district(s). The study should also
examine relevant federal regulations and case law that may create barriers to collaboration in this area.
This offer supports the Council Priority within Transportation and Mobility, “Advance Transit Initiatives that
Remove Barriers.” The specific item addressed is, “2022: Budgeting For Outcomes Offer submitted with a focus
on collaboration with Poudre School District.”
Funding and Fare Study - It is important to note that the cost estimates outlined in the TMP were based on 2016
operating figures and assumptions. These projections also did not account for the transition of the Transfort fleet
from CNG to zero-emission vehicles, which have a significantly higher up-front cost, but an expected lower
operating and maintenance cost over the life of the vehicle. Staff have hired a consultant to conduct a
comprehensive study which will include:
• Updated capital, operating and maintenance estimates for the 20-year span of the TMP
• Identification of a preferred, dedicated, and permanent funding source or sources, including extensive public
outreach
• Full analysis of the current fare structure and associated costs, as well as feasibility of a fare-free system
The Funding Study is expected to conclude no later than quarter 4 of 2022.
Future Transit Projects
Beyond the projects listed above, there are several initiatives from the TMP that will begin development soon:
Micro Transit Pilot - As noted above, there are areas of the City that do not currently meet the conditions for
fixed route bus service, identified as Innovation Zones. While they might not have the population density to
support traditional bus service, these residents still need better transportation options. Micro Transit is a relatively
new concept where shared, on demand services can be provided to quickly connect to the rest of the
transportation network.

Mobility Hubs - Designed locations where Micro Transit, bus services and other mobility services can connect
are called Mobility Hubs. These locations can concentrate the various mobility options in one location, including
ebikes and scooters, transportation network companies (such as Uber and Lyft), car shares, regional transit, and
bike lockers. These hubs can come in a variety of sizes and built infrastructure.
Mobility As a Service (MAAS) - These various mobility options can all be connected through technology. Mobile
phone apps or internet connected kiosks can allow customers to purchase a bus ticket, rent a scooter or hail a
taxi, all through the same interface. This creates the concept of Mobility As A Service with options and scheduling
all in one space.
More Regional Connections - One of the most successful routes in the network is the regional FLEX route.
During the pandemic, when other routes were suspended, FLEX was the first route returned to service due to
customer demand. Transfort will continue to work with partners to connect mobility across the region and state.
This could be expansion of existing regional bus services, developing new routes and/or support for front range
passenger rail projects.

BACKGROUND / DISCUSSION
The City is currently developing an Active Modes Plan, which will combine and update the City’s 2011 Pedestrian
Plan and 2014 Bicycle Plan. The plan will incorporate not only pedestrians and bicyclists, but also micro-mobility
devices such as scooters and skateboards. The geographic scope of the plan is the Growth Management Area
and will incorporate key regional connections beyond the city’s jurisdictional boundaries. This update is focused
on identifying key opportunities to significantly improve and expand the City’s existing active modes networks, and
support facilities, policies, and programs. The plan will focus on making it easy, safe, and attractive for people of
all ages and abilities to use active modes of transportation.
The Active Modes Plan is a joint effort between the City and Colorado State University and is funded by both
entities. The City funding is derived from bicycle and pedestrian Community Capital Improvement Program funds.
The consulting firm Toole Design Group was selected to support the development of the plan through a
competitive request for proposals process. Kicking off in September 2021, the project team is currently finalizing
the Visioning and Existing Conditions phases and has started drafting recommendations and developing a
prioritization framework. The plan is anticipated for Council adoption in August 2022.

EXISTING CONDITIONS
To get a sense of the state of active transportation in Fort Collins today, the project team is analyzing existing
conditions data. The analysis includes a review of data related to relevant planning, design, policy, and
programmatic efforts; demographic data; land use and zoning; travel behaviors, speeds, and volumes; crash
patterns; existing infrastructure location, type, and condition; critical destinations and connections; and resident
requests received by the City for infrastructure improvements. Toole Design Group is currently finalizing the
existing conditions report. The report will highlight existing issues and opportunities for active modes in Fort
Collins.
COMMUNITY ENGAGEMENT
The plan will be informed not only by data analysis, but also on feedback from the community. The project team is
seeking broad feedback from stakeholders and the community at-large, with an emphasis on elevating the voices
of historically underrepresented groups. A Technical Advisory Committee, composed primarily of City staff and
partner agencies, and a Community Advisory Committee, composed of pedestrian and bicycle advocates and
community members of diverse backgrounds, provide feedback at key junctures throughout the plan
development. The Bicycle Advisory Committee, Transportation Board, and other interested Boards and
Commissions are also engaged and providing input. To reach the community at-large, the project team is utilizing
both traditional engagement methods such as visioning workshops and focus group meetings as well as non-
traditional methods that “meet people where they are” such as pop-up events along trails and at community
events.
Two examples of engagement methods that have focused on reaching historically underrepresented groups
include conducting focus groups with middle school students and contracting with Community Connectors, a local
Latina-owned business which hires mobile home community residents to survey their neighbors. For the middle
school focus groups, nearly 350 students participated in an in-person mapping activity led by the City’s Safe
Routes to School Program. The students identified places they currently walk/bike/skate/scooter or would like to
be able to as well as barriers to using active modes of transportation. Thanks to the work of the Community
Connectors, 294 Spanish-speaking residents of mobile home communities in and around Fort Collins participated
in the community survey. This represents 38% of all survey responses received.
Total participation in the public engagement activities thus far is as follows:
• Visioning questionnaire = ~350 participants
• Community Survey = 771 participants
• Mapping Activity = 879 participants; 1,376 submissions

VISIONING
Based on all the feedback received from the community, the project team has drafted the following vision and
goals. Each goal is supported by a set of specific objectives. The vision and goals will serve as an overarching
framework guiding the prioritization framework, recommendations, and implementation strategy.
Vision
Active transportation is an integral part of daily life and the local cultural experience. Fort Collins is a place where
walking, bicycling, and rolling are safe, accessible, and desired by people of all ages and abilities.
Goals
• Network Connectivity - Create continuous, low-stress bicycle and pedestrian networks.
• Access - Foster a transportation network for all people regardless of skill level, age, background, or ability.
• Safety and Comfort - Develop and maintain a safe and comfortable transportation network that prioritizes
active transportation users.
• Health and Equity - Provide equitable programs and opportunities for walking and bicycling that help improve
physical activity and environmental health throughout the community.
• Community Culture - Expand upon programs and education to strengthen the culture of respect and
responsibility for all transportation system users.
NEXT STEPS
The project team is currently finalizing the vision, goals, and objectives and the existing conditions report. The
timeline for the remaining phases of the plan is as follows. The team will seek feedback from stakeholders and the
community at-large on the recommendations and prioritization framework as well as the draft plan:
